A Grote on the motion was recorded as follows. AYE: Hall, Rainey, Wallace NAY: None The motion carried- 3 -0. 4. O OA -04-02 -- ' A request for a SPECIAL EXCEPTION to allow a temporary vendor (Flower and Gardening 'Tent) to occupy the Reasor9s parking lot located in the northeast corncr of E. 86 "' St. N. and N. 117"' E. Ave. Duane presented the item and the properly location was described. The applicant is requesting a special exception to allow for a non -- permanent vendor in a commercial shopping district. The use is for the sale of landscaping and plant materials. Ms. Allison Andreoli, the applicant, was present to answer any questions. fetters were mailed to property owners within 3009 of the subject property and the request was advertised in the Owasso Reporter. No phone calls or correspondence has been received. Staff recommends approval subject to the following conditions: 1. The special exception use is discontinued no later than July 31ST, 2004. 2. All signage be reviewed by the City Planner to ensure the strict adherence to the Owasso Sign Code. 3. The applicant must provide on -site trash receptacles. The Board Members questioned the July 31ST, 2004 date of discontinuation. Ms. Andreoli assured the Members that July 315` would be suitable for removal of the tent. OBOAp04 -03 - - -- A request for a SPECIAL EXCEPTION T`ION to allow a temporary vendor (Snow Cone Stand) to occupy the Reasor's parking lot located in the northeast corner of E. 86 "' St, N. and N. 117 "' E. Ave. Duane presented the item and described the requested location. The applicant is requesting a special exception to allow for a non - permanent vendor in a commercial shopping district. The use of the property is as a snow cone vendor. Mr. I.,arry Duvall, the applicant, was present to answer any questions. fetters were mailed to property owners within 300' of the subject property and the request was advertised in the Owasso Reporter, Staff has received no phone calls or correspondence regarding this request. Staff recommends approval subject to the following conditions: f The special exception use is discontinued no later than July 3 V5 2004. 2. David Hall moved to approve O13OA-04 -03, Craig Wallace seconded the notion, A vote on the motion was recorded as follows: AYE: Hall, Draper, Ramey, Wallace MAY: None The motion carried 4-0. 6a O OA ®04-04 — A request for a VARIANCE FROM THE BUUILDING SETBACK REGULATIONS on the southern side yard of property located at 11702 N. 115 "' E. Ave. Duane presented the item and described the property location. 'The applicant is requesting a variance to allow an encroachment of Y-3" over the southern side yard setback line. The corner of the house sits approximately 3'w9" from the property line. The Owasso Zoning Code stipulates that the corner should be at lease 5' from the side property line. fetters were mailed to property owners within 300' of the subject property and the request was advertised in the Owasso Reporter. No calls have been received. The applicants, Kevin and Angela Hcavener were present to answer any questions.
