Hale Acres is zoned RSwl and with that designation there is a 35' building setback. The

5. .0110A-03-24 Jake Britton _ A request for a Variance, TO ALLOW FOR THE
CONSTRUCTION OF TWO DWELLING UNIT'S OVE 'fHE REAR 50' BIJILDING
LINE ITS A. RESIDENTIAL DISTRICT. The subject: properties are located at 11 903
11505 E. 105 St, M
Duane presented the item and described the location of the subject property. Duane
explained that the houses the applicant wishes to build are situated on an "eyebrow"'
shaped, tern in the street. This circular pattern of the street cuts into and diminishes the
length of the subject lots. There is a 50' rear setback line that was established as a
condition of the plat approval process further limiting building space. Letters were
mailed to property owners within 300 feet of the subject property and the request was
advertised in the Owasso Reporter. Several calls were received wanting clarification..
Staff recommends approval of the Variance allowing the builder to construct a dwelling
unit over the 50' rear setback line but still adhere to the zoning code's prescribed 20'
setback line. Mr. Jake Britton, the applicant, was in attendance to address any concerns
the Board Meinbers might Dave.
Ken Foster moved to approve to Variance request, Dan Draper seconded the motion. A-
