1995 at 9:00 Aid.
1. CALL TO ORDEJ --'. _. Vice Chairperson Gale Whitaker called the meeting to order at
7:00 PM and declared a guorurn present.

seconded by Vicki Tapp.

BOARD OF ADJUSTMENT' PUBLIC HEARING
. OA -98 -0 - A request for a Special Exception of the Owasso `honing Code, Section
1002, to allow for a non -- permanent accessory vendor on property currently ;coned OO
(Commercial General). The subject property is described as a portion of the southeast
corner of E. 86th Street North and North 123 E Ave., Cornerstone Shopping Center;
further described as 12400 E. 86th Street North.
1. Signage be limited to that which is affixed to the structure itself.
2. A trash receptacle during the hours of business operation.
3. Obtain vendor license from the City Clerk's office.

Vicki Tapp moved to .approve the Special Exception request subject to the above staff
recommendations, The motion was seconded by John Phillips.

an IL (Light Industrial) zoning district. The subject property is described as Lot 2,
Block 1, Three Lakes Industrial Park; further described as 8263 Owasso Expressway.
Mr. Rooney presented the staff report. The subject site is developed as a strip
shopping /office center. The appliewit is requesting this Special Exception to allow for
a restaurant use in an 11, zoning district. The applicant was present to answer any
questions from the Board Members, Concerns with parking was addressed. This rrse
is not opposed by staff and recornr ends approval with the following conditions:
1.. Building permits be obtained for any remodeling.
2. Sign permits be obtained for any signage.
Jerry Duke moved to approve the Special Exception request subject to the above staff
recommendations. The motion was seconded by Vicki "Tapp.

6. A-9 -10 - A request for a Special Exception of the Owasso Zoning Code, Section
1002, to allow for a non - permanent accessory vendor on property currently zoned OS
(Commercial Shopping Center). The subject property is described as Lot 1, dock 1,
Clark plaza Fourth Addition; further described as 11815 E 86th Street North.
Mr. Rooney gave the staff report. A landscaping and plant sale tent operated in this
location last year. Surrounding property owners have been notified and the legal ad was
published in the Owasso Reporter and no objections have been received. Staff
recommends approval of the request with the following conditions:
1. Signage be limited to that which is affixed to the structure itself.
2. A trash receptacle during the hours of business operation.
3. Obtain vendor license from the City Clerk's office.

of October 31, 1998 and above staff reconirmnd.ations. The motion was seconded. by
Vicki Tapp.

7. -98-1 - A request for a Variance of the Owasso Zoning Code, Section 4.30, to
allow for a deviation in the side yard setback requirements of property currently zoned.
RD (Residential Duplex) . The subject property is described as Lot 10 & 11, Block 2,
Hale Acres 11 Addition, Owasso, OK.
Mr. Rooney presented a staff report. The subject property is currently undeveloped.
The applicant is requesting a Variance to allow for the, development of duplexes. The
lots are 60' x 173', which would allow for a. duplex to be constructed at a width ref 4.5'
(5' setback on one side, 10' on the other). `1-"he applicai.it would like to construct a
duplex structure that is 48 feet wide, reducing the side, yard setbacks to 5' and 7'. Staff
would recommer -0 that the `i' setback be applied to the side yards that al) -ut the either
property owners. The applicant was present to answers questions. Staff` recommends
approval of the Variance request which would allow for the deviation in side yard
setback, allowing 5' and 7' side, yard setbacks, with the following condition of approval:
1. The "south" side yard setback of Lot 11, Block 2 be 7 feet.
2. The "north" side yard setback of Lot 10,, Block 2 be 7 feet.
