HomeMy WebLinkAbout1986.04.15_City Council Minutes42 OWASSO CITY COUNCIL APRIL 15,1986 PAGE ONE On Tuesday, April 15,1986, the Owasso City Council met in a regular session in the Council Chambers at the Community Center per the Notice of Public Hearing and Agenda posted on City Hall bulletin board at 4:00 p.m. on Friday, April 11,1986. ITEM l: CALL TO ORDER The meeting was called to order at 7:00. p.m. with Mayor Spencer presiding. ITEM 2: FLAG SALUTE Flag Salute was led by Mayor Spencer. ITEM 3: ROLL CALL PRESENT: Boyd Spencer, Mayor James Smalley, Vice-Mayor Robert Peel, Councilman Kenneth. Wood, Councilman Von Stockler, Councilman Dan Galloway, City Manager Ronald Cates, City Attorney Jane Buchanan, City Clerk ABSENT: None ITEM 4: CONSIDERATION OF APPROVAL OF MINUTES OF APRIL 1. 1986 Motion was made by Mr. James Smalley, seconded by Mr. Von Stockler, to approve the minutes of April 1,1986, by reference made a part hereto. AYE: Messrs, Smaller; Stockler, Peel, Wood, Spencer NAY: None MOTION: Carried ITEM 5; CONSIDERATION OE' APRROVAL OF WARRANT PAYMENTS Motion was made by Mr. Robert Peel, seconded by Mr. Von Stockler, to approve Warrant Payments, as submitted. AYE: Messrs. Peel, Stockler, Wood, Smalley, Spencer NAY: None MOTION: Carried '~ 43 OWASSO CITY COUNCIL APRIL 15, 1986 PAGE TWO ITEM 6: CONSIDERS-1TION OF SELECTION OF THE C.P.A. FIRM TO AUDIT THE CITY OF OWASSO FOR THE FISCAL YEAR 1985-1986. Mr. Dan Galloway presented the three proposals received by the City. The firms submitting proposals were: Stand- field and O'Dell, Briscoe & Robinson, and Lohrey & Jay. Mr. Galloway recommended the firm of Standfield & O'Dell. After discussion, a motion was made by Mr. Robert Peel, seconded by Mr. Kenneth Wood, that the firm of Lohrey & Jay be rehired for the fiscal year of 1985-1986. AYE: Messrs. Peel, Wood, Stockier, Smalley, Spencer NAY: None MOTION: Carried ITEM 7: CONSIDERATION OF RESOLUTION NO. 86-03 TO RESOLVE THE CITY OF OWASSO'S JOINT PARTICIPATION WITH THE OWASSO CHAMBER OF COMMERCE IN SPONORING THE 1986 TRAIL DAYS CELEBRATION. Mr. Dan Galloway stated the resolution contains the same wording of last years resolution. After discussion, a motion was made by Mr. .Kenneth Wood, seconded by Mr. Von Stockier to adopted Resolution No. 86-03 as presented. AYE: i~iessrs. Wood, Stockier, Smalley, Peel, Spencer NAY: None MOTION: Carried ITEM 8: CONSIDERATION OF REQUEST FROM SIGNS,LTD. (CAPTAIN D'S) TO ALLOW VARIANCES TO SECTIONS OF ORDINANCE NO. 309 WITH REGARD TO THE DENIAL FOR PERMIT FOR GROUND SIGN. ED BOLTON, PRESIDENT Mr. Bolton stated that they are requesting a sign height of 70 feet and sign area of 10'X32' (320 sq. ft) because of the location on the service road. Mr. Bolton feels the size is needed for visibility from the expressway. 44 OWASSO CITY COUNCIL APRIL 15,1986 PAGE THREE Mr. Peel stated that the limit that council has allowed in the past is a height of 60 feet with a sign size of 16 feet X 16 feet. Mr. Galloway stated that council has been consistant in the sign variance that has been allowed as new business have presented their requests. After discussion, NSr. Wood stated he would be willing to hear an alternate proposal from the representatives from Captain D's for a sign that conforms more to the standards set by the city council. A motion was made by Mr. Kenneth Wood, seconded by Mr. Von Stockler, to deny the request for sign variance as requested. AYE: Messrs. Wood, Stockler, Peel, Smalley, Spencer NAY: None MOTION: Carried ITEM 13: CONSIDERATION OF APPOINTMENT OF DOUG MANN AS CITY ATTORNEY. (ADDENDUM TO A ~ .BRA) A motion was made by Mayor Boyd Spencer, seconded by Mr. Robert Peel, to accept Mr. Doug Mann as our next City Attorney. AYE: Spencer, Peel, Smalley, Wood, Stockler NAY: None MOTION: Carried Mayor Spencer stated that he would like to take this opportunity to thank Mr. Ron Cates for the fine excellent work that he did while he was City Attorney. Mr. Cates thanked the Mayor for the compliment. ITEM 10: REPORT FROM CITY MANAGER Mr. Galloway reported the Surplus Item Auction was held as scheduled on Monday, April 14,1986. Items sold well and sales totaled $5,858.00. Mr. Wood asked that Mr. Galloway give a brief report on Sales Tax Receipts. Mr. Galloway stated that sales tax receipts for the month of April reflect what was collected by the Oklahoma Tax Commission for the month of February and that the amount was less than the same time the previous year. 45 OWASSO CITX COUNCIL APRIL 15,198.6 PAGE FOUR Mr. Galloway stated that this has been the first time in twenty months that we have seen a decrease from the same time a previous year. He stated it is worth noting and becoming aware of. ITEM 11: REPORT FROM CITY ATTORNEY No Report. ITEM 12: NEW BUSINESS Mr. James Smalley stated that in view of the election results and the fact that we do not have an elected councilperson from Ward Five, he has consented to go through the thirty day hold- over period so that he may see the projected budget for next year complete. '"At that point in time, which would be the end of next month, I do intend to vacate Ward Five seat and I would so request the council to declare the seat vacant and then they can appoint or call a special election, which ever they choose." "I do wish for this to be a part of the record tonight that I do need to continue to pursue my business interest and I feel like a continuation of council would interfere with my business interest." ~° With no more New Business, Council was recessed at 7:40 p.m. to go into the Owasso Public Works Authority Meeting. Motion was made by Mr. Von Stockler, seconded by Mr. Robert Peel, to reconvene Owasso City Council. AXE: Messrs. Stockler, Peel, L4ood, Smalley, Spencer NAY: None MOTION: Carried Council reconvened at 8:05 p.m. ITEM 9: REQUEST FOR EXECUTIVE SESSION ~ CITY MANAGER'S OFk'ICE f CITY CLERK'S OFFICE AND COURT CLERK'S OFFICE ON PERSONNEL MATTERS. DAN GALLOWAY A motion was made by Mr, Von Stockler, seconded by Mr, Robert Peel, to go into Executive Session. AYE: Messrs. Stockler, Peel, Smalley, Wogd, Spencer NAY: None MOTION: Carried Meeting recessed at 8:07 p.m. and reconvened at 10:10 p.m. 46 OWASSO CITY COUNCIL APRIL 1.5,1986 PAGE FIVE No action was taken at this time on Item 9. A motion was made by Mr. Kenneth Wood, seconded by Mr. Von Stockier, to adjourn. AYE: Messrs. Wood, Stockier, Smalley, Peel, Spencer.
