L C "ALIL ` O ORDER Joe Etarn y called the meeting to order at 6:00 PM and declared a quorum present. 2. ROLL CALL 3. Consider Approval of the Minutes of October 24, 2000 Regular beating. Ken Foster moved to approve the minutes of October 24, 2000. Vicki Tapp seconded. AYH: '_Tapp, Rarney, foster, Kimball NAY: None The motion carried 4 -0 An addendum to the agenda was _filed on November 21., 2000. The items numbers 1 through 3 shall remain the sane. Item number 4 shall be deleted. Items number 5 through q will now be numbered 4 through 8. BOARD OF ADJUSTMENT HEAIUNG 4. O OA -00 -16 -- Kane Development — A request for a Variance of the Owasso Zoning Code Chapter 4, Section 430, "Bulk and Area Requirements in a Residential District" to allow for a reduction in one of two 25' front yard setbacks on corner Lot 5, Block 1, Central park. Gard 3) Donna presented the case and described the location. She explained that the property is at the corner of a through street and cul- de-sac and is irregular in shape. The setback reduction request is for the north side yard setback. Legal notification was published and letters were mailed to surrounding property owners. Staff received one call with no objection. Staff recommends approval to allow for the reduction of the north 25' building setback to 15'. Donna also explained that this lot is very shallow and very challenged. Mr. Bill Richert, the applicant, was present to answer questions. Vicki Tapp moved to approve the variance request, Ken foster seconded. AYE: Tapp, Ramey, Kimball, Foster NAY: None The motion carried 4 -0 BOA- 00 -17.` �,q Yqt i g A request for a Variance of the Owasso Zoning Code Chapter 10, Section 1021, "Business Sims and Outdoor Advertising99 to allow for 1) an increase in the allowable square footage of signage; and 2) a second wall sign on a wall not directly fronting a public right-of-way, (Ward 44) Donna Sorrclls described the case to the Board Members. The existing sign on the north_ facing wall of the building is approximately 108 square feet with the wall this sign is attached is 403 square feet. A sign of only 40 square feet in size would be allowed on this wall. The facility is located along a dead -end street, therefore, advertisement is accomplished by the north -- facing signage seen from E 76 "' Street No, i..,cgal notification was published and letters were mailed to surrounding property owners. There were no calls received by the Community Development Departrxzent. Staff feels denial of the application is appropriate, but would suggest the signage located on the east-facing wall could be relocated to the north - facing wall and comply with the size limitations of the zoning code. Mr. Young was present and requested to make a brief presentation to the Members. He stated that he Hired Garrett Signs to fabricate the sign and was unaware that there was a City of Owasso Sign Ordinance. He also presented pictures and explained that he did the installation of the signs, which took approximately two weeks. Mr. Young explained that the Code Enforcement Officer drove by the subject property numerous times during installation and never stopped to ask him if he had a permit until the signs were installed. Donna assured the Board Members that Garrett Signs would be contacted with a letter regarding this situation along with a copy of the sign ordinance. lien Foster had questions regarding the size of a pole sign that would be excepted at this location. Donna responded that the sign ordinance would allow a 100 square feet high and 309 tall.. Mr. Young stated that the sign is approximately 20' high on the building. Ken Foster stated that the Board has tried to keep a close watch on signs in the Owasso area but, it seems that a lot of things should have been done up front in this case. Ms. Deloris Hayes of 4.08 South Birch, was present to state that she had been a neighbor of Mr. Young since 1959 and can not see the sign from her house, Ms. Hayes feels that Mr. Young has contributed to the improvement of the area. After discussion, Ken Foster moved to approve the Variance request, Joe Ramey seconded the motion. A vote on the motion was recorded as follows: AYE: Ramey, Tapp, Kimball, Foster NAY: None The motion was denied 4 -0. BOARD OF ADJTJSTMENT November 28, 2000 Page 3 of 4 C. OA-00- - Chumle & Assodates -- A request for a Special Exception of the Owasso Zoning Code Chapter 4, Section 410, "Principal Uses Permitted in a Residential District" to allow for a construction job trailer in a RS -3 /P D zoning district. (Ward 3) Donna presented, the item and described the location. She explained that the lot is '7150 square feet and the located is at 0010 No 149`1 E Avenue. The trailer has been oil the lot since February, 2000. The applicant was unaware that he needed to go before the Board, of Adjustment for a Special Exception. The honing Code bruited the length of time to two years at the same location, staff would recorr mend. the Special Exception be granted through February, 2002. legal notifications were sent and it was published in the Owasso Reporter. No calls were received regarding this request. Staff recommends approval subject to the termination date of February 28, 2002. Susan Kimball moved to approve the requested special exception, lien poster seconded the motion. A vote on the Motion was recorded as follows: AYE: Tapp, Ramey, Kimball, poster NAY: None The motion was approved 4 - -0. 7. OA-00ss 1 Atlas C ,,oniput e°s A request for a Variance of the Owasso Zoning Code Chapter 10, Section 1021, "Business Signs and Outdoor Advertising" to allow for 1) an increase in the allowable square footage of signage, and 2) a second ground - mounted sign Donna described the location of the property. She stated that the subject property is zoned CO (Commercial general) and contains 1.73 acres and is located at 8$11 Owasso Expressway. The applicant's motivation for locating the sign at the southeast corner of the property is to maximize the benefit of the uphill topography and get visibility from E. 86 "' Street N. legal notification was published in the Owasso Deport and letters were sent to surrounding property owners. One call was received requesting more details and then stated no objection. Staff recommends approval of O3OAM00-19. The applicant was present to answer any questions or concerns regarding the variance request. Vicki Tapp moved to approve the variance, lien Foster seconded. A vote on the motion was recorded as follows: AYE: Tapp, Ramey, Kimball, Foster NAY: None The motion was approved 4 -0.
