ITEM l: CALL TO ORDER The meeting was called to order at 7:03 p.m, with Mayor Spencer presiding. ITEM 2: FLAG SALUTE Flag salute was led by Mayor Spencer. ITEM 3: ROLL CALL PRESENT: Boyd M. Spencer, Stockier, Smalley, Peel; Mrs. Webb NAY: None Motion carried. B. CONSIDERATION OF APPROVAL OF MINUTES OF SPECIAL MEETING OF MA.Y 2 2 , 19 84 . Motion was made by Wauhilleau Webb, Seconded by Von Stockier, to approve the minutes of May 22, 1984, by reference made a part hereof. AYE: Messrs. Spencer, Stockier, Smalley, Peel; Mrs. Webb NAY: None Motion carried. ITEM 5: BUSINESS: A. OPENING OF BIDS ON CIVIL DEFENSE SIREN The following bids were opened and read by Mayor Spencer: ~6 OWASSO CITY COUNCIL Storey Fire Safety Law Enforcement Equipment Co. CONSIDERATION OF ACCEPTANCE OF DEED OF DEDICATION FROM JERRY TERLINE AND GARY ADAMS OF A PORTION OF PROPERTY LYING WITH- JP.l,11V1V emu, ruwiv~nlr Gl NUK'l'H, KA.NGE 14 EAST OF THE INDIAN BASE AND MERIDIAN, UNDER T-HE TERMS THEREOF, AND AUTHORIZATION OF MAYOR TO APPROVE SAME ON BEHALF OF THE CITY. Motion was made by Wauhilleau Webb, seconded by Robert Peel, to accept the deed of dedication from Jerry Enterline and Gary Adams and authorize the Mayor to approve the same on behalf of the City. AYE: Messrs. Spencer, Stockler, Peel, Smalley; Mrs. Webb NAY: None Motion carried. When the documents were presented for signature, same changes had been made and the City Attorney asked for time to review them. At approximately 9:45 p.m., the City Attorney asked that the above motion be amended, as follows: Motion was made by Von Stockler, seconded by Mayor Spencer, to accept the Deed of Dedication as presented with language deletions relating to the building of a city street; authorize the Mayor to execute a letter of acceptance; and authorize the Mayor to execute a letter of committment to the construction of the street to city standards. DISCUSSION OF WATER LINE AND STREET PROBLEMS ON_NORTH D -.WOOD FROM TH fi0 12TH STREETS JOHN GROTH Mr. Groth spoke to the Council relating the history of water prob- lems on Dogwood Street and asked Council to replace the water lines in that area, bring the street up to city standards and do all work in accordance with city codes. ADDENDUM A. DISCUSSION AND COMPLETION OF DOGWOOD PROJECT en um filed in o ice o ity C er an poste on City Hall bulletin board at 2:00 p.m, on June 4, 1984 Mayor Spencer introduced Mr. Kendall Garrett of Bartlesville Dirt and Excavation who presented a proposal far replacement of water line and repair of street and curbing on North Dogwood fram 8th to 12th Streets. There was further discussion on specifics as to how the project should be handled. Mayor Spencer stated that Bartlesville Dir-t and Excavation had agreed to do the total project for a cost of $55,531.00. Mayor Spencer declared that an emergency situation exists for reasons of public health and asked that the competitive bidding requirement be waived and Bartlesville Dirt and Excav ation be hired to do the required work. The City Treasurer stated that there was money available to meet the expense. Motion was made by Wauhilleau Webb, seconded by Von Stockier, to declare an emergency, waive competitive bidding requirements and award the emergency work to Bartlesville Dirt and Excavation and require them to do whatever it takes to get the job done right. CONSIDERATION OF ACCEPTANCE OF RESIGNATION OF GEORGE PHILLIPS -FROM THE OWASSO PLANNING COMMISSION AND APPOINTMENT OF NEW MEMBER TO FILL HI5 UNEXPIRED TERM. Motion was made by Von Stockier, seconded by Robert Peel, to accept the resignation of George Phillips from the Owasso Planning Com- mission and commend him~for doing a good job. AYE: Messrs. CONSIDERATION OF REQUEST TO VACATE UTILITY EASEMENT ON LOT 45, BLOCK 3, HALE ACRE'S II ADDITION. Mr. David Martin, representative of the mortgage company presented the request and Council discussed the matter with him, the City Attorney and the City Planner, Carol Dickey. Motion was made by Von Stockier, seconded by Robert Peel, to vacate the portion of the utility easement as described in the correspondence of May 4, 1984, to the Owasso Planning Commission, on Lot 45, Block 3, Hale Acres II Addition. AYE: Messrs. Spencer, Stockier, Smalley, Peel; Mrs. Webb NAY: None Motion carried. F. CONSIDERATION OF REQUEST TO REZONE A TRACT FROM OM TO CS LOCATED AT 119 0 E. th ST. N. Passed to the June 19 agenda. G. CONSIDERATION OF REQUEST TO APPROVE A CONDITIONAL/FINAL LAT FOR ELM CREEK COMMERCIAL CORNER. 