HomeMy WebLinkAbout1984.02.21_City Council Minutes23 On Tuesday, February 21, 1984, the Owasso City Council met in regular session in the Council Chambers at City Hall per the TJotice of Public Hearing and Agenda posted on City Hall bulletin board at 4:00 p.m, on February 17, 1984. ITEM l: CALL TO ORDER The meeting was called to order at 7:08 p.m, with Mayor Spencer presiding. ITEM 2: FLAG SALUTE Flag salute was led by Mayor Spencer. ITEM 3: ROLL CALL PRESETdT: Boyd Spencer, Mayor Wauhilleau Webb, Vice-Mayor James Smalley; Councilman Von Stockier, Councilman Ron Cates, City Attorney Ben Hynum, City Manager Ann Hendrickson, City Clerk ABSENT: Phyllis Gross, Councilwoman ITETZ 4: COISIDERATION OF APPROVAL OF CONSENT AGENDA ITEMS: A. APPROVAL OF CLAIMS Motion was made by James Smalley, seconded by Wauhilleau Webb, to approve the items on the consent agenda, by reference made a part hereof. AYE: Messrs. Spencer, Stockier, Smalley; Mrs. Webb NAY: None Motion Carried. ITEM 5: BUSINESS A. DISCUSSION OF POSSIBLE FACILITY FOR FORMERLY CHRONICALLY MENTALLY ILL DAVID CRAMER - STAR COMMUNITY HEALTH CENTER Mr. Cramer requested that this item be stricken from the agenda. B. CONSIDERATION OF PETITION FOR ANNEXATION/ELDEN BIRI:S. REQUEST TO ANNEX ZO ACRES LOCATED IMMEDIATELY WEST OF 1'~.,.i:ADOWCREST SUBDIVISION, WEST OF 1095h ST. N. AND GARNETT 24 OWASSO CITY COUNCIL PAGE TWO FEB. 21, 1984 Mr. Gerald Snow stated that he wished to speak to the Council concerning this matter as he has a contract on the property. He said he would like the Council to consider an exception so that he would be able to put in roads without curbs and gutters. He said the roads will be prepared with a h~.gh grade of gravel covered by asphalt. He said he was proposing 37 half- acre tracts which would not be feasible if he had the added expense of curbs and gutters. He stated that he would be willing to post a bond to cover any damage that might occur to 110th St. N, during construction. Carol Dickey stated that the request had been reviewed by the Planning Commission at their last meeting and they found no reason why the property should not be annexed. They made no recommendation regarding the requested exception as that would have to be dealt with after annexation procedure was completed. Mation was made by James Smalley, seconded by Von Stockier, to annex the 20 acres immediately west of Meadowcrest subdivision. AYE: Messrs. Smalley, Stockier; T~Zrs. Webb IJAY : TZr . Spencer Motion carried. After discussion with Mr. Snow, the City Attorney stated that Mr. Snow did not wish the property to be annexed unless he could get the exception regarding curbs and gutters. Mr. Cates stated that if he did not receive the desired exception through the regular procedures, he could withdraw his plat and petition for deannexation. Motion was made by James Smalley, seconded by Von Stockier, to rescind the motion to annex the 20 acres immediately west of Meadowcrest subdivision. AYE: Messrs. Smalley, Stockier, Spencer; Mrs. Webb NAY: None Motion carried. C. APPOINTMENT OF BOARD. OF ADJUSTMENT MEMBER-REQUEST TO ACCEPT RESIGNATION LETTER OF GARY WHITE AND CONSIDER APPOINTING NEW MEMBER TO THE BOARD OF ADJUSTMENT. Carol Dickey stated that because of a change in employment, Mr. [Jhite had submitted his resignation and that the Board would recommend Mr. Bob Peel for appointment. Mayor Spencer stated that Mr. Peel had talked with. him today and asked that his name be withdrawn. 