Cedar on the 29th day of January 2001 at. 6:00 PM. 1 v CALL TO ORDER — Chairperson Joe Ramey called the meeting to order at 6:00 PM and declared a quoru n present. 2. ROLL CALF, 3. Ken foster seconded, AYE,: Tapp, Foster, lgarta, Ramey NAY: None ,fhe motion carried. 4 -0 BOARD OF ADJUSTMENT NEARING 40 0 OA -00 -21 _!radley j- Beasley A request for a Variance to the Owasso Zoning Code Chapter 6, Section 630, "Bulk and Area Requirements in Commercial Districts" to allow for a reduction of a 50' building setback along the north property line. The subject is described as Lot 4, Block 2, Elm Creek Commercial Comer Amended and is located at 12620 E 86 "' Street North. (Ward 3) Donna presented the case and described the surrounding land use. This request is to accommodate a one-foot encroachment across the front of an existing office building. Legal notification was published and letters were mailed to surrounding property owners. No calls were received regarding this request. Donna stated that this request is merely to clear the title. The applicant was present to answer any questions. Staff recommends approval of OBOA ®00 -21 to allow for a 5' reduction of the required 50' front yard building setback. Ken Foster moved to approve the variance request of OBOA -00 -21 to allow for a 5' reduction of a 50' building setback along the north property line. Jim lgarta seconded. A vote on the motion was recorded as follows: AYE: Tapp, Ramey, poster, lgarta NAY: None The motion carried 4 -0 January 31, 2001 Page 2 of 3 O OA -01 -01 — Erik Miller A request for review of a Variance to the Owasso Zoning Code Chapter 2, Section 240.2e "Permitted Yard Obstructions" to allow for the 'location of an accessory building in the side yard. The subject property is described as Lot 3, Block 33, Elm Creek Estates First Addition and is located at 7713 N. 126 "' E. Avenue. (Ward. 3) Donna described the case to the Board Members. Donna presented copies of a letter, from Mr. John Westin, a nearby property owner, that was in favor of the variance (attached). She explained that while the storage shed was being constructed. the Code Enforcement Officer informed Mr. Miller that accessory building must be located in the rear yard of the property. The applicant completed the structure and is now requesting a variance to allow the shed to remain in the side yard. Legal notification was published and letters were mailed to surrounding property owners. Donna also explained that the Enforcement Officer had a compliant from a neighbor on the storage shed in November 2000 and a letter was sent to Mr. Miller at that time stating that the accessory building needed to be moved to the rear yard. In addition to the shed being in the side yard, it is within the 5' side yard setback. Mr. Miller was present and requested a brief presentation to the Members. He stated that the shed is less conspicuous in the side yard and that it would be difficult to fit in the rear yard. Mr. Miller had spoke with his neighbor prior to construction and they had no objections. Utility locations were discussed briefly. The Owasso Zoning Code states a variance may be granted upon a finding that: L The application of the ordinance to the particular piece of property would create an unnecessary hardship, 1 Such conditions are peculiar to the particular piece of property involved and 3. Relief, if granted, would not cause substantial detriment to the public good, or impair the purposes and intent of the ordinance or the Comprehensive Plan, Staff recommends denial on the grounds of the applicant not meeting the prescribed requirements listed above. Vicki Tapp moved to deny the variance that would allow the placement of the storage building outside the required rear yard but granted the applicant a variance on the 5' side yard setback in the rear yard, The motion also includes the storage building to be moved to the rear yard within 60 days of this meeting. Jim Igarta seconded the motion. A vote on the motion was recorded as follows: AYE: Tapp, Ramey, Foster, Igarta NAY: None The motion carried 4w0. 6. OA -01 -02 — James & Wanda Baker A request for review of a Variance to the Owasso honing Code Chapter 4, Section 430 "Bulk and Area Requirements in Residential Districts" to allow for a reduction of a 5' building setback along the east property line. The subject property is described as Lot 3, Block 3, Bailey Ranch 1 and is !. January 31, 2001 Page 3 of 3 located at 11303 E 100t1i Street moo, (Ward 1) Donna described the property. I'his request is for a 1' reduction of a 5' side yard to accommodate an encroachment, Donna stated that the property was recently purchased and the new owner is aware of this request. The applicant was present to answer questions. Legal notification was published and letters were sent to surrounding property owners. No inquires resulted from the notifications. Staff recoznmends approval to allow for a 1' reduction of the required 3' side yard setback to accommodate an encroachment on the east side, Staff recommends approval of OBOA -01-02 to allow for a 1' reduction of the required 5' side yard setback, Ken Foster moved to approve the 1' reduction of the 5' side yard setback to accommodate the existing east side encroachment, Jim lgarta seconded the motion.
