AYE: Wallace, poster, Hall NAY: None 'The motion was approved 3 --0. 4� OA-03 -015 -m- Saab 1J1F_0wasso Market 11, L C - A request for a Variance from the Owasso Zoning Code, Chapter 6, Section. 630, bulk and Area Requirements in Commercial Districts, TO ALLOW W FOR A MINIMUM LOT FRONTAGE ON AN ARTERIAL, STREET SMAL,L,ER THAN THE 1509 REQUIREMENT on property zoned CS (Commercial Shopping District), The subject property is described as a part of Lot 2, 3 and 4, Block 1, Owasso Market II, an addition to the City of Owasso, Tulsa County, Oklahoma, further described as 3/8 rnile east of Garnett on the north side of E. 96"' St. N. Duane presented the item and described the property location and surrounding land use. 'The applicant is requesting a variance to allow for the creation of a lot with frontage of 40 feet. It is used as an access easement and contains the shopping center sign. A lot split was approved on June 9, 2003, contingent upon approval of the Board of Adjustment. Letters were mailed to surrounding property owners within 300 feet of the subject property and notification was published in the Owasso Reporter, No calls have been received concerning this application, Staff recommends approval, allowing the creation of a lot containing 40 feet frontage within a zone requiring 150' frontage. Mr. Jerry Emanuel was present representing the applicant. David Fall moved to approve the above Variance request, Craig Wallace seconded the motion. Duane described the property location and surrounding zoning. The applicant is requesting a variance to allow for the construction of a house that will encroach 135-6" into the 25' rear yard setback line. 'The subject lot configuration is not conducive to the typical developirlent found in Brentwood Village. The builder made reductions in the size of the house but will still need variance approval to fit the proposed house on the lot. Letters were mailed to surrounding property owners and notification published in the Owasso reporter. One call was received concerning this request but was mainly concerned. about the size of the home to be built. Staff recommends approval. Duane introduced the item and described the property location. The builder was made aware of the setback violation with a survey completed after the building pad was laid. The 1 foot discrepancy will cause no substantial detriment to the public. Letters were mailed to surrounding property owners and notification published in the Owasso Reporter. Staff recommends approval. Mr. Ron Staggs, the applicant, was present to answer questions. Craig Wallace reminded the staff that there was discussion held several months ago regarding the staff s ability to vote on a variance when the BOARD OF ADJUSTMENT June 24, 2003 Page 3 of 5 encroachment is minor. OBOA -03, -1 — Forest _Cree k III — A request for a Special Exception to the Owasso Zoning Code Chapter 2, Section 240.2.c, Permitted Yard Obstructions, TO ALLOW FOR A 6' FENCE T.`0 BE ERE, CTED WITHIN THE FROM T Y ARD PARAMETER on property zoned l U-D 20 or CG (Commercial General District). The subject property is described as T.,ot 13, Forest Creek Business lark, an addition to the City of Owasso, JUsa County, Oklahorria, farther described as 7794 %1. Owasso Expressway, Owasso, Oklahorna. Duane presented the staff report. The applicant is requesting approval to allow f or the construction of a 6' fence along the northern front yard perimeter. The purpose of this fence is to provide screening between the Print Shop and the Transmission Shop to the north. Letters were mailed to surrounding property owners within 300 feet of the property and the request was published in the Owasso Reporter. Duane also explained that the fence will still be required to maintain the 25' sight triangle. Staff recommends approval. Craig Wallace moved to approve the Special Exception request, David Hall seconded the motion. YE: Foster, Wallace, Hall NAY: None The motion was approved 3 -0. BOARD OF ADJUS'Y' ENT Juno 24, 2003 Page 4 of 5 Duane presented the item and described the subject property. In October of 2002, a different applicant submitted a similar request. The application was denied due to the applicant's unwillingness to provide screening adjacent to residential uses. The developer intends to provide extensive landscaping along the perimeter and will con.stroct a decorative masonry veneer along the exterior rior wall adjacent to residential uses, Lighting g will be positioned so that no light will shine directly on neighboring residences, letters were nailed to surrounding; property owners and the request was advertised in the Owasso Reporter. No inquires were received concernsi. -ig this request, Mr. Dan Draper, the applicant, was present to address concerns, Drainage and landscaping was discussed along with the type of screening. Mr. Draper stated- that brick pillars and gating will surround the establishment, He also explained that a proper drainage plan would be submitted to the Owasso public Works Department for review. The following are comments made by several surrounding property owners present: Bruce Barnard -- 9606 F 114 St No - -- expressed traffic and drainage concerns. Concerns were expressed regarding the possibility of'the units causing; a decline in property values.
