MINUTES
Monday, July 28, 1982, 4:00 p.m.

1. Chairman Borgna called the meeting to order at 4:00 p.m., and,
2. declared a quorum present.
3. The reading of the minutes of June 9 and July 7, 1982, was dispensed with
due to the fact that Board members reviewed copies sent in the mail. L,
Trammel moved to approve the minutes as written. R. Helm seconded the
motion,

PUBLIC HEARING
5. TCBDA-231 Referral - Howard Massinoale
Due to the large number of people present to discuss TCBOA-231, Chairman
Borgna requested that this case be heard first, Mr. Norton, applicant for
OBOA-47, had no objection,
Staff gave the Case History, Mr. and Mrs, Massingale, applicants, spoke
for the application, stating a lot split for the property had already been
approved and that they were requesting permission to place a mobile home on
the resulting second in a residential subdivision for their children's first
home- They stated that FHA requirements for the mobile home loan are to own
at least 112 acre on which to locate the mobile home. They said if this ap-
plication is denied they would forfeit the loan. In reply to a Board member's
question, they stated they were applying for the mobile home with no time
limit,
Harold Charney, attorney for neighborhood protestants, spoke in opposition
to the application and presented a protest petition with signatures of 34
neighborhood residents. He stated that the mobile home would destroy the
integrity of the subdivision, which is a beautiful neighborhood of $100,000
homes, He stated that the devaluation of the homes would far outweigh the
hardship of the Massingale children, He presented a map of the subdivision
showing property owners: 26 oppos-ed, 4 no opinion, 2 in favor and 6 exist-
ing trailers (including the applicants' trailer). He stated that the
subdivider intended to restrict mobile homes, but neglected to file it
legally. He stated original owners had to sign an agreement they would not,

move in a mobile home. There were approximately 20 to 25 people present
to protest the application
The Massingales presented photographs of the mobile home in support of
their application, They stated the children wanted to buy other land and
move the trailer eventually,
Board members discussed the application and the surrounding neighborhood,
The applicant and Mr. Charney answered various questions, R, Helm moved
to recommend that the County Board of Adjustment deny the application based
on the surrounding land uses and the protestants, L. Trammel seconded the
motion,

Motion carried 5-0-0,
The Board directed staff to include in the recommendation to the County, a
request for the County Inspector to investigate the legal status of the
other 5 mobile homes in the subdivision.
4, OBOA-47 Charles Norton
Staff presented the Case History and the Staff Evaluation:
The applicant requests a Special Exception to permit construction
of 30 units of ministorage on the rear of a lot zoned CG commercial.
The property currently has a 50' x 120' commercial building. The
property is surrounded on the west and north by commercial zoning,
light industrial zoning lies to the south and multi-family zoning
to the east across a drainageway. There are two driveways onto 83rd
Street North, the only street frontage for the property, The appli--
cant is not intending to extend water, sewer or electric service to
the units,
The Technical Advisory Committee may have additional comments by
the public hearing date.
Charles Norton spoke in support of the application, explan4ng what he wished
to do- In response to a Board question, he said security for the units would
be no problem because the only way to come in would be through the ditch, He
said there would be no electricity to the units. He stated the existing com-
mercial building had been leased to a stakehouse and dance studio, and that
he had signed to pave the lot within 90 days. He referred to the letter from
Robert Green, in protest to the application, attached to and made a part of
these minutes saying he had ignored the letter because "its obvious what he
wants", Staff submitted a letter written to Mr. Norton after the TAC meeting
requesting additional information for the site plan, Mr, Norton said he had
not responded to the letter because all the information needed was already on

the site plan. He stated he had not planned to put up a security fence,,
Chairman Borgna said that the Board was at a disadvantage without adequate
data on the site plan. Staff related the TAC requirements included in the
letter of July 8, 1982
