10 CALL TO ORDER Joe Rarney called the meeting to order at 7:00 PM and declared a
quorum present.

BOARD OF ADJUSTMENT PUBLIC HEARING
da O A-99 -32 -- Owasso Market - A request for a variance of the Owasso Zoning Code,
Appendix F, Owasso Sign Ordinance, to allow a signage in excess of maximum area
requirements. The property is located on the north side of E 96 "' Street N, west of the
Owasso Expressway. The subject property is described as hots 1 & 2, dock 1, Owasso
Market Addition and is zoned CS (Commercial Shopping Center).
Theron presented the case and the property was described. Theron explained that because
the developer has frontage on two streets, two signs are permitted. Both signs are to be
35' high. The 96 "' Street sign is proposed to be 352 square feet and the sign facing the
Owasso Expressway is proposed at 160 square feet. Notices were sent to surrounding
property owners and published in the Owasso Reporter. No calls were received opposing
this request. Theron also discussed the five out - parcels which are generally located on
96 "' Street. The developer is willing to compromise on the size of the out - parcel signs in
order to redistribute the gross square footage that would normally be allowed on the site.
Theron also stated that there is a slight error on the square footage calculation in the staff
report. The out parcel signs should be limited to 25 feet in height and 80 square feet in
area. Mr. Christopher Seay, developer and applicant, was present to answer any
questions or concerns. Mr. Seay made a brief presentation to the Commissioners stating
that he agrees to encourage out - parcels to use ground type monument signs, whenever
possible. An area property owner was present to voice concerns regarding the possible
depreciation of his property due to the large signs in the area. He also had concerns
regarding the times in which the parking lot lights will be on and wit!) the drainage of the

property. Theron offered to discuss the drainage for this project with Mr. Phil Lutz of
Owasso Public Works Authority. V ioki Tapp stated that she did not want the out parcel
tenants to corne back before the Board of Adjustment to apply for a variance request tier
larger signs. She feels if monument signs for the out parcels are agreed upon, the
developer needs to make sure this is done. Susan Kimball expressed concerns regarding
the possibility of the developer coming before the Board at a later elate, stating there is a
hardship on the out parcel tenants, due to the fact that they can only have 25' hash and 30
square feet signs or 125 square, feet for a monument sign.
Staff recommends approval subject to the following conditions
1. That the Owasso Expressway not exceed 35 feet in height and 160 square feet in
area,
2. That the 96 "' Street sign not exceed 35 feet in height and 352 square feet in area,
3. That the out parcels signs be limited to 25 feet in height and 40 square feet in area,
4.. 'Thank ground -type, monument signs be encouraged by the developer on out-
parcels.
Vicki Tapp moved to approve the variance request subject to the above staff
recommendations, with the exception of item I -0 being changed. to 80 square feet in area
and the monument signs to be no larger than 125 square feet, Susan Kimball seconded the
motion.
The vote on the motion was as follows:
AYE: Raney, Foster, Tapp, Kimball

The motion was approved 4 - -0.
5. ® OA-99 -33 - Hodges - A request for a Special Exception of the Owasso Zoning
Chapter, Section 24.0, to allow a carport in the required front yard of property located
at 609 N Ash. The subject property is described as Lot 3, Block 3, Raywood Addition
and is zoned S -3 (Residential Single - Family High - Density).
Theron presented the item. He stated that carport requests come before the Board
frequently. This structure would encroach into the front yard, but not into the required
easements. Legal advertisement was published and letters were mailed to surrounding
property owners. Staff has received no calls concerning the request. Mr. and Mrs.
Hodges, the applicants, were present to answer any concerns. Mrs. Hodges presented a
picture of the proposed carport to the Members.
Vicki Tapp moved to approve the special exception, Ken Foster seconded the motion.
