HomeMy WebLinkAbout1991.09.17_City Council MinutesOWASSO CITY COUNCIL SEPTEMBER 17, 1991 On Tuesday, September 17, 1991 the Owasso City Council met in a regular session in the Council Chambers at the Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p.m. on Friday, September 13, 1991. ITEM 1: CALL TO ORDER. The meeting was called to order at 7:00 p.m. with Mayor Phillips presiding. ITEM 2: FLAG SALUTE. The flag salute was led by Mayor Phillips. ITEM 3: ROLL CALL. PRESENT: John Phillips, Mayor Patricia Marlar, Vice Mayor Mark Thompson, Councilman Bob Randolph, Councilman Jason Gittelman, Councilman Rodney J. Ray, City Manager Ronald D. Cates, City Attorney Jane Buchanan, City Clerk ABSENT: None A quorum was declared present. ITEM 4: REOUEST APPROVAL OF THE MINUTES FROM SEPTEMBER 3 1991 MEETING. A motion was made by M. Thompson, seconded by B. Randolph, to approve the minutes by reference made a part hereto. AYE: Thompson, Randolph, Gittelman, Marlar, Phillips NAY: None MOTION: Carried 5-0 1 OWASSO CITY COUNCIL ITEM 5: REQUEST FOR__A_PPROVAL OF THE CLAIMS. SEPTEMBER 17, 1991 A motion was made by P. Marlar, seconded by M. Thompson, to approve the following claims: (1) General Fund $24,623.55 (2) Ambulance Service $748.97 (3) City Garage $5,661.92 (4) Workers' Compensation Self Insurance Fund $108.38 (5) Revenue Bond Project Fund $54,343.13 (7) General Fund Payroll $74,170.88 and (7) Garage Payroll $2,868.03. AYE: Marlar, Thompson, Gittelman, Randolph, Phillips NAY: None MOTION: Carried 5-0 ITEM 6: REQUEST FOR COUNCIL ACTION TO RESCIND AN ORDER BY THE CODE ENFORCEMENT OFFICER WHEREIN THE REMOVAL OF AN INOPERATIVE VEHICLE IS REQUIRED. Ms. Betty Bryan who resides at 607 North Carlsbad addressed Council stating she feels the Code Enforcement Officer is singling her out to give her code violation tickets because someone continues to call in and complain about the car that her son is working on in the driveway of their home. She said this is the second time she has addressed Council. The last time was in February of this year. She stated this is the third warning ticket the Code Enforcement Officer has given her. She stated within twenty-four hours after she and her son pushed the car out of the garage to work on it, she gets a ticket. She says none of the other cars in her general area have been ticketed and they are up on blocks and do not even have all the parts. She asked Council to change the ordinance so working people can work on their cars in the driveway and not be breaking the law. Ms. Bryan showed the Council pictures she had taken of cars in worse condition than hers that have not been ticketed. She also presented a petition signed by her neighbors stating they do not have a problem with the car sitting in the driveway while her son is working on it. Mr. Ray commented by stating he does not feel the ordinance needs to be repealed because it allows for abatement when needed. He stated a lot more should be abated and a good job is not being done in reference to the inequity. In discussion, the Council agreed the ordinance does not need to be repealed, but there is a definite problem with the ordinance not being equally enforced. 2 OWASSO CITY COUNCIL SEPTEMBER 17, 1991 A motion was made by B. Randolph, seconded by P. Marlar, to give Ms. Bryan forty-five days to fix the car making this an exception to the time allowed in the ordinance due to the circumstances involved and make the code enforcement officer clean up the rest of the neighborhood. AYE: Randolph, Marlar, Gittelman, Thompson, Phillips NAY: None MOTION: Carried 5-0 The City Attorney requested that the record show Ms. Bryan demanded her pictures and petition, that were entered as evidence, be returned to her. Mr. Ray returned them to her against the advise of legal counsel. ITEM 7: REQUEST