CALL TO ORDER

Consider .Approval of the minutes of the January 28, 2003 Regular Meeting. Ken
Foster moved to approve the minutes of January 28, 2003. Vicki 'Tapp seconded.

District). The proposed use of the property is as a gardening and plant supply store. 'The
subject property is described as Lot 1, Block 1, Clark Plaza Fourth, an addition to the
City of Owasso, 'Tulsa County, Oklahoma, further described as 11815 E. 86 " St M,
Owasso, Oklahoma.
Robert presented the item and described the property location and surrounding land use.
The records indicate that this vendor has been allowed to operate at this location with
prior Board of Adjustment approval. Letters were mailed to all property owners within
three-hundred feet and the request was advertised in the Owasso Reporter. No calls have
been received. Robert explained that all structures in commercial districts must meet the
minimum building setback line. 'The CS (Commercial Shopping District) zoning has a
minimum fifty -foot building setback line. Staff recommends that the provisions of
Section 620.2 be enforced on this and all future non - permanent vendor requests. Staff
recommends approval of OBOAw03 -02, subject to the following conditions:
1. The special exception use is discontinued no later than July 31", 2003 and
the facility be dismantled and removed.
2. All signage be reviewed by the City Planner to ensure the strict adherence
to the Owasso Sign Code.

Discussion was held regarding the 50' building setback requirement. There
was corrcern that the 50' building setback line would bring the tent too far into the
parking lot of Reasor's. Robert suggested the plat be reviewed in order to determine the
property line location. He also stated that a variance, world be needed if this requirement
was not met, but the fee would be waived, Ms. Allison Andreoli, the applicant was
present and stated that she would have to address the new tent location issue; with
Reasor's and also make sure an electric, pale could be placed at 'that location,
Vicki Tapp moved to approve the Special Exception request subject to the above staff
recommendations, David Hall seconded the motion.

District). The proposed use of the property is as a snow cone vendor. The subject
property is described as Lot 1, Bloch 1, Clark Plaza Fourth, an addition to the City of
Owasso, Tulsa County, Oklahoma, further described as 11815 E 86”' St N., Owasso,
Oklahoma.
Robert described the property location and surrounding zoning. He stated that records
show that this vendor has been allowed at this location with prior Board of Adjustment.
Letters were mailed to all property owners within three hundred feet of the subject
property and the request was advertised in the Owasso Reporter. The Owasso Zoning
Code, Section 620.2, states that all accessory structures in commercial districts must meet
the minimum building setback line. The CS (Commercial Shopping District) zoning has
a minimum fifty -foot building setback. Staff recommends that the provisions of Section
620.2 be enforced on this and all future nonmperrnanent vendor- requests. The applicant
Ids. Nancy Wood, was present to address questions. Staff recommends approval of
OBOA- 0303, subject to the following conditions:
1. The special exception use is discontinued no later than October 15th, 2003
and the facility be dismantled and removed.

A request for a Variance of the Owasso Zoning Code, Appendix F, Owasso Sign
Ordinance, Section 1021, Business Signs and Outdoor Advertising, TO ALLOW FOR
THE CONSTRUCTION OF A SIGN WITH A SQUARE FOOTAGE IN EXCESS SS OF
THE MAXIMUM 150 SQUARE FEE T' Af f OWED on property zoned CS (Commercial
Shopping District). The subject property Is described as Lot 1, Bloch 1, 'Tulsa Teachers
Credit Union, are addition to the City of Owasso, 'Tulsa County, Oklahoma, farther
described. as 11725 E. 96t" St. N., Owasso, Oklahoma.
Robert introduced the item and described the property location along with the
surrounding zoning. The applicant is requesting a variance to allow for the construction
of a sign with a square footage of 58.5 feet in excess of the maximum 150 square feet
allowed in the C S (Commercial Shopping District), Robert explained to the Board
Members that former staff gave the applicant certain verbal assurances that the marquee
would be allowed. The marquee will be used to advertise special events and promotions.
If this request is approved the business would no longer have a need for any additional
temporary signs. Mr. James Adair, the applicant, was present to address any concerns.
Letters were mailed to all property owners within 300 feet of the subject property and
were advertised in the Owasso Reporter. Staff recommends approval of OBOA-03-04,
allowing for the construction of a sign in excess of the 150 foot maximum allowed in the
CS (Commercial Shopping District) subject to the follow conditions:
1. That any and all temporary signage on the subject property is prohibited.
1. That all temporary signage is removed from the property prior to releasing
the sign permit for construction.
Vicki Tapp moved to approve the Variance request allowing for the construction of a sign
in excess of the 150' maximum allowed in the CS zoning district, subject to the above
conditions. David Hall seconded the motion.

Robert presented the item. setters were mailed to property owners within 300' of the
subject property and the request was advertised in the Owasso Reporter. Staff
recommends approval, allowing for the creation of a lot with a width of 5.74 less than
rewired 65 foot lot width. Apparently, the cause of the mistake was due to the removal
of property pins located. along E. 89`' dace N. The foundation was pulled from the south
by the property pins which are Located approximately 6 feet to the west of Lot 5. The
applicant received approval for a lot split from the Planning; Commission. Letters were
mailed to all property owners within 300' ofthe subject property and was advertised in
the Owasso Reporter. The applicant was not present. Staff recommends approval of
OBOA- 03 -05, allowing for the creation of a lot with a width of 5.74 feet less that
rewired 65 foot lot width.

Pp1jey Discussion — Discussion of the Board of Adjustment's policy relative to Non-
permanent Vendor Requests.
Discussion was held regarding the possibility of initiating some review guidelines for
non - permanent vendors. Robert stated that several calls have been received regarding the
sale of such items as handbags and accessory clothing. There is a need to protect local,
established businesses within the City. Staff recommends that the Board Members
consider the impact that a vendor may have on businesses in the city limits of Owasso.