'lhe City Planner presented the proposed conditional/final plat and reviewed the conditions set forth by the Technical Advisory Com- mittee and the Planning Commission. Mr. Bob Pruitt representing Elm Creek, Inc. presented two drawings, one showing the Planning Commission's recommended changes and one showing the owner's suggested changes and discussed the proposals with the Council, the City Planner and PZr. D.M. Sokolosky. Motion was made by James Smalley, seconded by Van Stockier, to approve a conditional/final plat consisting of a combination of the left part of the Planning Commission map (Block Z) and the right part of the owner's map (Block 1). CONSIDERATION OF REQUEST TO ADOPT ORDINANCE ~~335, AN ZUNINU CODE. The City Planner and City Attorney reviewed additional changes recommended as a result of new state law to go into effect in October. They recommended these changes be included now rather than amending the code again in October. The City Planner stated that the newest zoning code draft received by the Council con- tained these changes. Motion was made by Robert Peel, seconded by Von Stockier, to adopt Ordinance ~~335, an Ordinance adopting by reference the amended Owasso Zoning Code. AYE: Messrs. CONSIDERATION OF APPROVAL OF ORDINANCE ~~335 EMERGENCY CLAUSE Motion was made by Mayor Spencer, seconded by Robert Peel, to adopt the emergency clause of Ordinance ~~335. AYE: Messrs. Mr. Smalley said that several businessmen had requested an appoint- ment be made from an area not already represented and he would like to suggest Mr. M. W. Eckel to replace Rick Mahar. Mayor Spencer stated that with the Council's approve, he wished to reappoint Mac Borgna and Charles Adams, and appoint M. W. Eckel. Roll call vote for ratification of appointments: AYE: Messrs. Mr. York and Mrs. Shafer in the audience voiced their disapproval of the suggested change. No action was taken on this item. L. CONSIDERATION OF AUTHORIZATION TO TRANSFER LINE ITEM ROPRIATIONS FOR DEPARTMENTAL BUDGETS LEE DAWSON Motion was made by Robert Peel, seconded by Von Stockier, to authorize the City Treasurer to transfer line item appropriations for departmental budgets. AYE: Messrs. Spencer, Stockier, Smalley, Peel. NAY: None Motion carried. M. Council recessed at 8:50 p.m, and reconvened at 9:20 p.rn. Motion was made by Robert Peel, seconded by Von Stockier, to approve the contract between the City of Owasso and the Fraternal Order of Police, Fiscal Year 1984-1985. AYE: Messrs. Spencer, Stockier, Smalley, Peel NAY: None Motion carried. 6. REPORT FROM COUNCILMAN PEEL REGARDING MEETING HELD BY CHAMBER COMMERCE MEMBERS ON MAY 2 198 . Mr. Peel said that he and Mr. Stockier had decided that as far as they could tell, they would be the only two people on the Council who would be attending, so they went down to the meeting. He said the meeting place was changed from the First Bank of Owasso to Fidelity Federal Savings and Loan and that there were about eight """ Chamber members present. He said the first item discussed was the businessmen's concern that our Mayor was getting rid of our City Managers. Mr. Peel said he told them that the City Managers got rid of themselves and that Mr. Stockier explained some of the 9? OWASSO CITY COUNCIL PAGE SEVEN JUNE 5, 1984 things that happened to some of the other City Managers. He said Tam Kimball then gave a talk about what he knew about the Mayor in his association with him. Mayor Spencer asked who had made the remarks about his getting rid of the City Managers. Mr. Peel said he didn't really know. Mr. Stockler said that two remarks were made. He said Mr. Vines said the City Council was controlled by five or six other people outside the City Council who were making all the decisions for them. He said Mr. Enzbrenner said that both of the previous City Managers had gone to him and told him the reason they were resigning was because of Mayor Spencer, his attitude toward them and that they couldn't get along with him. He said Mr. Enzbrenner asked why this was. Mr. Stockler said he and Mr. Kimball said it wasn't just Boyd (Mayor Spencer), but it was a lot of things and some of it was personal. Mr. Peel said it all boiled down to the City Managers bringing it all on themselves by their actions. Mr. Stockler said the men at the meeting brought up a lot of ideas that would be good for the City. Mr. Stockler said he figured there were more than seven businessmen in the City of Owasso. He said they brought up good ideas about choosing a new City Manager. He said that the City Council makes mistakes, but businessmen make mistakes in their business too. He said it was very difficult being a City Council- man, as you get paid such a big salary and you have to