ITEM l: CALL TO ORDER. The meeting was called to order at 7:05 p.m. with Mayor Wood presiding. ITEM 2: FLAG SALUTE. Flag Salute was led by Mayor Wood. ITEM 3: ROLL CALL. PRESENT: Kenneth M. Wood, Mayor Von E. Stockler, Councilrr~n Boyd M. Spencer, Councilrr~an Allen C. Surr~pter, Councilman Dan D. Galloway, City Manager J. Douglas Mann, City Attorney Jane Buchanan, City Clerk ABSENT: Robert M. Peel, Vice-Mayor (Vacation) ITEM 4: CONSIDERATION TO APPROVE AND VOTE UPON THE MINUTES OF AUGUST 5, 1986. A motion was made by V. Stockler, seconded by A. Sumpter, to approve the minutes of August 5, 1986, by reference made apart hereto. AYE: Messrs. Stockler, Sumpter, Spencer, Wood NAY: None MOTION: Carried ~-0 ITEM 5: CONSIDERATION TO APPROVE AND VOTE UPON THE WARRANT'S. A motion was made by V. Stockler, seconded by K. Gd©od, to approve the warrants as submitted. AYE: Messrs. Stockler, Wood, Spencer, Sumpter NAY: None MO'T'ION: Carried 4-0 OWASSO CITY'COUNCIL AUGUST 19, 1986 PAGE TWO ITEM 6: CONSIDERATION TO APPORVE AND VOTE UPON ORDINANCE N0. 355. AN ORDINANCE LEVYING AND ASSESSING AN EXCISE TAX OF THREE PERCENT (3~) OF THE PURCHASE PRICE UPON THE STORAGE, USE OR CONSUMPTION OF TANGIBLE, PERSONAL PROPERTY PURCHASED OUTSIDE THE STATE OF OKLAHOMA AND BROUGHT INTO THE CITY OF OWASSO. A motion was made by A. Sumpter, seconded by V. Stockier, to approve this ordinance as presented with a beginning date of October 1, 1986. AYE: Messrs. Sumpter, Stockier, Spencer, Wood NAY': None MOTION: Carried 4-0 ITEM 7: CONSIDERATION TO APPROVE AND VO`T'E UPON RESOLUTION N0. 86-07. AN AGREEMENT FOR ADMINISTRATION OF THE USE TAX ORDINANCE OF THE CITY OF OWASSO. A motion was made by A. SLUripter, seconded by V. Stockier, to approve this resolution as presented with a beginning date of October 1, 1986 and ending June 30, 1987. AYE: Messrs. Sumpter, Stockier, Spencer, Wood NAY: None MOTION: Carried 4-0 ITEM 8: CONSIDERATION TO APPROVE AND VOTE UPON ORDINANCE N0. 356. AN ORDINANCE A1~END3NG SECThON 15-401 OF THE CITY CODE CON- CERNING SPEED LIMITS IN THE CITY OF OWASSO. D. Galloway reviewed this item with council. He stated this ordinance is changing the speed limit in the city to 25 mph unless otherwise posted. B. Spencer made himself known that because three areas in town are proposed to have two different speed limits on a street, Main Street, 76th Street North and 86th Street North, he is opposed to the ordinance and for that reason will not be able to votes for it. K. Wood questioned Section 3 that refers to setting a maximum speed of 25 mph in a school zone and a minimum speed of 25 mph. He stated he would prefer to address only the maximum speeds in this ordinance and leave the minimum speeds silent. After discussion, a motion was made by A. Sumpter, seconded by V. Stockier, to approve the ordinance as presented with the sentence addressing the minimum school zone speed of 25 mph being omitted. AYE: Messrs. AN ORDINANCE ESTABLISHING WATER AND SEWER FEES AS APPROVED BY THE OWASSO PUBLIC PUBLIC WORKS AUTHORITY EFFECTIVE MAY 1,1986. D. Galloway reviewed this with council. A motion was ir3~.de by 'B. Spencer, Stockler, Sumpter, Wood NAY: None MOTION: Carried 4-0 ITEM 10: CONSIDERATION TO APPROVE AND VOTE UPON AN EMERGENCY CLAUSE ON ORDINANCE N0. 357. A motion was made by B. Spencer, seconded by V. Stockler, to approve the ordinance as presented. AYE: Messrs. Spencer, Stockler, Sumpter, Wood NAY: None MOTION: Carried 4-0 ITEM 12: CONSIDERATION AND VOTE ON AUTHORIZATION FOR CITY MANAGER TO PTIRCHASE CONCRETE SAW FOR THE STREET DEPARTMENT NC7I' TO EXCEED $1,3©0.00 IN ACCORDANCE WITH THE 1986/1987 BUDGET. D. Galloway reviewed this with council. A motion was made by V. Stockler, seconded by A. Sumpter, to approve the purchase as requested. AYE: Messrs. Stockler, Sumpter, Spencer, Wood NAY: None MOTION: Carried 4-0 ITEM 13: CONSIDERATION TO APPROVE AND VOTE UPON ENTERING INTO AN AGREENtENT WITH TULSA COUNTY FOR PROPOSED ROAD V10RK. D. Galloway reviewed this with council. He stated the county will provide the equipment and labor and the city will