BOARD OFADJUS,rMENT PUBLIC HEARING OBOA-98-17 - A request by Precision Components Co., applicant, for a Variance of the Owasso Zoning Code, Section 730, to allow for the development of an industrially zoned property with less than the required 75 foot setback from an abutting residential property. The subject property is currently zoned IL (industrial Light) Zoning District and is located at 209 E 5th Ave. 1. The 24.'8" area along the northern boundary of the Precision Components property will be required to be a grassy landscaped area with a minimum of 20 trees planted in this area. 'Tree trunks shall be a minimum of 1.5 - 2" in diameter at time of planting, and shall be planted prior to the occupancy of the structure. Where shall be no other use of this area for storage, parking, access, refuse, etc.; however this area may be used for recreational activities of Precision OWASSO BOARD OF ADJUSTMENT August 25, 1998 Page No. 2 Co mponents. 1 A solid, site obstructing, wood fence will be installed along the northern boundary of the Precision Components property. The tractor trailer truck currently utilized for storage will be re,r- nove°d ft•oni the subject property prior to the occupancy ref. the structure, 6, Construction activity shall be limited to the hours of 7:00 AM to 5:00 PM, 1. Such conditions of approval shall be applicably; to the subject property, regardless of ownership, as long as the abutting property is utilized in a residential manner, Staff is satisfied that these above conditions will protect Mrs. Thompson's property yet allow for expansion of Precision Components. Mr. Jay Nicolaides, a surrounding property owner, had concerns with Mrs. Thompson's welfare. Vicki Tapp requested a recess in order to call Mrs. T hograpson to be scare, that she understood the conditions and was agreeable. Ken Poster moved to approve the variance request, subject to the above staff recommendations. ENT August 25, 1998 Pape No. 3 Mr. Warlick addressed the Members. The owner has requested a patio after the original building permit had been issued for the construction of the dwelling. The encroachment into the rear yard is only 2' 1" and the patio would remain 6' from the rear yard utility easement:. Surrounding; property owners were notified. within 300'. One call was received, wanting clarification on the owner's plans and did not express opposition. Carpenter, applicant, for a .Special Exception of the Owasso Zoning Code - Chapter 4, Section 420.2, Accessory Use Conditions In Residential Districts, to allow for a carport on property currently zoned RS -3 (residential Single Family Ifi h Density) zoning district. he subject; property is located at 410 N Dogwood Street„ further described as Lot 15, block 4, Marywood Addition. Mr. looney briefed the Board Members on this item. This is the fifth carport request in the last two years from this area. The structure would extend into the required from yard by 20 feet and the required side yard by 3 feet. No easements or right -of- -ways would be effected. Letters were mailed to surrounding property owners within 300' of the request. No calls were received opposing the special exception. John Phillips moved to approve the special exception request. OBOA -9 - 0 - A request from the United Mates Postal Service, the property owner, for a Variance of the Owasso Zoning Code - Chapter 6, Section 630, to allow for an encroachment of 14 feet into the front yard setback on property currently zoned CCU ((general Commercial) Zoning District. The subject property is located at 1233 No Cedar Street, further described as follows Lot 1, dock 1, Owasso Post Office Addition. Mr. Warlick presented the case. The applicant is requesting a variance to allow for a building; expansion that will encroach up to 14 feet into the required 25 foot building setback. He explained a 14 foot encroachment is substantial and tapers back to the building, line very quickly. This is adequate room for markers or other safety features should they be heeded in the future. Two calf were received regarding the notice although,, they were riot concerned about the setback encroachment, These property owners had comments about the sharp curve on Cedar Street: and would like traffic safety researched. Staff recommends approval of the Variance with the following condition: L That the applicant provides any and all safety features;, now or in the future, that rrray be prescribed by the "Owasso City Engineer or Owasso Department of Public Works as necessary to maintain safe travel on Cedar Street. Discussion was held regarding the four parking spaces at the northwest corner. Ms. Lyn Ritter of 1 502 forth Cedar had concerns with the north property line. Mr. Robert Schaefer, the applicant in this case, agreed to investigate lbs. Ritter's concerns, Ken Foster moved to approve the variance request subject to the above staff conditions and an 8 foot site obstructing fence be constructed., from the height of the post office parking lot. Colleen Joplin, applicants, for a Variance of the Owasso Zoning ;ode -- Chapter 4, Section 430, Bulk and Area Requirements in residential Districts, to allow for a deviation in the side yard setbacks on a property currently zoned RS-3 (residential Single-Family High Density) Zoning District. The applicants request a variance to allow for encroachments into the side yards of 1' on the south side and 3°" on the north side on an existing; structure. The property is located at 12407 E 90 St loo, further described as Lot 8, Block 3, Lakerldge Addition. Mr. Warlick presented the item. This request is to allow for encroachments into the required side yard by l foot on the south side and 5 inches on the north side of the property to correct an existing condition. This problem was recently discovered. Surrounding property owners within 300' were notified. Staff received several calls requesting clarification, but no opposing calls. The building does not encroach upon any casements and does not present any concerns. John Phillips moved to approve the variance request.
