HomeMy WebLinkAbout1984.03.20_City Council Minutes33 On Tuesday, March 20, 1984, the Owasso City Council met in regular session in the Council Chambers at City Hall per the Notice of Public Hearing and Agenda posted on City Hall bulletin board at 4:00 p.m. on February 17, 1984. ITEM l: CALL TO ORDER The meeting was called to order at 7:35 p.m, with Mayor Spencer presiding. ITEM 2: FLAG SALUTE Flag salute was led by Mayor Spencer. ITEM 3: ROLL CALL PRESENT: Boyd Spencer, Mayor Wauhilleau Webb, Vice-Mayor James Smalley, Councilman Von Stockier, Councilman Phyllis Gross, Councilwoman (now Capshaw, hereinafter Ben Hynum, City Manager referred to as Phyllis Gross) Ron Cates, City Attorney Ann Hendrickson, City Clerk ABSENT: None ITEM 4: CONSIDERATION OF APPROVAL OF CONSENT AGENDA ITEMS: A. Mayor Spencer asked that Item H be removed from the Consent Agenda and placed on the April 3 Council agenda. 34 OWASSO CITY COUNCIL PAGE TWO MARCH 20, 1984 Motion was made by James Smalley, seconded by Von Stockler, to approve the Consent Agenda, by reference made a part hereof. AYE: Messrs. Spencer, Stockler, Smalley; Mesdames Webb, Gross NAY: None Motion carried. ITEM 5: BUSINESS A_. CONSIDERATION OF APPROVAL OF PETITION FOR ANNEXATION SOKOLOSKY-WILLIAMS. REQUEST TO ANNEX 60 ACRES LOCATE N R~ THEAST OF THE NORTHEAST CORNER OF SECTION 28, TOW Carol Dickey stated that although there was not a quorum present at the Planning Commission-meeting when this item was discussed, the comments of the members present had been favorable. Mrs. Gross suggested that the Council wait for formal approval from the Planning Commission. Mr. Smalley asked what effect this annexation might have on our current problems with the sewer situation. Mayor Spencer said he had talked with Gary Woodruff and John Gilmore who had said as long as the City was working toward a new plant, it would be ok. Mrs. Gross and Mr. Smalley asked if the City could get that in writing. Mr. Cates said that although a recommendation from the Planning Commission is not legally required, the Council has set a precedent in re- questing the Planning Commission's recommendation before acting on an annexation request. Mr. Cates said that if the Council wishes to have the Planning Commission's recommendation, he would suggest that this item not be rejected at this time, but be re- ferred back to the Planning Commission. This would preserve previous legal publications. Ms. Dickey said she would request that the Planning Commission hold a special meeting before the next regular Council meeting. Motion was made by Wauhilleau Webb, seconded by Mayor Spencer, that the request for approval of petition for annexation submitted by Mr. Sokolosky and Mr. Williams be referred back to the Planning Commission for their recommendation. Mrs. Gross asked that Mrs. Webb allow her motion to be amended to add that the City Manager verify with the County and State Health Departments that such an annexation would not cause a problem for the City. Mrs. Webb agreed to amend her motion to that effect. Mr. Smalley seconded the amended motion. AYE: T~Iessrs. CONSIDERATION OF REQUEST FOR AUTHORIZATION OF CITY ATTORNEY TO EXECUTE ON BEHALF OF THE CITY OF OWASSO, A DECREE VACATING A PORTION OF PLATTED EASEMENT - LOT 15, BLOCK 1, THREE LAKES TT AT1T)TTTf1N ('.A~T~ ~EC'..T_RG._F,S~ TN TNF T)T~TRT('.T ('.nTTRT C1F TTTT.~A Potion was made by Mayor Spencer, seconded by Wauhilleau Webb, to authorize the City Attorney to execute on behalf of the City, a decree vacating a portion of platted easement on +T..ot 15, Block 1, Three Lakes II, Case ~~CJ-84-653.in the District Court of Tulsa County. AYE: Messrs. Spencer, Stockler, Smalley; Mesdames Webb, Gross NAY: None Motion carried. C. CONSIDERATION OF REQUEST FOR CITY TO PARTICIPATE WITH SEVERAL COMMUNITY GROUPS IN CONTRIBUTING MATCHING FUNDS IN THE AMOUNT OF 1 250 TOWARD FIREWORKS DISPLAY OIQ JULY 1984. Mr. Loy Payne of the Tulsa Chamber of Commerce said that there tivas not enough money to have a fireworks