make a lot of decisions. Mr. Peel said some of the people at the meeting suggested that the Councilmembers should be paid $200 per month to make the job more lucrative for someone who would want to run for City Council. He said they didn't say where the City would get the $200 per month to pay them. Mr. Stockler said he suggested that the businessmen come to the Council meetings more often and take part in them instead of waiting until things happen. He said that if there was a personal conflict between the City management and the City Council, the Council is honorbound not to talk about what happened between them. He said he told the men at the meeting about all the good things that were going to happen in the next six to eight months, such as the sewer system, the newer- addition, all the water lines, the re- pair of the streets. He said he thought Owasso could function over a year and a half without a City Manager. He said a lot of people wouldn't buy that, but the City is functioning pretty good now. He said he wanted to comment on the work Lee Dawson has done. He said Lee has gotten more done in the last month than a lot of people got done in three years. He said he didn't apologize for that statement one bit. N1r. Peel said that another complaint they had at the meeting was on the line going up to 120th St. He said they were concerned because the City didn't have all the people signed off yet. He said he explained to them that the City was having the same prob- 1-ems they had and that they were trying to get the job done . He said outside of that, the rest of the meeting was really congenial. He said the businessmen said they would have a Chamber member at every City Council meeting. He said it was set up to where they 92 OWASSO CLTY COUNCIL PAGE EIGHT JUNE 5, 1984 were supposed to have been doing this, but they just got away from it. Mr. Stockier said he thought Council members should take part in the Chamber meetings too. He said he liked what Mr. Sokolosky had said earlier in the Council meeting .tonight about a Council member attending board meetings. Mayor Spencer said he would like to go back a little about this nailing him to the cross. Mr. Peel said that those were just the remarks that were made and he didn't think anyone on the Council felt that in any way. Mayor Spencer said he appreciated, that, but he did not think Mr, Enzbrenner had any right to say what he did and when a man gets up like that and makes a statement against one man, he is cutting the rug out from under you all. (Council) at the same time. He said he didn't think Frank Enz- brenner was qualified to make that statement. Mr. Peel said he and Mr. Stockier brought out what they knew about past City Managers and they didn't even state the reasons they left, that they just said they brought it on themselves. Mayor .Spencer said he was glad Mr, Peel said .that. He said that if the Council would have brought out why they left, it would have been a dif- ferent story. He said that everyone would have been patting them on the back. He said the Council was man enough to let them out so they could look good. He said that last week he had gotten a letter to verify a City Manager_ for a real job. He said he could have marked Excellent, Good and Poor and that on every one of the answers he marked Excellent. He said he didn't jerk the rug out from under him. Mr. Stockier said he thought the Chamber was going to take care of itself and handle it as a city body and that they had a lot of r-esponsibility and would take care of themselves. He said he believed the Chamber and the City Council could take care of themselves. He said that the City had grown and was no longer the end of the trail, but the middle of it. He said that every businessman in town is part of our trail and that they need to take part more in their government. Mr. Smalley said that most people don't realize that when a Council member comes to a meeting, he or she has received information on the meeting several days before the Council meeting and that he knows that it appears that sometimes when a motion is made, it's yes, yes, yes or no, no, no. He said that what people fail to understand is that a Councilperson usually has from Friday night to the meeting Tuesday night to make those decisions and to gather information. He said that if a C~ouncilpersori has questions to work out or problems to resol-ve, they get it worked out. He said a Councilperson can talk with another Councilperson one on one without jeopardizing the Open Meeting Law. He said that when a Council member comes to the meeting, generally, the