provide the materials. A motion was made by B. Spencer, seconded by V. Stockler, to approve the agreement as presented. AYE: Messrs. Spencer, Stockler, Sumpter, Wood NAY: None MC7I'ION: Carried 4-0 OWASSO CITY COUNCIL AUGUST 19, 1986 PAGE FOUR ~ ,_~ ITEM 14: CONSIDERATION AND VOTE UPON APPROVAL OF MUTUAL AID AGREEMF,NT BETWEEN CITY OF OWASSO AND COLLINSVILLE RURAL FIRE PROTECTION DISTRICT. D. Galloway reviewed this with council. He stated this is a standard form agreement between fire district. D. Mann stated he would like a minor change within the contract on page two. He would like it to read 19 O.S. 901.1 thru 901.26. A motion was made by V. Stockler, seconded by Sumpter, to approve the agreement with the change requested by Mr. Mann. AYE: Messrs. Stockler, Sumpter, Spencer, Wood NAY: None MOTION: Carried 4-0 ITEM 15: CONSIDERATION TO APPROVE AND V(7I'E ON THE MEMBERSHIP, PURPOSE, TERMS AND THE ESTABLISHMENT OF THE PARK & RECREATION ADVISORY COMMITTEE. D. Galloway reviewed this item with council. After discussion and input from citizens present, a motion was called for by the Mayor twice. The item fell for lack of a motion. ITEM 11: CONSIDERATION TO APPROVE AND VC7PE UPON RESOLUTION N0. 86-08. AN APPLICATION FOR FUNDS FOR FISCAL YEAR 1986/1987 COMMUNITY DEVELOPMENT BLOCK GRANT (.CDBG) PROGRAM. Andy Armstrong with INCOG reviewed this item with council. After discussion, a motion was made by B. Spencer, seconded by A. Sumpter, to approve Resolution No. 86-08 as subr~utted. AYE: Messrs. Spencer, Sumpter, Stockler, Wood NAY: None MOTION: Carried 4-0 ITEM 28: MONTHLY STATUS REPORT FROM LOHREY'& JAY, INC. (Addendum) Mr. Steve Jay gave council a report. ITEM 27: RECOGNITION OF SEVZCE......JAMES SMALLEY AS COUNC3LMAN. (Addendum) Mayor Wood presented Mr. Smalley with a plaque showing the appreciation of the council for his tenue of service. Mr. Smalley thanked the council. 114 OWASSO CITY COUNCIL AUGUST 19,1986 PAGE FIVE ITEM 16: REPORT ON COST OF OPERATION AND THE ISSUES RELATING TO THE OWASSO EMERGENCY MEDICAL SERVICE DISTRICT. Mayor Wood and D. Galloway reviewed the history of this agenda item. D. Mann reviewed his findings with the council on his research of the existing ambulance ordinance creating an ambulance district. It is his recommendation to council that the ordinance be abolished because it is of no use to the city and the city does not need it. He stated the city is properly running an ambulance and needs ordin- ances to set out how this department should be operated and how it should function and who should be in charge. He further stated the city needs to put in writing what is existing at this particular time. He stated funding could be thru subscription or adding a charge on the monthly utility bills. This choice is the decision of the council. Chief Allen presented a report to the council on the operations of the ambulance service and the costs involved and the revenues. Citizens came forward with comments regarding their appreciation of the ambulance service and voicing their desire that the service remains intact. Darlene Myer presented council with a petition stating the citizens request for continued ambulance service. The petition had in excess of 1,000 signatures. The council members individually voiced their desire was also the keep the ambulance service intact and running as it is now. ITEM 17: CONSIDERATION AND VdI'E TO DIRECT THE CITY ATTORNEY TO PREPARE ORDINANCES FOR THE PROPER ESTABLISHMENT OF AMBULANCE SERVICE. A motion was made by A. Sumpter, seconded by K. Wood, on the above agenda item. AYE: Messrs. Sumpter, Wood NAY: Messrs. Stockler, Spencer MOTION: Failed for lack of majority ITEM 18: REPORT FROM CITY MANAGER. None ITEM 24~ CONSIDERATION AND VOTE UPON REQUEST FOR EXECUTIVE SESSION.(Addendum) (a) Discussion of Terms of the 1g86/1g87 FOP Contract and the 1886/18 87 IAFF Contract. A motion was made by A. Sumpter, seconded by K. Wood, to recess into Executive Session. AYE: Messrs. Sumpter, Wood NAY: Messrs. Spencer, Stockler MOTION: Failed for lack of majority ITEM 22: VdI`E TO ADJOURN.