display last year and perhaps the City could participate with several community civic organizations so that enough funds could be raised to have a display this year. He said the display would be on July 3, not July 4, at Ator field. He said that if City firemen could be; there to actually light the fireworks, the firm that builds the fireworks would charge less for the display. Mrs. Webb asked if the display would be-free admission to the public. Mr. Payne said it would be free. Mayor Spencer asked the City Attorney's opinion on the City's participation. Mr. Cates asked for time to study the request, tiayor Spencer asked that the item be put on the April 3 Council agenda. D. CONSIDERATION OF REQUEST FOR PAYMENT OF $100 PER SESSION FOR ALTERNATE JUDGE. Motion was made by James Smalley to approve the request for pay- ment of $100 per session for alternate judge. Mrs. Webb asked if Mr. Smalley would like to put a limit on the number of pay- ments per year. Motion was amended to read "not to exceed five sessions". Mr. Hynum said if this was approved, the b>rtdget would have to be supplemented to cover it. Mayor Spencer and Mrs. Gross voiced the opinion that if the Judge is not able to be in court, he should pay for a substitute himself, that otherwise he tioould be paid for work he did not do. 36 OWASSO CITY COUNCIL PAGE FOUR P~IARCH 20, 1984 i~Ir. Cates stated that an Alternate Judge can only be provided for by ordinance under existing code. He said an acting judge can be appointed by the Mayor to serve in his absence. Mrs. Webb stated that this had been done several years. ago. Mr. Smalley rescinded his motion. Motion was made by Mayor Spencer, seconded by Von Stockler, to deny the request for payment for an alternate judge. AYE: Messrs. Spencer,. Stockler, Smalley; Mrs. Gross NAY : Mrs . Webb P•Totion carried. E. CONSIDERATION OF APPOINTMENT OF STEVE JAY AS CONSULTANT IN THE SELECTION OF A COMPUTER. Mr. Hynum stated that he had contacted O.S.U. and their service would take six months and cost between 5 and 6 thousand dollars. He said the City Treasurer had talked with Mr. Steve Jay, who said he would perform the service for no more than $2,000. Mrs. Webb said she felt Mr. Jay would be a logical choice as a con- .. sultant in this matter. T•lotion was made by Wauhilleau Webb, seconded by Von Stockler, to engage the firm of Lohrey and Jay to perform a consulting service in the selection of a computer. AYE: Mr. Stockler; Mesdames Webb, Gross NAY: Mr. Spencer, Mr. Smalley Motion carried. Mr. Spencer stated that he had voted no because he felt Mr. Jay would be too closely tied to Burroughs. He said he felt the Council should go together to see the computers that are being considered. Mrs. Webb asked the City t~ianager to tell Mr. Jay about the Council's concern that. no particular computer be given preferential consideration. Mr. Smalley said the Council needs to know which machine will best fit our needs. F. CONSIDERATION OF AUTHORIZATION TO CONDUCT AUCTION OF SURPLUS ITEMS. Z•1rs. Webb asked if there was a list of items to be auctioned. Mr. Hynum said .there would be a list, that they would have to furnish the auctioneer with a list, r1r. Cates said that if the cumulative value of the items to be auctioned exceeds $500, tie necessary prerequisite is that the Council make a declara- tion that those items are surplus and may properly be sold, prior to the process of selling. 