gest of the motion is pretty well worked out and that it's either going to go or it's not. He said that sometimes the Council sits there and argues and disagrees and the Council is divided, which is the purpose of the fifth member, hopefully to carry that over. He said that from the comments he had heard, he thinks the public fails to understand that there's a lot of consideration that goes into it and that it 93 OWASSO CITY COUNCIL PAGE NINE JUNE 5, 1984 is difficult sometimes to make a decision on some of the matters that come before the Council, particularly when you find out the majority of your information that night from someone giving a presentation, as they had on some of the plats. He said that the Council doesn't always understand al-1 of the particulars until the meeting. He said that he knows it is easy to quarterback, to get into a small group and talk about things and make good decisions, as he does after football games. He said he does appreciate citi- zens who come to meetings and have an interest and that the Council should be there to answer their questions. He said that he thought it should be publicly and not privately in groups. He said that he felt the Council was here for- the citizens and that includes the business people as well as the citizens and not just one or two individuals. He said that if it appears that way, he would have to take objection to it because he doesn't think that's what the Council is here for. He said that he thinks the Council attempts to improve the City and make it a useful, workable place for all of the citizens. He said that he intends to live here and for his kids to grow up here and that he would like far them to have a goad community. He said that he disagreed with the May 29 meeting and did not go because it did violate the Open Meeting Act if more than two Councilmembers were Cher-e. He said that he did not like to meet with a small group if it's a gripe session. He said that if a citizen has some input, he should bring it in and let the Council hear it. He said that they may not give the answer the person is looking for, but at least they will sure discuss it and do the best they know. how, whether it's right or wrong. Mr. Peel said that he brought up at the meeting that if they wanted to have a meeting, they should contact the Mayor and set up a meeting by Open Meeting Law,;like a town meeting. He said when people see the Mayor going around town, they should be thankful he has the time to check on things. He said that the Mayor has operated on the Council just like the rest of the members and is not trying to take advantage of anyone on the Council or override anyone. He said that he was thankful the Mayor had the time and energy to keep it going. Mr. Stockier said that each Councilmember and each citizen of Owasso has the right to inquire about anything they think is wrong; that it is not necessary to get a badge to find out what's right or what's wrong. He said that everybody in the United States has the power to inquire about a thin, whether it's right or wrong. He said that he appreciated Mr. Smalley's comments; that Mr. Smalley had said what he couldn't say. Mr. Smalley said that the City had had a lot of City Managers go through and that each one of them had expertise in his awn field and that the entire Council and City management has to work in harmony. He said that they have to be going down the same path. He said that they don't always have to agree, but they have to come to a conclusion and it has to be in the right direction. He said that for the most part he felt they had always done that. He said that the city is growing tremendously and that they must look in the future at how they want the city to grow and that he hoped the Chamber as well as other citizens would have same input 94 OWASSO CITY COUNCIL PAGE TEN JUNE 5, 1984 into that. He said that he had heard from others and felt himself that there should be some change in the structure of our manage- ment. He said that one individual cannot run a growing city like Owasso; that it will take more than one person to get the job done adequatel-y. He said that he doesn't want our city pieced together, that he wants some coordination in our efforts. He said that re- gardless of why the City Managers have left, each one had his own reasons and he felt each one had expertise in his field. He said that he would not say that any one of them could not do a goad job. He said that some are right for some cities and some are right for others; but that they must work in harmony with the City Council.. He said that from that