Leon Trammel moved to approve the minutes. Richard. Helm seconded the
motion. Motion carried 3-0 -0.
PUBLIC HEARING

Chairman Borgna discussed the case history and :sail_ explained the reasons
for filing the case. Dr. Whitfield, owner of Lot.. 68C spore in favor of the
application and asked several questions regarding how an OM designation
would affect his development plans, Staff discussed the staff recommenda-
tion
The City of Owasso requests an _i_nterprret.:ation of the Official.
Zoning Map for lots 68A and 68C in Three Lakes Addition from a CS
designation to an OM designation, The property was zoned OM on >`riay
3, 1977 (Case #OZ -30, Ord #209). As the List of subsequent cases
indicates, no other rezoning case has been filed for this property.
Lot 68A was created by lot split OLS-12 approved February 22, 19790
Lot 68C was created by lot.: split. OLS -16 approved July 19, 1979. The
staff recommendations for both actions list the subject: properties
as zoned OM. All other nearby zoning cases reference this property
as zoned OM.
Staff concludes i_hat this property was included as CS on the
Zoning Map in error. The lots were split to meet OM standards, but
they do not meet the bulk and area requirements for a CS district.
Staff supports the interpretation of the zoning classifications of
lots 68A and 68C as OM, medium intensity office.
In the process of researching this case, staff discovered errors
in the legal descriptions of two previous zoning cases - OZ -20
(Ord, 192) and OZ-35 (Ord. 245). Comparing the Exhibit Map to the
OBOA -30 case map, the difference in zoning designations can be seen,

Commercial property at the northeast corner of Highway 169 and
86th Street North and commercial and office property north and
south of 86th Street North west of Three Lakes I and 11 were in-
tended to be rezoned as a part of these two zoning cases. Legal
descriptions for the area were incorrect and were published that
way. Staff recommends approval of the attached case map as the
official zoning map for this area and a recommendation from the
Board of Adjustment of Owasso City Council to amend the above re-
ferenced zoning ordinances to reflect corrected legal descriptions.
General discussion followed. Richard Helm moved to approve the application
subject to staff recommendation, Leon Trammel seconded the motion,

Motion carried 3-0-0,,
Richard Helm moved to approve an emergency clause (See. 1450.3 of the Zoning
Code) due to the city, rather than applicant, error. Leon Trammel seconded
the motion,
For: M. Borgna, L. Trammel and R. Helm,
Against: None.
Motion carried 3-0-0.
5. New and General Business
In response to staff recommendation, the Board recommended to the City
Council that they review Ordinances 192 (OZ-20) and 245 (OZ-35) to correct
the legal description to conform to the official zoning map.
6. There being no further business, the meeting was adjourned at 4:35 p.m.
