ROLL CALL — Ken Foster -moved approve the minutes from the February 24, 2004 meeting, Dan Draper seconded the motion. DCOAa04 -05 ..Un, A request for a VARIANCE from the Owasso Sign Code (Height and Sire Regulations) at 11 `y01 E I6"' St M Duane presented the item and the property location was described. The request is to allow a pole sign 5, taller than permitted and 4 square feet additional aggregate area on the face display than permitted. The current sign on the site meets the Owasso Sign Code. After installation of the existing sign the owners, employees and customers of the bank discovered that the sign is not visible from three approaching directions, if approved, the sign will be positioned so that the requested height and sire will not interfere with the location of adjacent businesses or buildings. petters were mailed to all property owners within 300 feet and the request was advertised in the Owasso Reporter. No calls were received concerning this request. A representative from Arvest Bank and Acura Neon, inc. was present to address concerns. Ken Foster moved to approve OBOA. ®04 -05, allowing Arvest Bank to increase their pole sign to a height of ') 5' and increase the sign's display area to 224 square feet. OBOA -04-06 -_ A request for a VARIANCE from the Owasso Zoning Code (Tear setback requirements) at 9112 M 133) "' E. Ave. Duane presented the item and described the requested? location. The applicant desires to construct a single family home on an Irregular lot and is requesting a variance to encroach upon the 25" rear setback building line, "fhe lot spacing requirements of 25' rear and front yard setback limes and 5"' and 10' side yard setback lines leaves the applicant with a problem of fitting a house or) this lot.. Letters were mailed to property owners within 300` of the subject property and the request was advertised in the Owasso Reporter. No calls have been received concerning this application. The applicant was present to answer any questions. Staff recommends approval which would allow an encroachment of the rear building setback line. l\,Ar. Travis Flogan was present to answer questions. Joe Ramey moved to approve OBOAN04-06, thereby allowing an encroachment ofthe rear building setback. Ken Foster seconded the rriction. Consideration and appropriate action granting Allison Andr°eoh (OBOA-04 -02) and Larry Duval (OBOA-04 -03) indefinite Special Exceptions to operate temporary vendors in a CS zoned district. Duane explained that at the February Board of Adjustment meeting the Board granted Ms. Andreoli and Mr. Duvall Special Exceptions allowing the operation as temporary vendors. Both operations have functioned in the same site for a number of years, The Board asked staff if there was a way to grant these Special Exceptions so that these two applicants would not have to come back year after year with the same request. Ms. Andreoli and Mr. Duval were present to address concerns. Staff recommends approval for the right to operate as a temporary vendor in the parking lot of Reasor's grocery store so long as each year they have permission from the property owner and conditions of the application remain unchanged. Staff recommends that the Special Exception expire if the property owner no longer allows such condition, if conditions change within the application, if ownership of the primary operation changes hands, and/or the operation ceases operation for more than one year. Discussion was held regarding a ten year time limitation being added to the conditions. Also discussed was the right to review on a case to case basis and revolve if conditions are not met. Ken Foster moved to grant a l0 -year° Special Exception, ending March 239 2014 to OBOA 04-02 and OBOA 04®03. The applicants must provide the Community BOARD OF ADJUSTMENT March 23, 2004 Page 3 of 3 Development staff with written approval of the property owner each year before occupying their respective sites. The Special Exception will become void if the businesses" owner or site plan is changed„ forcing the requirement of a new and separate Special Exception to be granted by the Board of Adjustn' ento Joe Ramey seconded the motion.
