Hall moved to approve the minutes of April 27, 2004. loan Draper seconded.

Duane presented the item_ and described the property location and surrounding land use.
'The applicant is requesting the special exception to allow for a non-permanent vendor in
a light industrial district. Letters were mailed to all property owners within three - hundred

eet of the subject property and advertised in the Owasso Reporter, No calls or
correspondence have been received.
The hoard Members may consider issuing a Special Exception for up to 10 years so long
as the following conditions are met:
L The operation granted the Special_ Exception does not cease operation for more
than one year.
1 Significant changes are not made to the original site plan.
3. Ownership of operation remains unchanged.
41 Written permission from the property owner to operate on site is submitted
annually.
5, The conditions of the Special Exception are met.
Staff recommends granting a 10 year (until Oct. 15, 2013) Special Exception for OBOA-
0410, allowing the proposed snow -cone stand subject to the following conditions:
1, The special exception use is discontinued no later than October 15th of each year.
1 All signage be reviewed by the City Planner to ensure the strict adherence to the
Owasso Sign Code.
3. 'nce applicant must provide on-site, s.raslr receptacles.

located in the southwest corner of E. 86"' St. N, and N. 125"' E. Ave,
Duane presented the item. The applicant is requesting a special exception to allow for a
non permanent vendor in a General Commercial district. The applicant wishes to operate
a snow -cone stand in the northeast corner of the Cornerstone shopping center. Letters
were mailed to all property owners within 300 -feet of the subject property and the request
was advertised in the Owass o Reporter,

Duane introduced the item and described the property location along, with the surrounding
zoning. Duane handed. out a revised plot plan. The applicant is requesting a variance to
encroach upon the 25' front yard and the 10' south side yard setback line in order to _gat
the hose on the lot. The revised plot plan proposed setback variances show 13' font:
yard and 63 side yard on the south side. Due to an irregular lot and the presence of a 50'

difficult. Letters were mailed to all property owners within 300 feet of the subject
property and the request was advertised in the Owasso Reporter, No calls or
correspondence have been received, Staff recommends approval of OBOA 04 -1.2
allowing the variances and setbacks. There were several surrounding property owners
present to oppose the variance, 'I'laey expressed concerns regarding the proposed home
being; aesthetically displeasing, destroying property values acid passible fire danger
because of only 5' on the side yard. John K. Davis, Jr., the applicant, was present to
address these concerns.
After discussion, Joe Ramey moved to approve the Variance request t_11-1OA- 04 -12, David.
Hall seconded the motion.