37 OWASSO CITY COUNCIL PAGE FIVE MARCH 28, 1984 Mr. Cates recommended that a list be drawn up of property to be declared surplus.or obsolete. Mayor Spencer asked that a list be prepared and this item be placed on the April 3 agenda. G. CONSIDERATION OF RECOMMENDATION ON BIDS SUBMITTED FOR REPAIR OF TENNIS COURTS. P•1r. Hynum stated that the bids received met the specifications, but did not fall within the amount of money allocated by the City Council. He said the Council had allocated $4,500 and the lowest bid was $6,000. He said if the item was rebid he doubted a bid would be submitted for- less than $6,000. Mrs. Webb said the Council's options were either to reject the bids and bid again or come up with another- $1,500. Mr. Hynum said the balance of unallocated revenue sharing funds had been put in a capital improvements fund and the $1,500 could come from there. Spencer, Stockier, Smalley; Mesdames Gross, Webb NAY: None Motion carried. H. CONSIDERATION OF SUBMISSION OF NOMINATION TO BOARD OF TRUSTEES OF OML MUNICIPAL ASSURANCE GROUP. . Motion was made by Mayor Spencer, seconded by Wauhilleau Webb, to submit the name of James C. Smalley as a candidate for election to the Board of Trustees of OML Municipal Assurance Group. AYE: Messrs. Spencer, Stockier; Mesdames Webb, Gross NAY: None ABSTAIN: Mr. Smalley Motion carried. 38 OWASSO CITY COUNCIL PAGE SIX MARCH 20, 1984 I. CONSIDERATION OF ADOPTION OF ORDINANCE ~~332 ADOPTING AND ENACTING A CODE OF ORDINANCES OF THE CITY OF OWASSO, OKLAHOMA.: PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES NOT INCLUDED .THEREIN, EXCEPT AS HEREAFTER PROVIDED; PRO- VIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE: PROVID- ING FOR SALE AND COPIES IN THE CLERK S OFFICE: PROVIDING FOR SUPPLEMENTS OR CHANGES TO CODE: AND DECLARING AN EMERGENCY. Motion was made by Mayor Spencer, seconded by Von Stockler, to adopt Ordinance ~~332 adopting and enacting a code. of ordinances for the City of Owasso, Oklahoma. AYE: Messrs. Spencer, Smalley, Stockler; Mrs. Webb NAY: None ABSTAITJ : Mrs . Gros s notion carried. J. CONSIDERATION OF ADOPTION OF ORDINANCE ~~332 EMERGENCY CLAUSE. ,...~,. The City Attorney explained that the emergency clause is neces- sary in order for the Code to go into effect on April 1, 1984, that being the legal deadline. Motion was made by Zlayor Spencer, seconded by Von Stockler, to adopt Ordinance ~~332 Emergency Clause. AYE: Messrs. Spencer, Stockler, Smalley; Mrs. Webb NAY: None ABSTAIN: Mrs. Gross Motion car-ried. K. CONSIDERATION OF ADOPTION OF RESOLUTION ~~84-05 DIRECTING FILING AND NOTIFICATION OF THE PUBLICATION OF THE OWASSO CITY CODE. Motion was made by Mayor Spencer, seconded by Von Stockler, to adopt Resolution ~~84-05 dir-ecting filing and notification of the publication of the Owasso City Code. AYE: Messrs. Spencer, Stockler, Smalley; Mrs. Webb NAY: None ABSTAIN: Mrs. Gross Motion carried. 39 OWASSO CITY COUNCIL PAGE SEVEN MARCH 20, 1984 6. .REPORT FROM CITY ATTORNEY None at this time. 7. REPORT FROM CITY MANAGER Mr. Hynum said he had talked with a company who would be able to submit a bid under $8,p00 on the engine analyzer scope. He said the only bid received before was rejected because the. price was too high and the equipment was not new. Mayor Spencer said he thought less expensive equipment could be used. He said a local automotive supply store could furnish what is needed for less money. Mr. Hynum said he would like Council's approval to set up a clean-up campaign for the City about the last part of April and first part of May. He said it would be a time when the sanita- tion trucks would pick up things people wanted to get rid of. Mrs. Webb said she would like to see the dumpster at Rayola Park moved to another location. Mr. Hynum said the County was willing to help put in the new parking lot. He said the City Attorney had given the final ok to begin construction on the parking lot. He said money from the General Fund operating capital could be used for this project. Mr. Cates suggested that approval for funds for this project be put on the next agenda. Mr. Hynum said the City has received a Community Development Block Grant in the amount of $445,000 for new water lines, drainage and refurbishing of 20 low-income homes in a certain section of the original town of Owasso. 8. NEW BUSINESS Mrs. Webb stated that she would recommend the Council forego packets for the meeting of May 1, 1984, so that the City Clerk could attend a two.-day training session presented by the Okla- homa Commission for.Training Municipal Clerks, Treasurers and Finance Officers.
