the Council Chambers at City Hall per the Notice of Public Hearing and Agenda
posted on City Hall bulletin board at 4:00 p.m. on August 16, 1985, and Addendum
to Agenda posted on City Hall bulletin board at 9:00 a.m. on August 19, 1985.
ITEM l: CALL TO ORDER
The meeting was called to order at 7:00 p.m. with Mayor Spencer presiding.
ITEM 2: FLAG SALUTE
The flag salute was led by Mayor Spencer.
ITEM 3: ROLL CALL

ITEM 22: (Adendum) COMMENTS FROM MAYOR REGARDING CITY GOVERNMENT AND VOTE
OF CONFIDENCE.
Mayor Spencer stated that the Council had been working hard and working together
in the past year. He stated that the City Manager had stood beside the Council
and had done all the Council had asked of him and had done it in top form. He
said the Council was working together, not against each other, and that though
some people might think the Council is split or should be doing things in a
different way, he did not see it that way.
Mayor Spencer asked for a roll call vote of confidence in the City Manager and
City government.

ITEM 4: CONSIDERATION OF APPROVAL OF MINUTES OF AUGUST 6, 1985 COUNCIL MEETING.
Motion was made by James Smalley, seconded by Von Stockler, to approve the
minutes of August 6, 1985, by reference made a part hereof.

ITEM 4a: CONSIDERATION OF APPROVAL OF MINUTES OF AUGUST 13, 1985, SPECIAL
COUNCIL MEETING.
Motion was made by Von Stockler, seconded by James Smalley, to approve the
minutes of August 13, 1985, by reference made apart hereof.

ITEM 5: CONSIDERATION OF APPROVAL OR REJECTION OF BIDS PRESENTED FOR
TELEPHONE SYSTEM FOR CITY HALL.
Mr. Galloway reviewed the bids which were publicly opened and read at 2:00 p.m. "`"~
on August 14, 1885.
Mr. Galloway stated that after the bids were opened, Sothwestern Bell had talked
with him about a different type of telephone service that might be to the City's
advantage .
Motion was made by James Smalley, seconded by Mayor Spencer, to continue Item
5 to the September 3, 1985, Council meeting.

ITEM 6: CONSIDERATION OF APPROVAL OF THE PRELIMINARY/CONDITIONAL FINAL PLAT
OF APPLETREE, LOCATED SOUTH OF THE INTERSECTION OF 11 th ST. N. &
lOgTH E. AVE.
Mr. Galloway stated that the Appletree subdivision would require 23 sewer taps
and that as of this date there were 25 prepaid taps available. This would leave
2 prepaid and 4 unpaid sewer taps still available in the H. D. Hale sewer tap
agreement.
Motion was made by Von Stockler, seconded by James Smalley to approve the
preliminary/conditional final plat of Appletree subdivision.

ITEM 7: CONSIDERATION OF REQUEST BY TEXACO, fiNC. TO GRANT EXCEPTION TO
ORDINANCE #30g REGARDING SIGN HEIGHT AND AREA.
Mr. Bob Berkman spoke to the Council, representing Texaco, Inc.
Motion was made by Mayor Spencer, seconded by Von Stockler, to grant the
exception to Ordinance #30g requested by Texaco, Inc., to erect a sign
60 feet high and 16' x 161 in area.

ITEM 8: CONSIDERATION OF PLANNING COMMISSION RECOMMENDATION REGARDING A
REQUEST FOR A CHANGE OF ACCESS AS SHOWN ON THE RECORDED PLAT OF
LC7I' 2, BLOCK 1, CLARK PLAZA ADDITION LOCATED NORTH OF th ST. N.
BETWEEN 117tH E. AVE. & 120th E. AVE.
Mr. John Harbin and Mr. Jerry Watts spoke to the Council representing Taco Bueno.
Motion was made by James Smalley, seconded by Kenneth Wood, to approve the
change of access as presented on the recorded plat of Lot 2, Block 1, Clark
Plaza Addition.

ITEM 9: CONSIDERATION OF ADOPTION OF ORDINANCE #342 AMENDING
SECTION 1013.4 OF CHAPTER 10 OF THE OWASSO ZONING CODE
ORDINANCE #335, ADOPTED THE 5TH DAY OF JUNE, 19 ,
PROVIDING FOR PARKING REQUIREMENTS, REPEALING PORTIONS
INCONSISTENT THEREWITH. AND DECLARING AN EMERGENCY.
Motion was made by Von Stockler, seconded by Kenneth Wood, to
adopt Ordinance #342.

ITEM 10: CONSIDERATION OF ADOPTION OF EMERGENCY PROVISION ON
ORDINANCE # 342..
Motion was made by Von Stockler, seconded by Mayor Spencer, to
adopt the emergency provision on Ordinance #342.

