QB A 9� 4I : 11 ellogg nIln request from Kellogg Engineering for a r `variance to reduce the required side yard setback to 5 feet in order to accommodate single family homes on 87 acres zoned RS -2 (Residential Single Family) in the general vicinity of the Southwest corner of Dingo and 96th Street North. Ken Foster presented the item. Chip reviewed the staff report and described the property location. The applicant is requesting a variance to reduce the required side yard setback to 5 feet in order to accommodate the residential development of the Bailey Range Subdivision, located on the Southwest corner of dingo and 96`x' Street North. Letters were mailed to all property owners within three -hundred feet and the request was advertised in the Owasso Reporter. Staff recommends approval of OBOA- 05 -11. Mr. Foster requested staff to examine the cul de sac lots in order to assure good, buildable lots. "Trish Hauser moved to approve OBOA 05A 1. David Mall seconded the motion. Chip reviewed the staff`report and described the property location. The applicant is requesting a special exception to allow a gardening tent in the easor's parking lot. Letters were nrrailed to all property owners within three- hundred feet and the request was advertised in the Owasso Reporter. Staff recorrrnrend s approval of OB A-05 19_ for a ten year period, subject to the following conditions: 1. All signage be reviewed by the City Staff to ensure the strict adherence to the Owasso Sign Code. I The applicant must provide on -site trash receptacles. 3. The applicant must get annual approval from the City Planner prior to locating the business on site. 4. Applicant must provide the city with a copy of their Tax i.D, number each year. Discussion was held regarding the length of time that the applicant needs. The Board Members agreed to allow the tent at this location from inid September through Tuesday before Thanksgiving. Mr, Kelly Jones, the Operations Director for Under the Sun Garden Center, was present to answer questions. Also discussed was the gray metal building that is currently being used for office purposes. Mr. Foster expressed his dislike for the metal building. Craig Wallace moved to approve OBOA 05-11 subject to the above staff recommendations. Also subject to the length of operation time being from mid September through the 'ruesday before Thar- lcsgiving. David Hall seconded the motion, A vote on the motion was recorded as follows: AYE: foster, Hauser, Hall, Wallace NAY: None The motion carried 4. -0. 6.