COUNCIL APPROVAL OF RESOLUTION NO. 91-07. AN RESOLUTION ESTABLISHING FEES AND CHARGES FOR SERVICES PROVIDED BY THE CITY OF OWASSO AMBULANCE SERVICE. Mr. Ray stated at the previous meeting the council approved an increase in the rates for base service and an increase in the mileage charge. This resolution formalizes the increased fees and outlines the supply charges. A motion was made by B. Randolph, seconded by P. Marlar, to approve Resolution No. 91-07. AYE: Randolph, Marlar, Gittelman, Thompson, Phillips NAY: None MOTION: Carried 5-0 ITEM 8: REQUEST COUNCIL APPROVAL OF ORDINANCE NO. 437. AN ORDINANCE AMENDING THE OWASSO ZONING CODE PROVIDING FOR ADDITIONAL "USES BY EXCEPTION" WITHIN THE "CS" ZONING CLASSIFICATION. Mr. Compton stated this is a request to amend the Owasso Zoning Code to allow "Other Trades and Services" uses and the "Drive-in Restaurants" uses in Commercial Shopping Center (CS) Districts only with approval of a Special Exception by the Owasso Board of Adjustments. At the present time they are not allow at all. This will allow the Board of Adjustments to consider the requests and make special exceptions if they determinate it approximate use of the land. 3 OWASSO CITY COUNCIL SEPTEMBER 17, 1991 Mr. Randolph stated he felt elected officials should have the authority to make these types of exceptions and not a board of appointed members without the Council having the final say. After further discussion, a motion was made by P. Marlar, seconded by J. Gittelman, to approve Ordinance No. 437 and waive the reading of the ordinance in its entirety. AYE: Marlar, Gittelman, Thompson, Phillips NAY: Randolph MOTION: Carried 4-1 ITEM 9: REOUEST BY THE MAYOR FOR COUNCIL CONFIRMATION OF AN APPOINTMENT TO FILL A VACANCY ON THE OWASSO SALES TAX WATCHDOG COMMITTEE. Mayor Phillips that the 1988 Bond Issue included the formation of a "Sales Tax Watchdog Committee". The vacancy is the "member at large" seat held by Mr. Johnny Price. The Mayor requested confirmation of Mr. Steve Barrett to fill the position. A motion was made by M. Thompson, seconded by J. Gittelman, to confirm the Mayor appointment of Mr. Steve Barrett to the Sales Tax Watchdog Committee. AYE: Thompson, Gittelman, Randolph, Marlar, Phillips NAY: None MOTION: Carried 5-0 ITEM 10: REQUEST FOR COUNCIL TO AWARD A CONTRACT TO MOULDER- OLDHAM COMPANY IN THE AMOUNT OF $1 999 50 FOR THE PURCHASE OF ONE (1) AUTOMATIC FLOOR SCRUBBER TO BE USED AT THE RECREATION CENTER AT RAYOLA PARK. BID OPENING WAS HELD ON SEPTEMBER 4. 1991 Ms. Worley addressed Council stated two bids were received. One from Moulder-Oldham in the amount of $1,999.50 and another from J & J Janitorial Repair Service in the amount of $2,900.00. She stated both bids met specifications. She recommended the scrubber be purchased from the low bidder, Moulder-Oldham. A motion was made by M. Thompson, seconded by J. Gittelman, to award the contract to Moulder-Oldham in the amount of $1,999.50 for the purchase of a floor scrubber for the gym floor. 4 OWASSO CITY COUNCIL SEPTEMBER 17, 1991 AYE: Thompson, Gittelman, Randolph, Marlar, Phillips NAY: None MOTION: Carried 5-0 ITEM 11: REPORT FROM CITY MANAGER. None ITEM 12: REPORT FROM CITY ATTORNEY. None ITEM 13: UNFINISHED BUSINESS. None ITEM 14: NEW BUSINESS. Mr. Gittelman asked if it would be a good idea to "down" zone the property the City has recently purchased on Main Street as part of the Main Street Renovation project. Mr. Ray asked if he would allow the staff three weeks of review this issue before any decisions are made since there are discussion with an interested party at the time. ITEM 15: ADJOURN. With there being no further business to be brought before the Council, Mayor Phillips asked for a motion to adjourn. A motion was made by B. Randolph, seconded by J. Gittelman, to adjourn.