ITEM 11. CONSIDERATION OF REQUEST TO ABANDON PUD-5/FIRST BANK OF
OWASSO. PROPERTY LOCATED SOUTH OF th ST. N. BETWEEN
123RD & 125TH E. AVE.
City Planner, Jim Dunlap, reviewed the Planning Commission recommen-
dations. Al Anderson spoke to Council on behalf of First Bank of Owasso.
Motion was made by Mayor Spencer, seconded by Jim Smalley, to approve
the request to abandon PUD5 on property located south of 86th St. N.
between 123rd & 125th E. Ave.

ITEM 12: OZ-72 FIRST BANK OF OWASSO - CONSIDERATION OF REQUEST OF

Motion was made by James Smalley, seconded by Von Stockler, to
approve the request of First Bank of Owasso rezone Lot 1, Block 2
Elm Creek Condominiums to RM-l.

ITEM 13: ELM CREEK CONDOMINIUMS AMENDED - CONSIDERATION OF REQUEST
FOR APPROVAL OF PRELIMINARY/CONDITIONAL FINAL PLAT LOCATED
SOUTH OF th ST. NORTH BETWEEN 123RD AND 125TH E. AVE.
Motion was made by Von Stockier, seconded by James Smalley, to
approve the preliminary/conditional final plat of Elm Creek Condo-
miniums Amended.

Motion carried.
Mayor Spencer announced that there were several special visitors
in the audience. Boy Scouts from Troop g3 in Owasso, Jimmy Kemp,
Rick Hudson, Mike Germany, Tony Evans and Brian Butler, and their
leaders, Scott Butler and Bob Germany were in attendance and were
introduced.

ITEM 14: EL RIO VISTA. CONSIDERATION OF REQUEST TO VACATE A PORTION
OF A UTILITY EASEMENT LOCATED ON A RESIDENTIAL LOT -
LOT BLOCK 3, EL RIO VISTA.
Motion was made by James Smalley, seconded by Von Stockier, to
approve the request to vacate a portion of a utility easement
on Lot 4, Block 3, El Rio Vista.

ITEM 15: CONSIDERATION OF AUTHORI'ZAThON FCR CITY ATTORNEY' TQ FhLE
Motion was made by James Smalley, seconded by Von Stockier, to
authorize City Attorney to file an entry of appearance and disclaimer
in the matter of Eddie Proctor.

ITEM 16: CONSIDERATION OF APPROVAL OF SECOND LOWEST BID PRESENTED
FOR CDBG REHABILITATION AT 2 N. ATLANTA TO JIM BROCKER
IN THE AMOUNT OF ,300.
Mr. Galloway stated that Don Snodgrass, the original low bidder,
did not wish to post a 15% retainer on the bid and so declined the
award.
Motion was made by Mayor Spencer, seconded by Von Stockler, to
approve acceptance of the second lowest bid submitted by Jim Brocker
in the amount of $8,300.

ITEM 17: REPORT FROM CITY ATTORNEY
None at this time.
ITEM 18: REPORT FROM CITY MANAGER
None at this time.
ITEM 19: APPROVAL OF CLAIMS
Motion was made by James Smalley, seconded by Von Stockler, to
approve the claims submitted in the total amounts of $37,773.23,
$1,308.02, $189,627.86, $6,164.68, and $6,755.20.

ITEM 20: NEW BUSINESS
Mr. Galloway stated that an item had come up earlier this day,
too late to put on the agenda on which action needs to be taken.
He asked that the Council consider approval of a change order
in the D. R. Crane CDBG water & drainage contract. Janet Atkinson,
engineer on the project outlined the changes, a decrease in water
line on Cedar Street, south of 4th Ave. South resulting in a decrease
in contract price of $27,127.50 and an increase in storm sewer line
on 3rd Avenue, in the amount of $24,523.75 for a net decrease in the
contract price of $2,603.75.
Motion was made by Mayor Spencer, seconded by James Smalley, to
approve the proposed change order in the D. R. Crane CDBG water
and drainage contract #2335.

Mayor Spencer recessed the Owasso City Council meeting ab 8:24 pm
and reconvened at 8:38 pm.
ITEM 21: REQUEST FOR EXECUTIVE SESSION: LITIGATION - NAPANEE
COFFMAN, AS ADMINISTRATRIX OF THE ESTATE OF EMMETT
COFFMAN, AND NAPANEE COFFMAN, INDIVIDUALLY VS. GERALD
SPARKS, THE CITY OF OWASSO, AND THE COUNTY OF TULSA.
The City Council did not recess into Executive Session. The City
Attorney asked that the Council authorize defense of the matter
and forwarding to OML-MAG.
Motion was made by Von Stockler, seconded by Mayor Spencer, to
authorize defense of the above styled case and referral of the
matter to Oklahoma Municipal League/Mutual Assurance Group.