standpoint, that's what the Council is looking for; the right individual to fit into what the Council feels is the proper management for the City of Owasso. Mr. Loy Payne spoke as the official spokesman for the Chamber and said that the meeting that was called last week was not called to throw rocks at anyone, but as a Chamber meeting to learn how they could help the Council in impr-oving the city. He said that he thought everyone was working for the betterment and the growth of the City. He said that it was his opinion and he felt the opinion of the majority of the people her-e that we could not have five more sincere and honest Councilmen serving than we have right now. He said that the Chamber would like to say that the city .has had a lot of managers and if the Chamber can help by going through the appli- cations and researching their background in order to establish some kind of longivity with a manager to help the long term growth of the City of Owasso, that's what the Chamber wants. He said that in defense of Frank Enzbrenner, he heard Frank make the comment that he (Enzbrenner) had heard that from the past two city managers; he did not make an accusation in any form or fashion. Mayor Spencer said that he (Enzbrenner) didn't have to call a name. Mr. Payne said that to be honest, the question is asked, what is the problem? He said that it's not like we have our heads in the sand or are not being realistic. He said that what the Chamber wants to do is to help the Council go over applications and contact businessmen in other cities and find out what kind of man the applicant is, how long he was there, how did he get along, how did he work with the people. He said the Chamber wants to work together with the Council and start having joint meetings with the Council, Chamber, School Board and whoever and whatever to work for the improvement of the city. He said that he arrived late and did not hear all the comments, but he heard what Frank said and he said that he was just telling them what he heard. Mr. Payne said that he admires a man who speaks his piece and sits down and that Mr. Enzbrenner did not push it through as an accusation in any way. Mr. Payne said that the Chamber would like to extend an invitation to the Council to work together to find a City Manager and help the city grow and make it the number one city in the state. Mr. Lee Dawson said he had only been in the position for a week and a half and he hadn't ever done it before and had received a lot of help; that without this help from the Council, he would have been in a lot of trouble. He said the Council had not been making any ad- ministrative decisions, but were helping him when he had a question, and he appreciated it. He said that he didn't know what he would do without them. He said that the Council does a lot of work for 95 OWASSO CITY COUNCIL PAGE ELEVEN JUNE 5, 1984 the city and that we need to recognize it. Mrs. Phyllis Sokolosky spoke from the audience and stated that years ago she had served on the Chamber Board of Directors and that at that time a policy was adopted providing that each of the Chamber Board members would attend each of the Council meetings and School Board meetings and in turn would ask members of the Council and the School Board to attend Chamber meetings. She said that the policy was adopted not out of criticism, but because at some point in time, we all share the same problems of growth in helping our community. She said that it was carried out for quite a while, and as people got busy with other things, it wasn't carried out. She said she and Mr. Sokolosky were invited to the meeting, but did not attend, but as a private citizen and a member of the Chamber of Commerce, she would like to commend. the Council and say that she certainly appre- ciates their hard work. Mr. 5tockler said that there was no better positive man than Loy Payne and he has been a big influence on him.' Peggy Robinson of .the Owasso Reporter stated that she thought every- one would agree that there has been no stronger critic of this Council or any other Council than she has been. She said the only difference is that she has some place to put it, to tell the entire community. She said that she feels that everyone on the Council understood-that when they took the job, they are public officials and fair game for the press. She said that the business community in the town is not fair game for the press; however when they do something that other members find criticism with, including our newspaper, (which has been a member- of the Chamber for a long time; the publisher had at