ITEM l: CALL TO ORDER The meeting vaas called to order at 7:00 p.m, with Mayor Spencer presiding. ITEM 2: FLAG SALUTE 1`he %lag salute was led by Mayor Spencer. ITEM 3: ROLL CALL PRESENT: Boyd M. Spencer, Mayor James Smalley, Vice-Mayor Von Stockler, Councilman Robert Peel, Councilman Dan Galloway, City Manager Ron Cates, City Attorney Jim Dunlap, Asst. City Mgr./City Planner Ann Hendrickson, City Clerk ABSENT: Rennetii Wood, Councilman ITEM 4: CONSIDERATION OF APPROVAL OF MINUTES OF SEPT. 17, 1985, COUNCIL MEETING. Motion was made by Robert Peel, seconded by Von Stockler, to app~o~~e the minutes of Sept. 17, 1985, by reference made a part hereof. AYE: Messrs. Spencer, Smalley, Stockler, Peel NAY: None Mot ion carr -± ed . ITEM 5: CONSIDERATION OF APPROVAL OF MINUTES OF SEPT. 2~, 1985, SPECIAL COUPdCTL MEETING. Motion was made by Mayor Spencer, seconded by Rober~~ Pool, to a~:t~rove the n~i_nutes of September 24, 1985, by reference made a part hereof. AYE: Messrs. Spencer, Stockler, Smalley, Peel NAY: None Motion carried. ITEM 6: CONSIDERATION OF APPROVAL OR REJECTION OF BIDS RECEIVED ON DECA HOUSING REHABILITATION PROJECTS AT 8 N. ATLANTA AND 216 W. 1ST ST. Motion was made by Von Stockler, seconded by Robert Peel, to accept the low bid of $7,990 submitted by Don Snodgrass for 8 N. Atlanta and the low bid of $6,900 submitted by Don Snodgrass for 216 West lst St . AYE: Messrs. Spencer, Stockler, Smalley, Peel NAY: None Motion carried. ITEM 7: CONSIDERATION OF REQUEST FOR APPROVAL OF PRELIMINARY/CON- DITIONAL/FINAL PLAT LOCATED 400 FEET TO THE EAST OF 76th ST. N. AND CEDAR (76 CENTER)/DUNLAP Messrs. Dale Williams, Rex Rouis, and Mark Thomas were present for discussion, as well as Fire Chief Bob Allen, and Fire Marshall Orville Lugo. Motion was made by Mayor Spencer, seconded by Robert Peel, to approve the conditional/final plat of 76 Center. There was further discussion. Motion was withdrawn. Motion was made by Mayor Spencer, seconded by Robert Peel, to send the request back to the Planning Commission for further review at their October 17 meeting. AYE: Messrs. (SEE NEW BUSINESS) ITEM 8: CONSIDERATION OF ADOPTION OF ORDINANCE #345 ACCEPTING, ADDING AND ANNEXING TO THE CITY OF OWASSO, OKLAHOMA, ADDITIONAL LANDS AND TERRITORY IN SECTION 32,TOWNSHIP 21 NORTH, RANGE 14 EAST, PROVIDING THAT FROM AND AFTER THE PASSAGE AND PUBLICATION OF THIS ORDINANCE ALL OF THE REAL PROPERTY WITHIN SAID TERRITORY HEREIN DESCRIBED SHALL BE A PART OF THE CITY OF OWASSO, OKLAHOMA, AND FURTHER DECLARING THAT ALL PERSONS RESIDING THEREIN SHALL BE SUBJECT TO THE JURISDICTIOhT, CONTROL,_LAWS AND. .ORDINANCES OF_TH_E_CITY OF OWASSO, OKLAHOMA, ESTABLISHING THE SAME AS PART OF WARD THREE OF SAID CITY, DIRECTING THE FILING OF THIS ORDINANCE. ITEM 9: CONSIDERATION OF APPROVAL OF PURCi-iASE OF SURETY BOND FOR DON BURKITT, CITY TREASURER, IN THE AMOUNT OF $5G,000. Spencer, Stockler, Smal_leyr, Peel NAY: None Motion carried. ITEM 10: CONSIDERATION OF APPOINTMENT OF COURT CLERK, SETTING C_OM- YENSATION CLASSIFICATION, AND BOND REQUIREMENT. Spencer, Stock]_er, Smalley, Peel NAY: None Motion carried. ITEM 11: CONSIDERATION OF RATIFICATION OF MAYORAL PROCLAMATION OF OCTOBER 7-12, 19u5, AS "READ-A-BOOK WEEK" IN 11^HE CITY OF OWASSO. Mayor Spencer read the proclamation aloud. Motion was made by James Smalley, seconded by Robert Peel, to ratify the mayoral proclamation as read. AYE: Messrs. ITEM 15: CONSIDERATION OF PROPOSED CONTRACT WITH DECA FOR A ~3V,VVU htCA1V'1' '1'U 1~1H1~r; 1MYKUVEMEN'1'S 'i'O THE NEW POLICE STATION. Motion was made by Von Stockler, seconded by Robert Peel, to enter into a contract with DECA for a $30,000 grant for improve- ments to the new police station. AYE: Messrs. Spencer, Stockler, Smalley, Peel NAY: None Motion carried. ITEM 16: CONSIDERATION OF ACCEPTANCE