HomeMy WebLinkAbout1984.05.01_City Council Minutes63 On Tuesday, May 1, 1984, the Owasso City Council met in regular session in the Council Chambers at City Hall per the Notice of Public Hearing and Agenda posted on City Hall bulletin board at 4:00 p,m, on April 27, 1984. ITEM l: CALL TO ORDER The meeting was called to order at 7:02 p.m. with Mayor Spencer presiding. ITEM 2: FLAG SALUTE Flag salute was led by Mayor Spencer. ITEM 3: ROLL CALL PRESENT: Boyd M. Spencer, Mayor Wauhilleau Webb, Vice-Mayor Von Stockler, Councilman James Smalley, Councilman Ben Hynum, City Manager Ron Cates, City Attorney Ann Hendrickson,•City Clerk ABSENT: Phyllis Gross, Councilwoman yTEM 4: APPROVAL OF MINUTES OF APRIL 17. 1984. The City Clerk stated that the City Attorney was incorrectly listed as present at the meeting, Motion was made by Wauhilleau Webb, seconded by Von Stockler, to approve the minutes of April 17, 1984 as corrected, by reference made a part hereof, AYE: Messrs. Spencer, Stockler; Mrs. Webb. NAY: None ABSTAIN: Mr. Smalley ITEM 5: SEATING AND SWEARING IN OF BOYD M. SPENCER AS REELECTED CITY COUNCIL MEMBER FROM WARD 4. Mr. Spencer was given the Oath of Office by the City Attorney and seated as the Councilman for Ward 4. ITEM 6: SEATITZG AND SWEARING IN OF ROBERT M. PEEL AS NEWLY ELECTED CITY COUNCIL MEMBER FROM WARD 3. Mr. Peel was given the Oath of Office by the City Attorney and seated as the Councilman for Ward 3. Spencer as Mayor for one year term of office to expire May 1, 1985, as set forth in the City Charter of the City of Owasso, Article 2, Sec. 2-2. AYE: Messrs. Smalley, Stockler, Peel; Mrs. Webb iVAY : None ABSTAIN: Mr. Spencer Motion carried. ITEM 8: ELECTION OF VICE-MAYOR Motion was made by James Smalley, seconded by Von Stockler, to elect Wauhilleau Webb as Vice-Mayor for one year term of office to expire May 1, 1985, as set forth in the City Charter of the City of Owasso, Article 2, Sec. 2-2. AYE: Messrs. Spencer, Stockler, Smalley, Peel NAY: None ABSTAIN: Mrs. Webb Motion carried. ITEM 9: BUSINESS A. CONSIDERATION OF WAIVER OF OCCUPATIONAL LICENSE FOR ROTARY CLUB SPONSORED CIRCUS. Motion was made by Von Stockler, seconded by Wauhilleau Webb, to approve the request for waiver of occupational license for Rotary Club sponsored circus. AYE: Messrs. Spencer, Stockler, Smalley, Peel; Mrs. Webb NAY: None Motion carried. B. RECOPdSIDERATION OF REQUEST TO VACATE A PORTION OF THE 17.5' UTILITY EASEMENT LOCATED ON A RESIDENTIAL LOT (LOT 20, Mr. DeLaFleur, attorney representing First Fidelity Savings and Loan Assn, introduced Mr. Buddy Lollar, Mr. Jeff Jenson and Mr. Sam Howard, all of First Fideli Savings & Loan and Mr. Wayne 05 OWASSO CIT-Y COUNCIL PAGE THREE MAY 1, 1984 Woodyard, attorney for Mr. Boyd Grindstaff, and Mr. Grindstaff. He stated that the matter was put on the agenda to get an actual determination, either favorable or unfavorable, from the Council. There was discussion, with Mr. DeLaFleur, Mr. Woodyard and Mr. Cates presenting argument to the Council. Motion was made to deny the request to vacate a portion of the 17.5' utility easement located at Lot 20, Block 5, El Rio Vista II. AYE: Messrs. Spencer, Peel, Smalley, Stockler; Mrs. Webb NAY: None Motion carried. C. CONSIDERATION OF AUTHORIZATION OF MAYOR TO EXECUTE ACCEPTANCE OF COr~IUNITY DEVELOPMENT BLOCK GRANT ADMINISTERED BY DEPT. OF ECONOMIC AND COMMUNITY AFFAIRS, STATE OF OKLAHOMA. Mr.. Andy