25 OWASSO CITY COUNCIL PAGE THREE FEB. 21, 1984 Motion was made by Mayor Spencer, seconded by Von Stockler, to accept the resignation of Gary White from the Board of Adjustment. AYE: r~essrs. Spencer, Stockler, Smalley; Mrs. Webb NAY: None Motion carried. Motion was made by Mayor Spencer, seconded by Mrs. Webb, to appoint Rick Mahar to the Board of Adjustment. AYE: P~essrs. Spencer, Stockler, Smalley; Mrs. LJebb NAY: None Motion carried. D. OWASSO ZONING CODE - CONSIDER Carol Dickey asked that the Council review the amendments and consider them at a later meeting. Mayor Spencer asked that consideration of the amendments to the zoning code be placed on the April 3 agenda. E. OPENING OF BIDS ON RESURFACING OF TENNIS COURTS Bids were opened and read by Mayor Spencer as follows: Jennite Service Co. 1916 N. Sheridan Tulsa, Ok. Richie's Tennis & Tract 10$2$ E. Newton Place Tulsa, Ok. Bid ~~1: $14, 698.00 Bid ~~2: $9, 275.00 Bid ~~1: $6,000.00 Bid ~~2: $11, 812.00 The Mayor asked that the minutes reflect that the Council direct the City Manager to take the necessary actions to get the job done. (see Item 7.) F. .OPENING OF BIDS ON AUTOMATIC CARDIOPULMOTJARY RESUSCITATOR Bids were opened and read by Mayor Spencer as follows: Armstrong Industries iJorthbrook, Illinois Bid: $4,635 Dixie, U.S.A. Inc. Bid: $4,931 Houston, Texas S TO ORDINANCE The Mayor recommended that the City Manager and Fire Chief Bob Allen review the bids and the necessary action be taken. MEr'IBERS OF OKLAHOPZA S CONGRE S S IOTIAL DELEGATION TO ACHIEVE FEDERAL CABLE LEGISLATION CONSISTENT WITH` PRESERVATION OF LOC L FRANCHISE AUTHORITY IN ESSENT-IAL ARE 5 . _ Mayor Spencer stated that he felt it was important for the Council to let the Oklahoma Congressional Delegation know what type of Federal cable legislation they would wish to have passed. Motion was made by Wauhilleau Webb, seconded by Von Stockier, to adopt Resolution ~~84-03. .AYE: Messrs. Spencer, Stockier, Smalley; Mrs. Webb NAY: None Motion carried. H. CONSIDERATION OF ADOPTION) OF RESOLUTION ~~84-04 APPROVING THE INCURRING OF INDEBTEDNESS BY THE TRUSTEES OF THE OW SS0 INDU5TRI L AUTHORITY IN THE PRINCIPAL AMOUNT OF OT TO EXCEED 800,000.00 FOR THE PURPOSE OF FINANCING THE EXPANSION OF AN INDUSTRIAL MANUFACTURINIG FACILITY FOR WOODS ENERGY PRODUCTS, INC., AND THE NEGOTIATED SALE, ISSUANCE AND DELIVERY OF A PROMISSORY NOTE EVIDENCING SUCH INDEBTEDNESS. Mr. Tom Hilborne stated that in 1981 the Owasso Industrial Authority assisted in financing two projects, Parco Manufacturing Company and DWC (basically Barton Wellhead). He said both of these companies. in 1983 were acquired by the Woods Energy Products, Inc. Woods Energy Products has now asked the Authority for additional financing to expand both of those facilities in the amount of $800,000. The Authority had a meeting on February 20 and approved that financing which will be obtained from the American Bank of Tulsa. Mr. Holborne stated that the loan would be a non-recourse loan and would be secured by a second mortgage on those facilities and a note from Woods Energy Products. He said that by statute, the Council as well as the Authority is required to approve the borrowing and to waive competitive bidding. Motion was made by James Smalley, seconded by Von Stockier, to adopt Resolution ~~84-04. AYE: Messrs. CONSIDERATION OF ACCEPTANCE OF LOW BID ON OFFICE COPIER WITH ADDITION OF AUTOMATIC FF,EDER. Mr. Lee Dawson stated that he recommended the low bid on the Canon copier. He said a ten-bin sorter and reduction capability to add an automatic document feed which w~ to $5,151 which is sill below the amount purchase. tha the and Auld set t the City accept copier comes with that he would like bring the price aside for the Mayor Spencer adjourned the meeting for five minutes to allow Council members to look at