moved to approve the minutes of July 27, 2004, David Hall seconded.

proposed duplex lots 1.3 - -- 25, and 28 - - -- U; and to allow 3' side yard setbacks on the
northern sides ofproposed duplex lots 26, 27, & 44. in a proposed subdivision located at
the northwest corner of N. 1.29 "" E. Ave. and E. 66th St. N.
Duane presented the item and described the property location. "fhe applicant is requesting
a variance to reduce the side yard setback requirements of the duplex lots (lots 18 -- 44.) to
5' on either side; and to further reduce the north side yard setback requirement of duplex
lots 26, 27, and 44 to 3. OPUD 04 -01 was a planned and approved residential
development containing a mix of single family homes and duplex units. The
development standards adopted in the 1UD call for 5' side yard setbacks on either side of
the single family housing sites. The applicant was under the impression that the side yard
setbacks for the duplex units were 5' on either side. In order to correct this oversight a
variance needs to be granted. setters were mailed to all property owners within 300 feet
of the subject property and advertised in the Owasso Reporter. No calls have been
received. Staff recommends approval of the variance request. Discussion was held
regarding the zoning code requirements for side setbacks on duplex units. Duane
explained that the 5' side yard setback already applies to the single family residential lots.
The variance would create equality and uniformity. Concerns were expressed regarding
whether hots 26, 27 and 44 are buildable lots. Ken Foster stated that allowing a 3' side
yard setback on the northern side of lots 26, 27 and 44 creates a very small lot and does
not want to see a variance request in the future for these lots.

Ken Foster moved. to approve; the rcg1L?ested variance to allow 5' side yard setbacks on
either side of proposed duplex lots 18 -- 25, and 2 - -- 43), and to allow 3' si.de yard
setbacks on the northern sides of duplex lots 26, 27, and 44, Joe Rainey seconded the
motion.

OBOA- 04.18 - A request for a Special Exception to allow iJse Unit � 17 (Automotive
and .Allied Activities) or mu-6- -storages on property zoned CS (Commercial Shopping
District) located at the southeast corner of N. 137 Ih E. Ave. and E, 86" St. Tai,
Duane presented the item and described the property location. The applicant is proposing
to develop a mini- storage% facility befriend a proposed. shopping center. ,T'he applicant will
be required to install a screening fence limiting the view Iron} tl��e residential ctistn °�ict.
Letters were railed to all property owners within 300 feet of'the property arid the request
was in the Owasso Reporter. Staff received no phone calls regarding this request. .Staff
recommends approval of the ,special Exception with the following corndi.tionns:
1. That the applicant provides compatible landscaping alone the rear property
line adjacent to the Greens Apartment complex; at least 2" caliper trees should
be planted no more that 25' apart at center. The trees should be of a type that
reaches no less than 30' in height at maturation.
I That a closed trash receptacle be placed on site.
'That the placement of mini- storage be limited to the rear portion of the
property behind a commercial shopping center as proposed in the
accompanying site plan.
David Hall moved to approve the request for a special exception to allow mini - storages
on property zoned CS, subject to the above staff recommendations. Ken Foster seconded
the motion.

Craig Wallace moved to approve the following attachment to the above motion:
4. That the applicant provide a wrought iron fence surrounding the property,
similar to the fence at the Green's Apartments and St John's Medical Center.
