Chairman Borgna called the meeting to order at 4405 p.m., and, 2a declared a quorum present. 30 The reading of the minutes of September 23, 1981 was dispensed with due to the fact that Board members reviewed copies sent in the mail and G. White moved to approve the -minutes as written. R, Helm seconded the -motion. Aye: Borgna, Trammel, Helm, White and Fick]_e. Nay: None. Motion ca-rried PUBLIC HEARING' /i. OBOA-37 Steve Longsho-re Chairman Borgna discussed the case history and the staff recommendatioi--i- The applicant requests a -variance on a residential lot in an RS-3 district on the backyard setback from 20' to 18', 3". This request results from a lot split action, OLS-29, in which the north 51 of the subject lot, lot 12 was split and added to lot 13 because the house on lot 13 was inadvertently built on the lot line, not leaving a 5' sideyard setback. The lot split left lot 12 with an 18, 3" rear yard rather than a 20' minimum re- quired by the code. The Owasso Planning Commission approved the lot split subject to Owasso Board of Adjustment approval of the variance, The houses on both lots exist and are occupied, Sales of these lots will not be approved without action by Owasso to make these legal lots under Owasso codes. Neither houses or lots will be measurably affected by approval of this variance, Staff recommends approval of the application. Mr. Longshore was present and spoke for the application. No one was present to oppose the application. Board members discussed past problems in BOA cases with similar situations where houses have not been measured correctly and have been built with inadequate setbacks. The Board recalled that they had directed a statement be put on the building permit that it: was the owners' responsibility to make sure that the structure was located correctly. Owasso Board of Adjustment Minutes Page 2 October 7, 1981 They questioned if the building inspector was measuring the footings during inspections to ensure proper location of the buildings. They stated that mistakes like this put the City and Board in a position of having no choice but to approve variances. V Helm moved to approve the application, R. Fickle seconded the motion. Aye: White, Helm, Fickle, Borgna and TrammeY Nay: None. Motion carried 5-0-0. There being no further business to consider, G. White moved to adjourn the meeting. L. Trammel seconded the motion.
