HomeMy WebLinkAbout1984.04.17_City Council Minutes51 On Tuesday, April 17, 1984, the Owasso City Council met in regular session in the Council Chambers at City Hall per the Notice of Public Hearing and Agenda posted on City Hall bulle- tin Board at 4:00 p.m, on April 13, 1984. ITEM l: CALL TO ORDER The meeting was called to order at 7:03 p.m, with Mayor Spencer presiding. ITEM 2: FLAG SALUTE Flag salute was led by Mayor Spencer. Spencer, Stockler; Mesdames Webb, Gross ~ rt NAY: None Motion carried. ITET~ 5: BUSINESS A. CONSIDERATION OF RE UEST FOR REPAIR OF SERVICE ROAD NORTH OF 86th ST. TdORTH SOKOLOSKY. Mr. Sokolosky stated that the County and the City had repaired the street from the skating rink north and he felt the part of the road on his property should also be fixed properly. He said the County maintains other service roads in the city, but has never done anything to the road from 86th St. N. to the skating rink. He said the City Manager had suggested that~if he would give an easement, it could probably be worked out with the county. He said he would consider it if the easement could be deeded back to him when he gets ready to develop the area. He said the road should be moved to state right-of-way and should be put in by tine County, but if not, tie would do whatever it takes to get the road fixed. He said he did not feel it was his total responsi- bility to fix the road and all he asked was a fair shake. 52 OWASSO CITY COUNCIL PAGE TWO APRIL 17, 1984 Mr, Stockier said he was aware that the State had said they would not put a road in there until the bypass was built which would be a long time. Mr. Hynum said he had talked with Mr. Tom Terry of the County Commissioner's office who had said the County could not maintain a road on private property, but had not as yet re- ceived a reply regarding the possibility of putting the road on State easement. Mr. Sokolosky said if he had to spend several thousand dollars on the road, he would rather it be spent put- ting the road where it belonged, on state right-of-way. ~Ir. Hynum said if repair were to be done on the existing road, he had talked with Mr. Sokolosky about his .giving an easement and his buying the materials if the City did the work, Mr. Hugh Daniel asked if it would be possible to ask for a 30 day easement from Mr. Sokolosky while the City patches the road. Mr, Hynum said there is also a drainage problem involved and the whole area would benefit by having the road moved onto state easement. He said if the Council wished, he would find out if this can be done, at what price, and if not, why not. Mrs. Webb said that although the road is on private property, it is used by all the citizens of Owasso. She asked if Mr, Sokolosky chose to completely close the road, would another road have to be put in and if so, who would be responsible. Mayor Spencer said it was his understanding that the County had the responsibility for the service roads. Mr. Hynum said if the County put the service roads in, the County would probably have to respond if the road was closed. Mrs. Webb said that perhaps such an action would force the issue, but she realized it would also cause problems for the businesses in the area. Mr. Larry Bollinger said the City refuse trucks are the cause of the road being in such bad condition. Mayor Spencer asked the City Manager to pursue a solution to the problem. B. CONSIDERATION OF AUTHORIZATION FOR CITY TREASURER TO APPLY FOR VISA CARDS FOR CITY OF OWASSO. The City Treasurer stated that the use of Visa cards when City employees and Council members went on trips would solve a prob- lem in present accounting practices and would be more efficient for all .concerned. ~He said the card would be made to City of Owasso and City Treasurer and certain authorized signatures would be accepted. He said it would be kept in a safe place and people would have to sign out to use it. Motion was made by Mayor Spencer, seconded by. CONSIDERATION OF RECOT~IENDATION OF CITY TREASURER FOR PUR- CHASE OF TEYAS INSTRUMET~ITS COMPUTER AND AUTHORIZATION FOR SUPPLEMETIT_AL FUND5 APPROPRIATED FROT~I REVENUE SHARING CAPITAL RESERVE FOR PURCHASE OF SAME. Mr. Dawson recommended that the City purchase the Texas Instru- ments computer and said that Steve Jay would make a report. Mr. Jay said he had been asked to be spokesman of the group con- sisting of Mr. Dawson, Mr. Hynum, Jan Worley and himself. He said the group had made at least six trips out to see the vendors. He said the group felt the Texas Instruments computer and related software was the best buy for the City at this time. Mrs. Webb asked about conversion time. Mr. Jay said they had talked with another city who had made the conversion in a reasonable period of time. Mrs. Worley said it would probably take four to six months for complete conversion. Mr. Jay said that initially there would probably be some running of both systems parallel until all the inputting was done. Mrso Worley said T.I, has software avail- able such as General Ledger that is just what the City needs. Mr. Frank Fries of Burroughs stated that they had the best interest of the City of Owasso at heart and can provide the City with the things that are needed. He said their bid gave all of the costs up front and they had capability of getting system in operation very quickly. He said they can give the City the pro- grams requested. He said they had not changed their bid and some other vendors had underbid their systems. T~Iotion was made by Wauhilleau Webb, seconded by Von Stockler, to accept the City's recommendation to purchase the computer from Texas Instruments and to authorize supplemental funds appropria- ted from revenue sharing capital reserve for purchase of same. CONSIDERATION OF AUTHORIZATIOTd FOR MAYOR OR CITY MANAGER, UPON RECOT~NDATION FROT'T FIRE AND POLICE CHIEFS, TO ENTER INTO MUTUAL AID AGREEMENTS WITH COP'IMUNITIES THAT BORDER OUR FENCE LINE. Mayor Sr~encer said he thought any agreements would have to be signed by the Mayor. Mrs. Gross said the City Code states that the Mayor is to preside over the meetings and that the Mayor has no more authority than the council members, T~Iayor Spencer said that all executions approved by the Council are signed by the Mayor.