one time been the president of the Chamber of Commerce in Owasso) which was not invited to the meeting, she felt that any time they try to get together with the Council., it it should be through an open meeting or the Council shouldn't go. She said that she wanted the community to understand that the newspaper is not deliberately taking off on anybody', but would express an opinion when things are done that the newspaper does not think are handled in a proper way. She said that she tried to explain to every businessman involved that if they want to get together to have a meeting, that is their- prerogative; but when they try to involve the Council member-s, that is the paper's business and the public's business. She said she wanted to tell the Council she thought they were very wise in taking the Open Meeting Law seriously and that the businessmen would also be wise to take it seriously. Mayor Spencer said that when the a person violates it and is caught, it is one year in the calaboose. Mrs. Robinson said she didn't think a lot of people understood that is a criminal offense and that the law was not set up for the press, that it was set up for the public, and that the Council has a wise City Attorney sitting there telling them that. Mr. Smalley said that Peggy was right, that the Council was open game for rack throwing; that when a Councilperson gets the job, that's part of the glary that goes with it. He said that he still doesn't understand why people accept these positions, but 96 OWASSO CITY'COE`NCIL PAGE TWELVE JUNE 5, 1984 one of these days he would figure it out. He said that Mrs. Robinson had made a lot of comments in the paper that he dis- agreed with because it affects him, not necessarily personally, but it does because it's part of the Council and part of the City. He said that he hoped that comments Mrs. Robinson had made to the businessmen can be looked at from the same standpoint and back up and and evaluate it and take it and move on with it and not throw those rocks back. He said that this thing could rock back and forth forever and something big could be made out of nothing and Channel 2 or Channel 8 would love to see something like that. He said that in his opinion, the community was a little above that, that he did not intend to get down to that level and he would like everyone to work together. He said that he appre- ciated Mrs, Robinson's conunents, although he did not always agree. Mr. Payne said that he thought that was what everyone wants. He said that if the meeting was illegal, it was not intentionally called to be illegal. It was called to find out what they could do to help the city. Mayor Spencer asked the City Attorney if the Chamber of Commerce was subject to the Open Meeting Law. REPORT FROM CITY ATTORNEY Mr. Cates asked to return to Item 5-B (_5ee Item 5-B) Mr. Cates stated that at the last Council meeting he was instructed to follow up on the matter of Mr. Sokolosky's road. He said that nothing had been settled, but headway was being made. He said that he hoped to have a meeting on June 9 with Mr. Sokolosky, Mr. Robertson, Mr. Butterfield, the City Treasurer and himself and would report on the results. 8. REPORT FROM ACTING CITY MANAGER Mr. Dawson reported that the auction brought in $4,000. He said that the pool bath-house repair total cast was $1,800. He said that the area can not be properly drained. He said that the garage area cleanup has begun and that the trucks are being put in the garage and locked up at night. He said that he is proceed- ing with plans to repair the sidewalk ramp on the west side of City Hall. He said that he had received several proposals from health insurance companies and will have a recommendation at the next meeting. Mayor Spencer read a letter of thanks from the Meadowcrest Associ- ation for the repair of their streets. 97 OWASSO CITY COUNCIL PAGE THIRTEEN JUNE 5, 1984 9. NEW BUSINESS Mr. Jerry Cole asked to speak regar--ding the Sooner Mobile Home Park's project. He asked if areas outside the city limits were allowed to tap on to city sewers. The Mayor said they could with Council's approval. Mr. Cole asked if there were areas outside the city limits now that are hooked on to the sewer. Mayor Spencer said there were not. The City Attorney said this matter should probably be discussed in the O.P.W.A, meeting. Mr. Cole said he was asking these questions because he was concerned that the County Health Dept. would request that the City of Owasso allow Mr. York to tap onto your sewer- lines and he would like the Council to consider the problems this would cause in that area.