OF RESIGNATION OF ASSOCIATE JUDGE GARY McCURDY. Motion was made by Mayor Spencer, seconded by Von Stockler, to accept the resignation of Associate Judge Gary McCurdy. AYE: Messrs. Spencer, Stockler, Smalley, Peel NAY: None Motion carried. ITEM 17: CONSIDERATION OF REQUEST TO ADVERTISE FOR BIDS FOR ALL- WEATHER SURFACING OF ROAD IN NORTH SECTION OF CEMETARY. Motion was made by Mayor Spencer, seconded by Von Stockler, to deny the request to advertise for bids for all-weather surfacing of road in north section of cemetary. AYE: Messrs. Spencer, Stockler, Smalley, Peel NAY: None Motion carried. ITEM 18: CONSIDERATION OF PROPOSED PARKING REGULATION ON MAIN STREET BY CITIZEN JERRY COLE. Mr. Cole discussed with the Council the possibility of allowing parking on Main Street except during the hours of 7:00 a.m. to 9:00 a.m. and 3:00 p.m, to 5;00 p.m. Other options were discussed. Motion was made by Von Stockler, seconded by Robert Peel, to deny Mr. Cole's request. AYE: Messrs. Spencer, Stockler, Smalley, Peel NAY: None Motion carried. ITEM 19: REPORT FROM CITY ATTORNEY None. ITEM 20: REPORT FROM CITY MANAGER 1`ir. Gailosvay introduced Mr. Dan l:urlcitt, the nec,~ City Treasurer. Mr. Galloway reported that he had mot with Mr. Sweeney and l~:r. Souza regarding abatement of nuisances in their neighborhood. P~Ir. & Mrs. Sweeney and Mr. Souza ~•aar~ present and there was further discussion. Mr. Galloway received a round of applause upon the announcement that today is his ono year anniversary with the City. Item 21: NEW BUSINESS Mayor Spencer stated that rules of parking set up to make parking available to the senior citizens were not being followed. Mr. Galloway stated that beginning Oct. 4, 1985, all Ci-~y employees would be parking in a new area southeast of City Hall and that should make available adequate parking for senior citizens and those having business at City Hall. Mayor Spencer recessed the Council meeting at 8:18 p.m. Meeting reconvened at 8:33 p.m. ITEM 13: REQUEST FOR EXECU`T'IVE SESSION: POSSIBLE LEGAL ACTIOIv~ K~I~HKll11VCi llKAlNA(iL' ~A~DMBNTS ON DRAINAGE CHANNEL ON THE RAY BAILEY PROPERT`.[. ITEM 22: REQUEST FOR EXECUTIVE SESSION: POSSIBLE LITIGATION ;E- GARDING POLICE STATION REMODELING CONTRACT. Motion was made by Von Stockler, seconded by James Smalley, to consolidate items 13 and 22 and to recess into Executive Session. Meeting recessed at 8:34 p.m, and reconvened at 9:22 p.m. ITEM 13: Motion was made by James Smalley, seconded by Mayor Spencer that there be no legal ac-i.:ioIi on the drainage easement and that the City Manager be authorized to negotiate a change order with D. R. Crane to delete the trickle channel. AYE: Messrs. Spencer, Stockler, Smalley, Peel NAY: None Motion carried. ITEM 22: Motion was made by James Smalley, seconded by Mayor Spencer that the City Manager be authorized to negotiate a full settlement for all work done by Design III for the City of Owasso, avoiding legal action or litigation. AYE: Messrs. Spencer, Stockler, Smalley, Peel NAY: None Mot ion carried . ~~ T ~ ITEM 14: CONSIDERATION OF CHANGE ORDER WITH THE D. R. CRANE CONTRACT FOR THE DECA DRAINAGE AND WATER CONTRACTS. Action taken under Item 13. Mr. Jim Dunlap requested reconsideration of Item 7. He recommended that the conditional final plat be approved and that the site plan be sent back to the Planning Commission for further review. Motion was made by Mayor Spencer, seconded by James Smalley, to rescend the previous motion on item 7 and to move to approve the preliminary/conditional final plat on the 76 Center. AYE: Messrs. Spencer, Stockler, Smalley, Peel NAY: None. Motion carried. Motion was made by Mayor Spencer, seconded by Von Stockler, to send the site plan on 76 Center back to the Planning Commission for further review. AYE: Messrs.
