HomeMy WebLinkAbout1984.11.20_City Council Minutes153 On Tuesday, November 20,.1984, the Owasso City Council met in a regular session in the Council Chambers at City Hall per the Notice of Public Hearing and Agenda posted on City Hall bulletin board at 4:00 p.m, on November 16, 1984. ITEM l: CALL TO ORDER The meeting was called to order at 7:00 p.m, with Mayor Spencer presiding. ITEM 2: FLAG SALUTE Flag salute was led by Mayor Spencer ITEM 3: ROLL CALL PRESETIT: Boyd M. Spencer, Mayor Robert Peel, Councilman James Smalley, Councilman Dan Galloway, City Manager Ron Cates, City Attorney Ann Hendrickson, City Clerk ABSENT: Wauhilleau Webb, Vice-Mayor Von Stockler, Councilman ITEM 4: COr1SIDERATI0T1 OF APPROVAL OF MINUTES OF NOVEMBER 6, 1984 COUNCIL MEETING. Motion was made by James Smalley, seconded by Robert Peel, to approve the minutes of November 6, 1984, by reference made a part hereof. AYL: Messrs. Spencer, Smalley, Peel NAY: None Motion carried. ITEM 5: BUSINESS A. COi~TSIDERATI0T3 OF REQUEST TO WAIVE FEES AND LICENSES FOR THOSE PARTICIP TING IT1 TRAIL DAY5, APRIL ~~, ~~, ~. 1 There was no one present representing the Trail Days event. Motion was made by James Smalley, seconded by Robert feel, to deny the request to waive fees and licenses for participants in Trail Days, April 11, 12, 13, 1985. AYE:. Messrs. Physio-Control Corp. ~ Unit - $2,845.00 Arlington, Texas Accessories - $ 195.00 ~3,~.~0 Motion was made by Robert Peel, seconded by Mayor Spencer, to authorize the City Manager to review the bid and to accept it if it meets .the specifications required. CONSIDERATION OF AGREEMENT TO EXCHANGE THE SOUTH 100 FEET OF LOT 1:, BLOCK 1 OWASSO BUSii~TESS PARK TO WILLIAT~2S IN EXCHANGE FOR LOT BLOCK 1, OWASSO BUST1ESS PARK. Motion was made by Robert Peel, seconded by James. Smalley, to agree to exchange the south 100 feet of Lot 1, Block 1, Owasso Business Park to Williams in exchange for Lot 2, Block 1, Owasso Business Park. AYE: Messrs. Spencer, Smalley, Peel NAY: None Motion carried. D. CONSIDERATION OF WAIVER OF OWASSO BUSINESS LICENSE FEE FOR CHURCH THRIFT STO . Council discussed with the City Clerk and City Attorney tiie nature of this non-profit business. and the relevant section of the City Code. Motion was made by Mayor Spencer, seconded by Robert Peel, to waive the business license fee requested by the church thrift store. AYE: Messrs. Spencer, Smalley, Peel NAY : iJone Motion carried. E. CONSIDERATION OF ACCEPTANCE OF DEDICATION TO THE CITY OF OWASSO ~°° OF THE SERVICE ROAD NORTHEAST OF THE INTERSECTION OF 86th ST. . AND HIGHWAY FROM D. M. SOKOLOSKY. 155 OWASSO CITY COUPdCIL PAGE THREE NOV. 20, 1984 Council discussed with the City Attorney and City Manager the two easements presented for signature of D.M, and Phyllis J. Sokolosky and for approval by the Council. Motion was made by Mayor Spencer, seconded by Robert Peel, to accept Easement ~~2 subject to the discussed change in term of years, reduc- tion of right-of-way and execution by D.M, and Phyllis J. Sokolosky. AYE: Messrs. Spencer, Smalley, Peel NAY: None Motion carried. Motion was made by James Smalley, seconded by Robert Peel, to accept Easement ~~1 as executed by D.M, and Phyllis J, Sokolosky. AYE: Messrs. Spencer, Smalley, Peel NAY: None Motion carried. F. CONSIDERATIOi~T