MINUTES
Wednesday, April 21, 1982, 4:00 p.m.

1. Chairman Borgna called the meeting to order at 4:00 p.m., an
2n declared a quorum present.
3. The reading of the minutes of March 31, 1982, was dispensed with due to
the fact that Board members reviewed copies sent in the mail. R. Helm
moved to approve the minutes as written. G. White seconded the motion.
Aye, Helm,,, White, Trammel and Borgna.
Nay2 None.
Motion carried 4-0-0.
PUBLIC HEARING
4. OBOA-46.-Lonmshore Construction Company - The Chair reviewed the case
AbUry and -W-staff TvaluatiAT
The applicant requests a Variance in an RS-3 district to
permit a side yard building line reduction from 5' to 4' on each
side of the lot, The lots in Hale Addition were platted 60' wide
prior to the time the property was annexed to the city. The
Board should consider whether a Variance of this nature would have
any detrimental effect to the property itself or to surrounding
properties,
Board members discussed the application. The applicant was not present.
There were no persons present to support or oppose the application. Chair
Borgna related that the Building Inspector stated the structure would ex-
tend only three inches into the 5' setback. The Chair introduced a letter
from H. D. Hale concerning the application and directed that it be made a
part of the minutes. The letter is attached,
R. Helm moved to approve a Variance of zoning regulations to permit a 4'
sideyard setback on either side of Lot 13, Block 3, Hale Addition. L,
Trammel seconded the motion.
Aye: Helm, Trammel, White and Borgna.
Nay: None®
Motion carried 4-0-0.

5. OBOA-47 Lynn F
Chairman Borgna reviewed the case history. The applicant was not present.
There were no persons present to support or oppose the application. Staff
related that the site plan was received only the previous Friday and the
TAG members had not had time to meet with the applicant, Staff related that
comments received from TAC members indicated that some portions of the site
plan might have to be redrawn.
G. White moved to continue the public hearing to the next meeting after the
7AC meets to review the site plan. R. Helm seconded the motion.
Aye: White, Helm, Borgna and Trammel.
Nay: None.
Motion carried 4-0-0.
NEW AND GENERAL BUSINESS
6. & D. Hale Letter
Board members discussed the letter from H. D. Hale dated April 12, 1982
written in reference to OBOk-46. The Board directed the following comments
be made a part of the official record: The letter should have been directed
to the Board and not to staff, who acts as secretary to the Board. The
Board felt the letter was "...completely out of order, inaccurate..." and
had" to validity to it." They stated that enforcement of private covenants
of a subdivision plat is a civil matter and does not supercede the power of
the Board of Adjustment to enforce zoning regulations.
There being no further business to consider, Richard Helm moved to
adjourn the meeting, G. White seconded the motion.
Aye: White, Helm, Borgna and Trammel.
Nay: None.
Motion carried 4-0-0. The meeting was adjourned at 4:23 p.m.
