The meeting agenda was posted in the Owasso City hall, 207 S. Cedar on December
18, 1998 at 9 :00AM.
1. CALL TO ORDER- Chairperson Joe Ramey called the meeting to order at 7:00 PM
and declared a quorum present.

BOARD -OFADJUSTMEN'r PUBLIC HEARING
OA -98-24 A request from Shelly Lutu, applicant, for a Special Exception of the
Owasso :honing Code - Chapter 4, Section 420.21 , accessory Use Conditions -
Home Occupations, to allow for a child daycare facility on property currently zoned
RS -3 (Residential Single- Family High Density) Zoning District. The subject property
is described as Lot 3, Block 4, Elm Creek Estates First addition and is located at
8019 N 118th E avenue, Owasso, Oklahoma.
Theron Warlick presented the item to the Board. Mr. Warlick briefed the Members
on the provision for home occupations listed in the Owasso Zoning Code. also
described were the State of Oklahoma Department of Human Services requirements
for a prospective licensee. Legal advertisement was published in the Owasso
Reporter and letters were mailed to surrounding property owners within 300' of the
request. Staff received no calls concerning this item. The applicant, Shelly Lutu,
was present to answer any questions or concerns the Members had. lbs. Lutu stated
she was planning on no more than four (4) infants at one time to care for.
Staff recommends approval with the following conditions:
1. The facility shall be used to care for no more than seven (7) children at one
time,

2. The applicant shall contact the Community Development Department for a
Certificate of Occupancy prior to commencement of operation,
Vicki Tapp moved to approve the Special Exception request subject to the above; staff
recorrrrTreDdations. The motion was seconded by John Phillips.

5. OA -98-25 - A request from Schlotzsky's Deli, applicant, for a variance of the
Owasso Zoning Code - Appendix F (Owasso Sign Ordinance), Section 1021.5, CS
and 11 Use Conditions to allow for an additional wall sign not abutting a public right- -
of -way on property currently zoned CS (Shopping Center) Zoning District. The
subject property is described as a tract of land in the South Half of the :South Half of
the Southeast Quarter (S /2 S/2 SE /4) of Section 20, Township 21 North, Range 1�
East, and is located at 12551 E 86th Street North, Owasso, Oklahoma,
'Theron Warlick presented. the item to the Board. Mr. Warlick explained that the
applicant is request a. variance to allow for a second Mall sign to be placed on a
surface that does not race a public right - -of- -way. This proposed sign totals 32 square;
feet on the east: elevation above the main entrance to the business, Discussion was
field regarding the Owasso Sign Ordinance. Notices were seat to surrounding
property owners and legal advertisement was published in the Owasso Reporter.
'Where were no calls concerning this proposal. Mr. `Ferry Howard with Oklahoma
Neon, Inc. was present to answer any questions regarding this request.
Ken Foster moved to approve the Variance request. The motion was seconded by
Vicki Tarp.

Theron Warlick presented the item to the Board. He explained that the streets for
Country Estates 111 have been roughed in, but no paving or curb and guttering has

been installed. The site is located in Country Estates 111 and adjacent to the proposed -
County Estates 1V which lies to the north. Notice was seat to surround property
owners and the legal advertisement was published in the Owasso Reporter, Staff
received no calls concerning this request. .Staff' recommends approval of the Special
Exception request subject to the following conditions:
L That the use be continued f'or a period not to exceed two years, and that if the
developer foresees a steed to extend this use beyond two years, he must
reapply t tlre- Board- of �rlj€�stment.
2. That riff- street parking ors a bard, dustfree, surface shall be provided.
Joe Ramey moved to approve the Special Exception request subject to the above staff
reconi- mendations. The motion was seconded by Ken Foster.