Armstrong of INCOG discussed with the Council the revisions to the grant offer that had been suggested. He said he would draft a letter to Mr. Jim Miles of DECA outlining the proposed changes. Motion was made by James Smalley, seconded by Von Stockler, to authorize INCOG to revise the Community Development Block Grant offer letter and resubmit it to the Department of Economic and Community Affairs. AYE: Messrs. Spencer, Stockler, Smalley, Peel; Mrs.. Webb NAY: None Motion carried. D. CONSIDERATION OF APPROVAL OF 3.1 ACRES OF CS ZONING AT SOUTHWEST CORNER OF 60 ACRE TRACT AT A DEPTH OF 250 EAST FROM WEST PROPERTY LINE AND APPROVAL OF RS-3 ZONING ON BALANCE OF 60 ACRES. Carol Dickey, City Paanner stated that the Planning Commission recommended approval of the CS zoning after the 3.1 acres was relocated at the southwest corner of the tract to avoid strip zoning along 129th East Avenue. Motion was made by Von Stockler, seconded by James Smalley, to approve the CS zoning of 3.1 acres at the southwest corner of the 60 acre tract at a depth of 250' East from West property line and approval of RS-3 zoning on balance of 60 acres. AYE: Messrs. Spencer, Stockler, Peel, Smalley; Mrs. Webb NAY: None Motion carried. The 60 acre tract is located 1/8 mile north of NE/c of 76th St. N, and 129th E. Ave. e6 OWASSO CITY COUNCIL PAGE FOUR MAY 1, 19$4 E. CONSIDERATION OF APPROVAL OF PRELIMINARY/CONDITIONAL FINAL PLAT OF APPLETREE ACRES SUBJECT TO COMPLEfiION OF LISTED FOURTEE ITEMS. Carol Dickey stated that the Planning Commission recommended approval of the plat subject to the 14 Technical Advisory Committee conditions. Mr. Bob Pruitt of Al C. Young and Associates and Ms. Dickey discussed the layout of the plat with the Council and noted that most of the 14 conditions were minor. Motion was made by James Smalley, seconded by Von Stockier, to approve the preliminary/conditional final plat of Appletree Acres subject to completion of Technical Advisory Committee's fourteen conditions. AYE: Messrs. Spencer, Smalley, Peel, Stockier; Mrs. Webb NAY: None Motion carried. F. CONSIDERATION OF APPROVAL OF ONE 40' ACCESS FOR NEW LOT 67D AS SUBMIT-TED ~dITH 130 BETWEEN CENTERLINE OF 17th E. AVE. AND THE 0 ACCESS AND LIMITS-OF-NO ACCESS ALONG REMAINDER OF LOTS 67B AND D . Carol Dickey reviewed actions taken by the Planning Commission ands' the Board of Adjustment regarding this request, stating that the Planning Conunission had approved the amended lot split, the one additional 40' access onto 86th St. N, and the site plan. Mr. Jim Crosby of Poe and Associates and Ms. Dickey reviewed the site plan and discussed alternative locations for the 40' access. with the Council. Motion was made by Von Stockier, seconded by Robert Peel, to approve one 40' access for new Lot 67D with 130' between centerline of 117th E. Ave, and the 40' access and limits-of-no access along the remain- der of Lots 67B and D. AYE: Messrs. Peel, Stockier; Mrs. Webb NAY: Messrs. Spencer, Smalley Motion carried. G. CONSIDERATION OF APPOINTMENT OF NEW MEMBER TO BOARD OF ADJUST- MENT TO FILL UNEXPIRED TERM OF ROBBIE FICKLE. Mr. Smalley asked that Mr. Charles Adams be considered. Mrs. Webb asked that Mr. Kenneth Wood be considered. Mayor Spencer said .he would confirm that each of these gentlemen would be willing to serve and asked that this item be put on the May 15 agenda. OWASSO CITY COUNCIL PAGE FIVE MAY 1, 1984 ~] H. CONSIDERATION