Chairman Borgna discussed the case 1si`„si:or.y and s..,he st;as °3' evaluation,.,
The applicant r'etti.e >t,s a variance of the front tjar'rub build-
ing setback from 25' to 22', 9" a variance of 2', 3" in an
RS -3 district. The house was built with a portion of the
garage over the building line and has been used as a made]
home for the Elm Creek subdivision. The house is located on
a corner„ lot at the end of a curve! street, There are existing
single gamily homes on three sides and a drainage channel to the
rear of the house. The property is not exceptionally steep,
narrow or in the floodplain, although there are several utility
and drainage easements on the lot that restrict the buildable
area.,
The Owasso mooning Code states the following provisions for an
application for a variance:
Section 1470.1.
The Board of Adjustment, upon application, and after notice
and public hearing, and subject to the procedural substan-
tive standards hereinafter set forth, may grant such
variance from the tennis of this code as will not cause sub-
stantial detriment to the public: goad or impair the spirit,
purposes and intent of this code, or the Comprehensive Plan,
whereby reason of exceptional narrowness, shallowness, shape,
topography, or other extraordinary or exceptional situation,
condition, or circumstance peculiar to a particular property,
the literal enforcement of the code will result in unnecessary
hardship. The Board shall not vary any jurisdictional require-
ment, such as notice. The Board shall l riot; permit by variance

a principal ipal use not otherwise permitted in the applicable
district, it being the expressed spirit and intent of this
code 'tha..t', a change of the permitted principal uses shall be

conditions or circumstances which are peculiar to

Comprehensive Plan.
The Board should consider the cr'1zi,%ria for granting variances to se
whether this application would meet those standards, The effects that
approval of This application would have on the surrounding properties
should be considered, also.
Mr. Beale, applicant, spoke in support t'a.d: the application and explained
whey the variance was sought. There were no other persons present in
support or in opposition to the application. Board members discussed
the variance with the applicant at length.
R. Helm moved denial of the application for a. variance. taro Trammel
seconded the motion.

There being no `Further business to consider, dim Helm moved to adjourn
the meeting. L. Trammel l seconded the motion.
