Motion was seconded by gale Whitaker. AYE: Vines, Imbriano, Whitaker, Tapp NAY: None 'phe motion carried 4 -0. BOARD OF ADJUSTMENT PUBLIC HEARING 3. OBOA -96 -16 - Rick Oberleader - A request for a Variance of the Owasso Zoning ,ode, ,Section 240.2 "Permitted Yard Obstructions" in order to allow for the construction of a 1,200 square foot detached accessory building on property currently zoned RS-1 (Residential Single - Family Low Density). The subject property is described as Lot 3, Block 1, Hale Acres Addition, Mr. Rooney presented the staff report. The property is currently undeveloped. A building permit has been issued for the construction of a single- family residence. The applicant is requesting a Variance in order to allow for the construction of a 1,200 square foot detached building. The Owasso Zoning Code permits the construction of detached accessory structures, providing they do not exceed 750 square feet. The structure would be located 10' from the west property line and 27' from the north property line, OWASSO BOARD OF ADJUSTMENT November 11, 1996 Page Moo 2 The covenants of the Hale Acres addition states that no structure shall be erected, altered, placed, or permitted to remain on any residential building lot other than a single family dwelling with attached garage, Mr. Rooney informed the Board Members that covenants are created by the developer of the property as an agreement between the developer and the private property owners, The avenue:; for enforcement of the covenants is through the court system, 'the applicant rich- dlberlender addressed the Board regarding the materials that would be used and assured the Board ineinbcrs that the structure will matol-I the dwelling, Ile also stated the building will be used to store antique cars, which is his clients hobby, Area residents were present to protest the requesters use. Marie Engles raised the questions concerning property values and had concerns with the noise, Judy Brown had concerns of the property becoming a used car lot, Jambes Brusveen expressed concerns with the property being rezoned to commercial, Steven Smedley had some code enforcement questions regarding inoperable vehicles in yards and driveways. Following discussion and answering of questions, Gate Whitaker proved to approve; the Variance, with the stipulation of everything pertaining to this hobby be Dept inside this structure. Motion was seconded by Bat lrribriano, AYE: lnibriano, Whitaker, Tapp NAY: Vines The motion carried 3 -1 40 OBOA -96 -13 - F'r - A request for a Special Exception to the Owasso Zoning Code, Section 410, "Permitted Uses in residential Districts" to allow for the development and use of a Church in a residential District. The subject property is located west of the southwest corner of E. 86th Street North and No 145th E. Avenue, Mrs Rooney presented the staff report. The applicant is requesting a ,Special Exception in order to allow for the construction and use of a church in a residential zoning district. All churches are permitted in residential districts providing they receive a Special Exception. ,Staff recommends approval of the Special Exception request with the following condition: 10 if sanctuary or chapel area(s) exceeds 14,000 square feet, additional parking will be required, 2. Acceleration /Deceleration lanes are required along all entrances off of E. 86th Street North. 30 Sidewalks are required along E. 86th Street North. Gale Whitaker moved to approve the -request for a Special Exception with the stipulation of the above staff recommendations. Motion was seconded by pat Inibriano. I��ez1i_'i'a�: - A request for a `variance of the Owasso Zoning Code, ,Section 430, "Bulk and Area Requirernents in Residential District" to allow for deviation of the required rear yard setback in an RS-2 (Residential Single-Family Medium Density) zoning district. The subject property is described as pots 8, 14, 16, 19, 22, 23, and 26 of Block 1. and pots 15, 16, 17, 18, and 10 of Block 2, Brentwood Estates, Mr. Rooney presented the staff report . "1'lie applicant is requesting a Variance in order to allow for the development of single - family residences wide a rear yard setback of 20' rather than the 25' required in an RS--2 zoning district. ,Several lots are being requested for rear yard setback, deviation at the same time. Staff recommends approval of the variance request, allowing rear yard setbacks on the above described property of 20 feet. Pat Imbriano moved to approve the Variance subject to letters sent to the property owners stating variance acceptance. emotion was seconded by Vicki Tapp. AYE: hnbriano, Whitaker, Tapp NAY; Vines The motion carried 3 - -1. 6. OBOA -96 -15 - Greg _Simmons -- A request for a Variance of the Owasso Zoning Code, Section 430, "Bulk and Area Requirements in Requirements in Residential Districts" to allow for deviation of the required rear yard setback in an RS-2 (Residential Single- Family Medium Density) zoning district. The subject property is described as sots 28, 34, 36, 37, and 38, Block 3 of Barrington Point II. Mr. Rooney presented the staff report. The applicant is requesting a Variance in order to allow a lesser rear yard setback on 5 lots within Barrington Point 11. The applicant is requesting a 20' rear yard setback instead of a 25' setback. The approval of this request would eliminate home builders having to wait for a separate variance approval on each lot.