OF ACCEPTANCE OF BID ON WATER DISTRIBUTION SYSTEM, PROJECT ~~2310. Mr. Danny Bird of Al C. Young and Associates stated that the low bid of $696,000.00 presented by Bartlesville Dirt and Excavation had no errors. Motion was made by Von Stockler, seconded by Robert Peel, to accept the low bid of $696,000.00 presented by Bartlesville Dirt and Excavation on the Water Distribution System, Project ~~2310. AYE: Messrs. Spencer, Stockler, Smalley, Peel; Mrs. Webb NAY: None Motion carried. I. CONSIDERATION OF ACCEPTANCE OF BID ON WATER STORAGE TANK PROJECT 2307. Mr. Bird stated that CTM, Inc, is the low bidder because of the 5% preference given to in-state bidders and that the bid of $374,6''35.00 has no errors. Motion was made by James Smalley, seconded by Von Stockler, to accept the low bid of $374,035.00 presented by CTM, Inc, on the Water Storage Tank, Project ~~2307. AYE: Messrs. Spencer, Stockler, Smalley, Peel; Mrs. Webb IJAY : None Motion carried. J. CONSIDERATION OF ACCEPTANCE OF BID ON WATER TRANSMISSION LINE PROJECT 230 . Mr. Bird stated that the base bid covers an additional mile of water transmission line. He said Bartlesville Dirt and Excavation submitted the low base bid and CTM, Inc, submitted the low alter- nate bid (without the additional mil-e of water transmission line). He said both bids contained no errors. Motion was made by James Smalley, seconded by Von Stockler, to accept the base bid of $648,512.00 submitted by Bartlesville Dirt and Excavation on the Water Transmission Line, Project ~k2308. CONSIDERATION OF ACCEPTANCE OF BID ON RANCH CREEK INTERCEPTOR SEWER, PROJECT ~ 309. T~2r. Bird stated that the low bid of $729,153.45 submitted by CTM, Inc, had no errors. Motion was made by Mayor- Spencer, seconded by James Smalley, to accept the low bid of $729,153.45 presented by CTM, Inc. on the Ranch Creek Interceptor Sewer, Project ~k2309. AYE: Messrs. Spencer, Peel, Stockler, Smalley; Mrs. Webb TJAY : None Motion carried. L. CONSIDERATION OF AUTHORIZATION TO INSTALL ONE OR TWO NEW CIVIL DEFENSE SIRENS IN AREAS DEFINED BY SURVEY. Motion was made by Mayor Spencer, seconded by James Smalley, to purchase one new siren and locate it at the end of 98th St. Tlorth in Meadowcrest Addition. AYE: T~Iessrs. CONSIDERATION OF DECLARATION OF ADDITIONAL AVAILABLE UNSERVICE- ABLE CITY PROPERTY AS OBSOLETE A D UTHORIZATION FOR AUCTIONING OF SAME. Motion was made by Wauhilleau Webb, seconded by Von Stockler, to authorize the City Manager to continue adding items to the list of unserviceable or obsolete items up to the time of the auction, with the exception of any items exceeding $500 in value. CONSIDERATION OF BALLOT TO BE CAST ON BEHALF OF CITY OF OWASSO FOR ELECTION OF THREE MEMBERS FROM FIELD OF CATIDIDATES TO BOARD OF TRUSTEES OF THE OML MUNICIPAL ASSURANCE GROUP. Motion was made by Mayor Spencer, sec onded by Robert Peel, .for the ballot to be cast on behalf of the city of Owasso for election of Mr. James Smalley, T~Zr. Arland Perkins and Mr. Bob Martin to the Board of Trustees of the OML Municipal Assurance Group. 69 OWASSO CITY COUNCIL PAGE SEVEN MAY 1, 1984 AYE: Messrs. Spencer-, Stockler, Smalley, Peel; Mrs. Webb NAY: None Motion carried. 