PLACEMENT OF A GAR -AGE OVER THE BUILDING LINE IN A RESIDENTIAL
DISTRICT. The subject property contains 0.40 acres located at 10626 B 117 ill. N., in
[-Tale Acres, Owasso, Tulsa County, Oklahoma.
Duane Cuthbertson presented the item and the property location was described. Duane
explained that the applicant was in the process of constructing a house when he realized
that it was 9'-4" over the 35' building setback line. 'The construction was halted and a
-variance request was submitted. There is a natural drainage way that flows along the
eastern property line and flows in a westerly direction around the back of the lot. wane
stated that Mr. Moyle Wilkins, the applicant, has discussed possible solutions with
Owasso Public Works and has agreed to modify the existing channel (memo from Chris
Coss, City of Owasso Project Engineer attached). Letters were mailed to property owners
within three hundred feet and the request was advertised in the Owasso Reporter. A
number of calls have been received all of which were opposing to the construction of the
house. Staff recommends denial because it would not create an unnecessary hardship.
Although staff supports approval if there are some corrections made regarding the
drainage issue. Mr. Wilkins was present to address concerns along with several
surrounding property owners. The following comments were made:
Ralph Hunter – A petition was presented to the Members of the Board opposing the
zoning variance. Concerns regarding the storm water drainage in the area.

Lee Ann Due — f)iscussed drainage problems in the area. Afraid the drainage
modification of the subject property (10626 East 1 t2 Place North) will help that
particular lot but not th.e drainage for the entire neighborhood.
Mr. Wilkins requested a brief presentation to the members. He stated that the mistake
was noticed after a survey was done and the progress of construction was stopped at that
time. :tie also explained that he would grant any easement on the property where Public
Works engineers feel it necessary. If this request is not approved the 9' -.4" porno . would
be cut off and the garage would become a storage area. Ken poster described the
situation as difficult acrd feels life everyone has had a chance to voice their opinion. He
is voting for approval because he fears the value of the property would be much lower if
the garage was removed.,
Ken t�'oster moved to approve the Variance request subject to the granting of necessary
drainage easements and the modifications of the existing channel (per attached rnerno
from Chris Cross). Dan Draper seconded the motion. A vote on the motion was recorded
as follows:

The motion carried 4--0.
5. Other Business -- :wane requested the election of Vice Chairperson.
Joe Ramey moved to elect lien Foster for Vice Chairperson, Dan Draper seconded the
motion. A vote on the motion was recorded as follows:

The motion carried 4 -0.

The natural draainagewaay that crosses area subject property (1 0626 E. 112 th Pi ce ) in Hale acres generally
follows the east and south bOUrrrfary of the lot, fir. Wilkins will need to grant as 2 ft drainage easement along the
east lot line and a 5 ft Baas r Brat along the soratta lot lime to accommodate the storm aster runoff and to
cornponsatefor building the house over the building setback lime. An additional purpose of requiring drainage
easement is to prevent future obstructions to the natural drainageway that crosses the sul)joct properbl.
I rnot with DB and his brother on Friday, September 19, 2003, and they agreed to modify the existing channel as
described below.
J . The channel will be shaped sand aligned along the east lot lira, to allow mowing to be accomplished by the
future hOu`10own r(s).
The slope of the proposed channel will follow the slope of the xisting channel bottom with no major
modifications to channel depth.

Dear Mr. Cuthbertson,
fn response to the wr itten notice 1. received concerning a house being constructed at
10626 E 112 1h Pl North being over the setback line, I inspected the site nnysevl30 Wile
observing the area and taking in consideration the diffe -rent options, t believe tile smart
decision is to greet the variance to the builder. I felt that it was not immediately
otl o bi g € the area saw that It did not distract from or
negatively effect the surrounding aesthetics. New construction in a 20 year old
neighborhood not only enhances the existing area but helps increase property values
throughout the Hate Acres developme nt Other options could cause negative results fbr
the neighborhood.