the copier which had been brought for demonstration. Meeting adjourned at 7:53 p.m, and reconvened at 8:00 p.m. Motion was made by James Smalley, seconded by Von Stockl_er, to accept the low bid submitted on the Canon copier with the addition of the automatic document feed. AYE: Messrs. Spencer, Smalley, Stockier; Mrs. Webb NAY: None Motion carried, 6. REPORT FROP•Z CITY ATTORNEY Done at this time. 7. REPORT FROM CITY MANAGER Mr. Hynum said the Chamber of Commerce wants to plant trees and shrubs in the City and wanted suggestions as to where to plant them. He said he had suggested Rayol-a Park, the Cemetary, and the 76th Street North median. Mr. Hynum said he had furnished lists to the Council of streets to be considered for street work and that he has now been requested to provide a map for the County of exactly which streets to include in the upcoming work. He said he needs concurrance from the Council. Mayor Spencer stated that all the streets in Meadowcrest should be done first, then sections of Cedar and Dogwood. He said the water leak on Dogwood should be fixed before any work is done on the street. Mr. Smalley said there would need to be some relocation of water lines on llogwood, Mayor Spencer said he had gone to Tulsa Tractor to get infor- mation on a mower for the City. He said they have some diesel 28 OWASSO CITY COUNCIL PAGE SIX FEB. 21, 1984 mowers .that. might be adequate and that he was going to also talk with Bridges Ford and see what they have. The Mayor said that with regard to the bids on the tennis courts and resuscitator, he wanted the City Manager to select the best bid and bring it back to the Council. Mr. Hyrum said he would like to be able to review the b-ids and have Council's approval to accept the lowest bid that met the specifications and not have to bring it back before the Council. Mr. Cates asked that the Council vote on the emergency clauses of Resolutions ~p84-03 and $84-04. Motion was made by Mayor Spencer, seconded by James Smalley, to adapt the emergency clause on Resolution ~~84-03. AYE: Messrs. Spencer, Stockler, Smalley; Mrs. Webb NAY: None Motion carried. Mr. Smalley said he thought the Council had earlier in the meeting directed Mr. Hyrum to review the bids and accept the low bid that met the specifications. Mayor Spencer said he thought any time bids were opened, recommendations of the Law bid would come back at the next Council meeting. Mr. Smalley said he felt since there were just two bids, in the interest of time, it might be better to direct the City Manager to proceed. Mrs. Webb said as long as the Council was sure they wished to purchase the items, it might be ok to proceed. But if not, it should be brought back to the Council. Mr. Cates said the Council could legally instruct the City Manager to proceed with the lowest bid that meets t:ze specifications, but it must be by specific motion. He said if the City Manager determines that there is not a bid that meets the specifications and price range, then he would need to come back to the Council and ask that the award be withdrawn and ask to rebid. Motion was made by James Smalley, seconded by Von Stockler, to accept the low bid on the resurfacing of the tennis courts (Item E) that meets the specified criteria. AYE: PZessrs. NET~J BUSINESS Mr. Smalley said he had reviewed the bids on the computers with Mr. Dawson and would like to recommend that the City obtain the services of a computer consulting firm to analyze the needs of the City and which bidder most closely meets those needs. Mr. Dawson said the City auditor was also working with him on deciding which computer best fits the City's needs.
