WHEREAS, public hearings have been held regarding the request for rezoning and a Planned Unit Development of the property herein described, and WHEREAS, the Owasso City Council has considered the recommendation of the Owasso Planning Commission and all statements for or against the requested Planned Unit Development application OZ -14 -05 and PUD- 14 -02. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OWASSO, OKLAHOMA, THAT TO WIT: Section 1. A tract of land located in the Southeast Quarter (SE /4) of Section Thirty (30) of Township Twenty - one (21) North and Range Fourteen (14) East of the Indian Base and Meridian (I.B. &M.), according to the U.S. Government Survey, thereof, Tulsa County, State of Oklahoma; being more particularly described as follows: A tract of land located at 203 East 3rd Street (Lots 1 & 2, Block 1, Original Town of Owasso), a Subdivision in the City of Owasso, Tulsa County, State of Oklahoma be, and the same is hereby zoned from RS -3 (Single Family Residential) TO RD -PUD (Residential Duplex With A PUD Overlay) District. The Site Development Plan and Statement of Intent shall be followed for any development of PUD- 14 -02. Section 2. That all ordinances or parts of ordinances in conflict herewith be, and the same are hereby expressly repealed. Section 3. All ordinances, or parts of ordinances, in conflict with this ordinance are hereby repealed to the extent of the conflict only. Section 4. If any part or parts of this ordinance are deemed unconstitutional, invalid or ineffective, the remaining portion shall not be affected but shall remain in full force and effect. Section 5. The provisions of this ordinance shall become effective thirty (30) days from the date of final passage as provided by state law. Section 6. Stephenson Director of Community Development SUBJECT: Ordinance No. 1038 DATE: October 3, 2014 BACKGROUND: qpp� 6 Iy On September 16, 2014, City Council considered the rezoning and Planned Unit Development for property located at 203 E 3rd Street. The Council voted unanimously to approve rezoning request OZ -14 -05 and PUD- 14 -02, taking the subject property from an RS -3 (Small Lot Single - Family Residential) to RD (Residential Duplex) zoning designation with a PUD Overlay. The attached ordinance officially rezones the property, codifying the action taken by the Council. RECOMMENDATION: Staff recommends approval of Ordinance No. 1038. ATTACHMENTS: Ordinance No. 1038 Map
