approve the July 23, 2002 meeting, Ken Foster seconded the motion. A vote on the
motion was recorded as follows:

40 OBOA -02 -22 _Michael Scha -fer — A request for a Variance of the Owasso Zoning
Code, Appendix F Section I.D. (3 )), Owasso Sign Ordinance 'TO ALLOW A GROUND
SIGN /SURFACE MOUNTED TO EXIST WITH A 'TOTAL HEIGHT GREATER
THAN 4 FEET on property zoned CCs (Commercial General). The subject property is
described as Lot 4, Block 2, Elm Creek Center, further described as 12620 E. 86 ' Street,
Owasso, OIL.
Robert Moore presented the item and the property location. was described. Staff believes
that all criteria necessary for the approval of a variance have been met. Given the number
of approved signs in the area and the obstruction of the sign by parked cars, staff believes
the hardship criteria have been met. Also, the conditions could be reasonably considered
exceptional and peculiar to this particular piece of property in that several businesses in
the area have received permits for similar and with a greater height and width than the
sign the applicant is proposing. Staff also feels is would not cause substantial detriment
to the public good, or impair the purposes and intent of the ordinance. Staff recommends
approval of OBOA -- 0222, allowing a ground sign/surface mounted to exist with a total
height greater than four (4) feet. Discussion regarding the total height of the sign was
held. The applicant was present to address any conceals.
Ken Foster moved to approve the sign variance request, subject to the sign not to exceed
14 feet above ground level, Craig Wallace seconded the motion.

LINE on property zoned. CS (Commercial Shopping District). The subject property is
described as Lot 1, Block 1, Owasso Commercial Center, further described as 7 703 N
Owasso Expressway, Oklahoma, OK.
Robert presented the here and described the location of the subject property. The
structure was legally permitted in 1987 and for all .intents and purposes covered by
"grandfathering" provisions, the applicant is requesting approval of this variance in order
to obtain a clear title, eventually remodel and market the property. Robert explained that
if the applicant were to remodel the building he would be required to "shave 23 feet of
the front corner of the building. Staff also feels the structure was permitted legally by the
City of Owasso Planning Commission. If approved. the result would not cause substantial
detriment to the public; good. Notices were sent to surrounding property owners within
300' and legal advertisement was published in the Owasso Report. The applicant was
present to answer questions. Staff recommends approval of OBOA- 02 -23, allowing a
structure to exist within 23 feet of the required 50 foot setback.
David Hall moved to approve the above variance request which allows this structure to
exist -within 2.3 feet of the required 50 foot setback, Vicki Tapp seconded the motion.

Zoning Code, Section 420, Accessory Uses Permitted in Residential Districts TO
ALLOW FOR A HOME OCCUPATION IN A RESIDENTIAL DISTRICT on property
zoned. RS -3 (Single Family High Density District). The subject property is

requesting a special exception to allow for the continuation of the Owasso Copier
Service, a home occupation. "The applicant is aware of all restrictions set forth in Section
420 of the Owasso Zoning Code. The applicant is also aware of the time limitations that
the code provides, that would be a one year limit for special exceptions. Letters were
availed to property owners with 300 feet of the subject property and the request was

advertised in the Owasso Reporter. Several calls were received in favor of this request.
'The applicant was present to answer any questions from the board Members. Mr, John
Oroth, a concerned Owasso resident, wanted to be assured that there would be no
disturbances to the neighborhood such as increasing traffic or business signs. Mr,
t awvey stated that he flans on beeping a eery low profile and traffic would riot increase.
Staff recornmends approval of OBOA- 0:2 -24, allowing for a hon-ie occupation to
continue in a residential district.
Vicki Tapp moved to approve the variance request, Ken Foster seconded. the motion,

Prior to adjournment, a brief°discussion was held regarding a possible solution to the
problem of`builders encroaching into the setbacks. Also discussed were the zoning
options of a restaurant locating in an S- -3 district,