- Mayor Spencer asked that the item be put on tine next agenda . E. CONSIDERATION OF APPROVAL OF ORDINANCE ~~334 AMENDING. SECTION 6-123 OF THE CODE OF ORDINANCES OF THE CITY OF OWASSO, OKLAHOMA, PROVIDING FOR DELETION OF SECTION 6-123-A PROVIDITG AN INCREASE IN AMOUNT OF APPEARANCE BONDS REQUIRED FOR ALL OFFENSES, REPEALING PROVISIONS IN CON- FLICT TTiEREWITH AND DECLARING AN EMERGENCY_ Mayor Spencer asked if the emergency clause was necessary. The City Clerk said the Court had requested it so that the $200 limit on fines and bonds could go into effect immediately. The T~ayor said the public should be advised of this increase in advance of the effective date. T~Iotion was made by Mayor Spencer, seconded by Von Stockler, to adopt Ordinance ~k334 amending Section 6-123 of the Owasso City Code, providing for deletion of Section 6-123A, providing an increase in amount of appearance bonds required for all offenses and repealing provisions in conflict therewith. CONSIDERATION OF APPROVAL OF ORDINANCE ~~334 EMERGENCY CLAUSE Motion was made by Mayor Spencer, seconded by Wauhilleau Webb, to deny approval of Ordinance ~~334 emergency clause.- AYE: Messrs. CONSIDERATION OF AUTHORIZAT--ION F CITY MANAGER OR CITY ERS DESIRING TO ATTEND -y. Motion was made by Mayor Spencer, seconded by Von Stockler, to authorize the City Clerk to make reservations for members desiring to attend OML workshop for elected officials, June 7-9. AYE: Messrs. Spencer, Stockler; Mesdames Gross, Webb NAY: None Motion carried. H. CONSIDERATION OF FIXING COMPENSATION FOR ALTERNATE JUDGE OF MUNICIPAL COURT OF THE CITY OF OWASSO, OKLAHOMA, IT1 Item passed to May 1 Council meeting. I. CONSIDERATION OF AUTHORIZATION OF MAYOR TO EXECUTE ACCEPTANCE OF COT~'IUNITY DEVELOPMENT BLOCK GRANT ADMINISTERED BY DEPT. OF ECONOMIC COMMUNITY AFFAIRS, STATE OF OKLAHOMA. T1r. Andy Armstrong of INCOG stated that since Owasso was under- taking a significant water and sewer improvements program, INCOG felt it was a good time for a successful application to be pur- sued for the City Owasso through DECA. He said the program in- volves a 30% match for the City and must be in a low to moderate income neighborhood. He said a statement of needs was prepared by INCOG working with the engineer and City staff and submitted. The offer letter that has been received is the result of a decision at DECA to fund this program based on the information that they have received. He said the housing rehabilitation program was developed along the lines of several other successful programs INCOG has been involved with in the area. He said 60 to 70 potential structures had been identified and it was decided that 20 would be a good num- ber to take a look at .and the average grant would be around $8,000. He gave the Council some program guidelines to give them informa- tion about how a rehab program works. He said he understood the City wished to limit the program to owner occupied housing with the elderly being considered fir-st. lie said there is an income qualification and verification of ownership required and the house must be able to be brought up to minimum housing standards. He said the drainage improvements would be based on the engineering study. He said the engineering cost is $21,500 and would be part of the 30% contribution of the City. Mayor Spencer asked that the Council study the information pre- sented and the item be placed on the May 1 agenda. 56 OWASSO CITY COUNCIL PAGE SIX APRIL 17, 1984 J. CONSIDERATIOTd OF COUNCIL'S ENDORSEMENT OF REQUEST TO Y Mr. Hynum stated that Dave Simpson has requested a letter of support to help local churches in their endeavor to lease a cizannel on the local television cable system to broadcast Christian programs. Mrs. Webb said she would like to make a personal endorsement of the proposal, but saw no need for a vote of the Council. Mayor Spencer said he would also like to personally endorse it. The City Clerk said she would prepare individual letters for any who wished to sign one. 6. .REPORT FROM CITY ATTORNEY City Attorney not present. 7. REPORT FROM CITY MANAGER Mr. Hynum stated that the Personnel Board hearing has been post- poned to April 24.and that one of the applicants has withdrawn his appeal. He said the auction is set for May 26 at 10:00 a.m. He stated that the Owasso Fire Department has been requested to pilot a program for arson investigation and that it is quite an honor for the Fire Department and the City. He said the street sweeper is in operation and is operating at 6:00 in the morning. He stated that the Police and Fire departments are receiving a number of commendations. He said the new Police Sargent is Terry Laflin. 8. APPROVAL OF CLAIMS Motion was made by Wauhilleau Webb, seconded by Von Stockler, to approve claims for March in the amounts of $115,885.39 and $4,123.73. AYE: Messrs. Stockler, Spencer; Mesdames Gross, Webb NAY: None Motion carried. 57 OWASSO CITY COUNCIL PAGE SEVEN APRIL 17, 1984 9. NEW BUSINESS Mrs. Gross said she wished to thank everyone for the opportunity to serve on the Council. She said that perhaps there have been times when we've locked horns and have not always seen eye to eye. She said that to try to work together and yet not loose individual thinking is very important and she charged that to the person who is going to be sitting in her seat. She said she felt all the councilmembers had grown during the last few years and she is grateful to have been a part of the Council. She said she would continue to watch with interest the growth of the City and is entrusting her seat to someone who is very qualified and who will not consider politics, but the welfare of the City. Mayor Spencer announced that the special meeting on April 26, 1984, would be held at 2:00 p.m. There being no further business before the Owasso City Council, meeting adjourned at 8:17 p.m. Q/k/ Boy M.
