O OA -05-08 , -: I Dunn - -- A request for a Special Exception of the Owasso Zoning Code, Section 1002, Areawide Special Exception Uses, TO ALLOW FOR A NON - PERMANENT VENDOR IN A COMMERCIAL SHOPPING DISTRICT on property zoned CS (Commercial Shopping Center District). The proposed use of the property is as a snow cone vendor. The subject property is located on the Southwest corner of E. 86th St. N. and N. 125" E. Ave., in front of the Cornerstone, Shopping Center. Joe Ramey presented the item, Chip reviewed the staff report and the property location was described. Staff finds that the applicant is consistent with stated intent of the zoning code and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. Letters were mailed to all property owners within threc-hundred feet and the request was advertised in the Owasso Reporter. Staff recommends approval of OBOA- 05m08, for a ten year period, through September 15, 2014, subject to the following conditions 1 ° All signage be reviewed by the City staff to ensure the strict adherence to the Owasso Sign Code. 2. The applicant must provide on -site trash receptacles. 1 The applicant must get annual approval from the City Planner prior to locating the business on site. 4. Applicant must provide the city with a copy of their T'a_:c 1.1. number each year. BOARD OF ADJUSTMENT July 27, 2005 Page 2 of 3 Discussion was held regarding the staff recommendation of a ton year period, through September 15, 2014. The Board Members discussed the need for this to be changed to a ten year period, through October 1, 2014, Also discussed was the date of the removal of the stand. Ken Foster moved to approve OBOA 05 -08 subject to the above staff recommendations and subject to the modificatIOD of the ten year period, which should read October 1, 2014 Also the removal of the stand to be no later than October 1 of that year. Craig Wallace seconded the motion. A vote on the motion was recorded as follows: AYE: Ramey, foster, Wallace NAY: None REC US1 ; Hauser 'l'he motion carried 3-0. OBOA-05-09 - Scott R04y A. request for a Variance of the Owasso Zoning Code, Section 630 -- Bulk and Area Requi.rernertts in Commercial Districts, Front Yard Setback RegUirernerIts, to allow for a commercial setback to be measured from the curb rather than from the right -of -way. The proposed use of the property is as a recreation center. The property is located on. the southeast corner of E. 14"' St, N. and Fain St. Joe Rarney presented the item and Chip reviewed the staff report. The applicant is requesting the building setback to begin at the back of the curb line, There is no right - -of- way that has been dedicated for 14"' Street, on the north side of the property. The applicant has agreed to dedicate their portion of 14 th Street to be right-of-way. Chip explained that this will go to planning Commission for site plan approval and platting. Letters were sent to property owners within 300' and the request was advertised in the Owasso Reporter. Staff recommends approval of OBOA- 05 --09. Craig Wallace moved to approve OBOA -05 -09 subject to the right-of-way being deeded to the City of Owasso through the approval of the Planning Commission, Ken Foster seconded the motion. A vote on the motion was recorded as follows: AYE: Ramey, Foster, Wallace, Hauser NAY: None The motion carried 4 -0. 6.
