On Tuesday, June 18, 1991 the Owasso City Council met in a
regular session in the Council Chambers at the Community Center
per the Notice of Public Meeting and Agenda posted on the... City
Hall bulletin board at 4:00 p.m. on Friday, June 14, 1991.
ITEM 1: CALL TO ORDER.
The meeting was called to order at 7:00 p.m. with Mayor Phillips
presiding.
ITEM 2: FLAG SALUTE.
The flag salute was led by Mayor Phillips.
ITEM 3: ROLL CALL.

A quorum was declared present.
ITEM 4: RE UEST APPROVAL OF THE MINUTES FROM THE JUNE 4 1991
MEETING AND THE JUNE 11 1991 SPECIAL MEETING.
A motion was made by M. Thompson, seconded, by B. Randolph, to
approve the minutes by reference made a part hereto.

ITEM 5: REQUEST FOR APPROVAL OF THE CLAIMS
A motion was made by B. Randolph, seconded by J. Gittelman, to
approve the following claims: (1) General Fund $56,385.64 (2)
Ambulance Service Fund $448.45 (3) Ambulance Service Capital
Improvement $1,583.99 (4) City Garage $6,791.13 (5) Revenue Bond
Project Fund $20,596.72 (6) General Fund Payroll $70,621.17 and
(7) Garage Payroll $2,749.56.

ITEM 6: REQUEST BY A CITIZEN TO ADDRESS COUNCIL FOR THE PURPOSE
OF AMENDING THE CITY CODE CONCERNING THE KEEPING OF
DOGS INSIDE THE CITY LIMITS OF OWASSO.
Mr. John Blackwell addressed Council stating the Animal Control
officer has given him notice that he has too many dogs at his
residence. He explained that he raises dogs and has property
outside the city limits for the dogs. When the females are ready
to give birth then he brings them to his residence until the
litters become grown. From time to time he will have two to four
adult dogs and litters. He asked Council to concern changing the
code to make mention of puppies and not to include puppies in the
number of dogs allowed. He was also concerned that the code is
most generally ignored until there is a complaint. He feels that
is unfair.
He stated most cities allow three to four dogs and requested that
the code be changed to allow four dogs and make puppies under
four months of age an exception..
The following people addressed Council an this subject: Jerry
McHenry, Chuck Smiley, Dale Stockton, Marlin Kerr and Judy
Stockton.
The biggest concern voiced by the majority of the people is not
the number of dogs but the sanitation and odors involved in
keeping dogs in a residential area.
Mayor Phillips concluded this item by directing the city manager
to have staff review the current ordinance and report to Council
at the July 16th meeting with any changes or recommendations.

ITEM 7: REQUEST COUNCIL APPROVAL OF ORDINANCE NO 430 AN
ORDINANCE RELATING TO OKLAHOMA MUNICIPAL RETIREMENT
FUND (OMRF) REVISED ACTUARIAL ASSUMPTIONS AND AMENDING
THE RETIREMENT PLAN OFFERED BY THE CITY OF OWASSO TO
IT'S EMPLOYEES.
Ms. Sherry (Lambert) Bishop reviewed this item with Council
stating every two years the OMRF hires a consulting actuary to
compute actuarial assumptions. The changes have decreased the
city's contribution from 4.61% to 2.13%. It has not affected the
employees contribution rates. Monthly benefits paid out of our
plan will not change.
A motion was made by B Randolph, seconded by J. Gittelman, to
approve Ordinance No. 430.

ITEM 8: REQUEST COUNCIL APPROVAL OF AN EMERGENCY CLAUSE ON
ORDINANCE NO. 430.
A motion was made by M. Thompson, seconded by B. Randolph, to
approve the emergency clause on Ordinance No. 430.

ITEM 9: REQUEST FOR COUNCIL APPROVAL OF A REQUEST BY THE STAFF
TO INITIATE ANNEXATION PROCESS ON A TRACT OF LAND
BOUNDED ON THREE SIDES BY OWASSO'S CITY LIMITS. GENERAL
LOCATION IS ON THE EAST SIDE OF GARNETT ROAD BETWEEN
113TH STREET NORTH AND 116TH STREET NORTH
Mr. Compton addressed Council stating the tract of land is
approximately five acres in size and is zoned AG. It contains
one single family dwelling and an illegal flea-market business.
There is a County rezoning application for CG that is in progress
on the business part of the land. The Owasso Planning Commission
has reviewed the application for the Tulsa Metropolitan Area
Planning Commission and recommended that the CG request be denied
and that CS be approved. The TMAPC voted with the Planning
Commission recommendation and the application is pending final
action by the County Commission. If the CS zoning is approved,
the business would be allowed only by Special Exception, but if

the subject tract was in the City the flea market business would
not be allowed.
Mr. Compton stated the property in question is both unsafe and
unsightly and the owner has stated at the two public hearings
that he has no desire to improve the business and that if the
requested zoning is denied, he will let the area grow to pasture.
Mr. Compton stated it is extremely important to protect the
integrity of the businesses in that area by not allowing
deterioration of the area to occur. He asked the Council to
direct the staff to study the possible annexation of the tract so
there could be a greater level of assistance in protecting the
area.
After discussion, a motion was made by M. Thompson, seconded by
J. Gittelman, to approve the request to initiate the annexation
process on this particular tract of land.

ITEM 10: REQUEST FOR COUNCIL APPROVAL OF THE EXPENDITURE OF
$1.850.00 TO WEIS AMERICAN FIRE EQUIPMENT FOR THE
EMERGENCY REPAIR OF THE "JAWS OF LIFE" EQUIPMENT USED
BY THE OWASSO FIRE DEPARTMENT.
Chief Allen presented this item to Council stating this tool was
damaged during a rescue operation on June 9th. The vendor has
advised to perform a "conversion repair" that will replace the
motor unit that was damaged. A loaner motor will be provided
until the repair is complete.
After discussion, a motion was made by M. Thompson, seconded by
B. Randolph, to approve the expenditure of $1,850.00 to Weis
American Fire Equipment, for the repair of the "jaws of life"
tool.

ITEM 11: REQUEST FOR COUNCIL APPROVAL OF "END OF YEAR" BUDGET
TRANSFER. THIS ITEM IS LISTED IN THE EVENT ANY FINAL '""'""'
TRANSFERS ARE REQUESTED BY ANY CITY DEPARTMENT.
Mr. Ray stated there are no requests and no action needs to be
taken.

ITEM 12: REQUEST FOR COUNCIL ADOPTION OF THE GENERAL FUND AND
OTHER FUNDS OPERATING BUDGETS FOR THE FISCAL YEAR 1991-
1992.
Mr. Ray stated the budget was presented to the Council two week
ago and a public hearing was held on June 11, 1991 to solicit
citizen input. He asked for the budgets to be adopted.
A motion was made by J. Gittelman, seconded by M. Thompson, to
adopt the General Fund and other Funds operating budgets for
1991-1992.