0. CONSIDERATION OF AUTHORIZATION OF PURCHASE OF 16 HP MOWER FROM ALLOCATED REVENUE S RI FUNDS COUNCILWOMAN WEBB. Councilwoman Webb asked that this item be considered as the funds were approved for the purchase from Revenue Sharing and the initial bids were all rejected. The Council discussed the relative merits of different sized mowers and the possibility of having some of the mowing contracted out. Motion was made by Wauhilleau Webb, seconded by Mayor Spencer, to table the purchase of a 16 hp mower from Revenue Sharing pending study of proposals submitted for contracting out mowing work. AYE: Messrs. Spencer-, Peel, Smalley, Stockler; Mrs. Webb NAY: None Motion carried. P. CONSIDERATION OF AUTHORIZATION FOR MAYOR TO ENTER INTO MUTUAL AID AGREEMENTS WITH COMMUNITIES THAT BORDER OUR FENCE LINE. Motion was made by Mayor Spencer, seconded by Robert Peel, to authorize the Mayor to enter into mutual aid agreements with communities that border our fence line. AYE: Messrs. Spencer, Stockler, Peel, Smalley; Mrs. Webb NAY: None Motion carried. CONSIDERATION OF AUTHORIZATION TO ENCUMBER GENERAL FUND RESERVES IN THE AMOUNTS OF 5.0,0.00 OR POLICE STATION AND 5, OR IRE SUB-STATION. The Council discussed purchasing the old post office building for the police station and having a new fire sub-station built at the new water tower site. Motion was made by Robert Peel, seconded by Von Stockler, to authorize the encumbrance of General Fund reserves in the amounts of $150,000 for police station and $125,000 for fire sub-station. AYE: Messrs. Spencer, Peel, Smalley, Stockler; Mrs. Webb NAY: None ttiotion carried. COISIDERATION OF FIXING COMPENSATION FOR ALTERNATE JUDGE OF MUNICI AL COURT OF THE CITY OF OWASSO, OK., IN TERM5 OF AMOUNT AND SOURCE OF COMPENSATION. Motion was made by Von Stockler, seconded by Mayor Spencer,. that the City of Owasso will not offer compensation for payment of alternate judge and that payment of the alternate judge will- be the responsibility of the Judge of the Municipal Court of Owasso. CONSIDERATION OF APPROVAL OF PROPOSED PAY PLAN PROVIDED THE REVENUES PROJECTED FOR - 9 5 WILL SU PORT S ID PLAN. Mayor Spencer requested that this item be discussed in Executive Session at the May 15, 1984 meeting. AYE: Messrs. Spencer, Peel, Stockler, Smalley; Mrs. Webb NAY: None ' Motion carried. 10. REPORT FROM CITY ATTORNEY Due to the length of the meeting, the City Attorney postponed his report on his recent trip to the May 15.agenda. 11. REPORT- FROM CITY MANAGER Mr. Hynum said he had visited with people at the Department of Public Safety and the Tulsa Highway Patrol Division regarding feasibility of driver`s license testing in Owasso and he had been told that an effort would be made to have periodic testing held in Owasso. He asked that the Council meet with the department heads at the Community Center on Monday, May 7 and Tuesday, May 3 at 7:OO p.;m. to discuss the 1984-1985 budget. 12. NEW BUSINESS Mayor Spencer read a letter from INCOG regarding Tulsa Metropolitan Area Transportation System asking for information from elected officials regarding the most critical transportation problems facing our community in the next 10 years and ideas on how these problems might be solved. They asked for each person to develop their list of problem areas independently and gave details as to specific 71 OWASSO CITY COUNCIL PAGE T1INE MAY 1, 1984 information needed, including which major transportation facilites would be necessary to address the identified problems. Mayor Spencer asT;ed that this information be prepared and brought to him by Friday evening for him to take to a meeting on May 10.