OF APPOINTMENT TO OWASSO PLANNING COMMISSION TO FILL VACANCY LEFT BY PAT LARKIN. Mayor Spencer stated that with Council's approval, he wished to appoint Barbara Buffington to fill the vacancy left by Pat Larkin. Motion was made by James Smalley, seconded by Robert Peel, to approve the appointment of Barbara Buffington to fill the vacancy left by Pat Larkin on the Owasso Planning Commission. AYE: Messrs. Spencer, Smalley, Peel NAY: None Motion carried. G. CONSIDERATION OF REQUEST FOR COMPETITIVE BID PUBLICATION FOR REMOVAL OF THREE PEDESTRIAIJ BRIDGES Afi RP;YOLA PARK AIQD IiJSTAL- LATION OF TW0 REPLAC MENT BRIDGES. The City Manager discussed with the Council the kind of bid speci- fications that would be required of the bidders. Motion was made by Mayor Spencer, seconded by Robert Peel, to autho- rize the City Manager to advertise for bids on the removal of three pedestrian bridges at Rayola Park and installation of two replacement bridges. CONSIDERATION OF EXTENSION OF APPOINTMENT OF VICKI McHENRY AS DEPUTY COURT CLERK T DECEMBER City Clerk asked that the date of the appointment be extended to January 15, 1985. ' Motion was made by James Smalley, seconded by Robert Peel, to extend the appointment of Vicki McHenry as Deputy Court Clerk to January 15, 1985. AYE: Messrs. Spencer, Smalley, Peel NAY: None Motion carried. I. C0IQSIDERATION OF APPOINTMENT OF FAME SMITIi AS DEPUTY COURT CLERK TO JUNE 3 5. Motion was. made by Mayor Spencer, seconded by James Smalley, to appoint Faye Smith. as Deputy Court Clerk to June 30, 1985. AYE: Messrs. Spencer, Smalley, Peel NAY: None Motion carried. J. REQUEST FOR EXECUTIVE SESSION: LITIGATION - C01ySIDERATION O_F LIT~GAT301~ BY BEN F. HYNUM. This item was passed temporarily. 6. REPORT FROM CITY ATTORNEY Mr. Cates reported that in York vs. City of Owasso, there was a dismissal without prejudice filed against the City of Owasso and indicated that the case would probably be refiled against the Owasso Public Works Authority. 7. REPORT FROM CITY MANAGER Mr. Galloway reported that the City had acquired two used U.S. Post Office vehicles for use by the meter readers and they seem to be working out very well. 8. APPROVAL OF CLAIMS ...~., Motion was made by Robert Peel, seconded by James Smalley, to approve the General Fund in the total amount of $104,233.55 and Street and Alley Fund in the amount of $6,857.66. 157 OWASSO CITY COUNCIL PAGE FIVE NOV. 20, 1984 AYE: Messrs. Spencer, Smalley, Peel NAY: None Motion carried. 9. NEW BUSINESS There was no new business brought before the Council. Mayor Spencer recessed the Council meeting at 7:36 p.m. Owasso City Council was reconvened at 8:10 p.m. J. REQUEST FOR EXECUTIVE SESSION: LITIGATION - CONSIDERATION OF LITIGATION) BY BEN F. HYNUM. Motion was made by Robert Peel, seconded by James Smalley, to recess into Executive Session. AYE: Messrs. Spencer, Smalley, Peel NAY: None Motion carried. Meeting recessed at 8:11 p.m, and reconvened at 8:32 p.m. Motion was made by James Smalley, seconded by Mayor Spencer, to instruct the City Attorney that in regard to Tir. Hynum, the Council determines as unacceptable any offer of settlement requiring rein- statement and/or monetary payment by the City and authorize the City Attorney to reject such without bringing it to the Council again.
