session in the Council Chambers at City Hall per the Notice of
Public Hearing and Agenda posted on City Ha11 bulletin board at
4:00 p.m. on July 30, 1982, and by reference is made a part hereof.
ITEM l: CALL TO ORDER
The meeting was called to order at 7:03 P.M. with Mayor Spencer
presiding.

ITEM 4: APPROVE MINUTES OF REGULAR SESSION OF OWASSO CITY COUNCIL
JULY 20. 1982.
Motion was made by Wauhilleau Webb, seconded by James Smalley, to
approve minutes of July 20, 1982, and by reference is made a part
hereof.
AYES: Messrs. Spencer and Smalley; Mrs. Webb
NAYS: None
ABSTAIN: Mrs. Gross
Motion Carried.
ITEM 5: BUSINESS
A. DEDICATION OF WATER AP1D SEWER LINES AND STREETS IN EL RIO
VISTA ADDITION.
Mr. Block reported that he had inspected the addition and found no
problems with water, sewer or streets. Quality of the work and
drawings pertaining thereto are very good and he recommended approval.
Motion was made by Mayor Spencer, seconded by Mr. Smalley, to
accept the dedication of the water and sewerlines and streets in
the El Rio Vista Addition.

B. APPROVAL OF BOND FOR CITY CLERK
Motion was made by Wauhilleau Webb, seconded by Mayor Spencer,
to approve the amended bond for City Clerk.

6. REZONING REQUESTS:
A. OZ-63 LARKIN BAILEY
CONSIDERATION OF AMENDMENT TO ORDINANCE N0. 314, AMENDING
ORDINANCE N0. 175 DUE TO SCRIBNER'S ERROR, DEALING WITH
ZONING APPLICATION OZ- 3.
Mr. Cates explained that this matter was brought before the Council
again as it was inadvertently not published within the ten day ~,
requirement by law. Therefore, it must again be approved by the
Council.
Motion was made by Mayor Spencer, seconded by Wauhilleau Webb to
approve the rezoning request OZ-63.

B. OZ-63 ELM CREEK, INC.
REQUEST OF ELM CREEK, INC. APPLICATION OZ-66, TO REZONE A
TRACT OF 10.9 AC OF LAND LYING GENERALLY SOUTH OF 8 th ST.
N. A 2 RD E. AVE. FROM RS- SINGLE FAMILY TO RD DUPLEX.
Carol Dickey, City Planner, described the location of the land in
question and reported that the Planning Commission voted 4-0-1
with Mr. Larkin abstaining to approve the zoning. If zoning and
PUD are approved, then the application would be subject to sub-
division platting also and the developer would be held responsible
to develop the property according to PUD requirements.
Mr. Block asked if there had been a study as to how this develop- ~~~~
ment would affect drainage in Elm Creek. Ms. .Dickey said no
additional study had been made, but improvements have been made
to the site and more will be made if necessary.

A motion was made by Wauhilleau Webb, seconded by James Smalley,
to approve the rezoning request OZ-63 and that an ordinance be
prepared to rezone the tract of 10.9 acres of land lying generally
south of 86th St. N. at 123rd E. Ave. from RS-3 Single Family to
RD Duplex.
AYE: Messrs. Spencer and Smalley; Mrs. Webb
NAY: None
ABSTAIN: Mrs. Gross

A PLANNED UNIT DEVELOPMENT ON A TRACT OF 10.9 ACRES OF LAND
LYING GENERALLY SOUTH OF 86TH STREET NORTH AT 123RD E. AVE.
FOR COrISTRUCTION OF DUPLEXES AND CONDOMINIUMS ON PROPERTY
UNDER APPLICATION FOR RD DUPLEX ZONING.
Carol Dickey reported that the Planning Commission had several
requirements on the above request and they had been agreed to by
the applicant.
The possibility of using about 16 feeder lines instead of 96 indi-
vidula taps was discussed. Mr. Block asked who would be respon-
sible for any problems occurring on the jointly used lines. The
developer said it would be handled by a homeowner's association
which is a requirement of FHA and VA. With regard to entrances
and exits, 123rd St. and 125th St., leading into private streets,
have been approved. There are no public streets within the deve-
lopment. The developer stated that 2.5 parking spaces per unit
will be provided whic'z does not include any parking on the streets.
Entrances have been approved for emergency use.

approve the request of_ Elm Creek, Inc., application PUD-5.

Carol Dickey stated that this application was first presented
to the Council in October, 1981, at the request of the developer,
having been denied by the Planning Commission. The Council
referred the matter back to the Planning Commission and City
Engineer for further study. On May 20, 1982, the Planning Commis-
sion denied the recommendation by a 5-0 vote. The request was
appealed to the City Council.
Mayor Spencer asked Mr. Kennedy, owner of the property, to present
his case. Mr. Kennedy stated that he had employed the firm of
Sisemore-Sack-Sisemore & Associates, Inc. to make designs for
widening the creek on the west side of the park, building a retain-
ing wall and a holding pond. The park will be landscaped. The
homes will be tied down and approved by an inspector.
Mr. Ted Sack of Sisemore-Sack-Sisemore presented drawings illustrating
the procedures they would use to make the park safe for mobile home
use. He stated that they are building to protect the area from back
water of Bird Creek as well as 100 Year Storm. He stated that the
plans are not detailed and that during normal construction of the
park, more detailed plans will have to be approved. He introduced
Mr. Mac McClure, engineer on the project.
Mr. Block stated that the designs seemed to be adequate in construe- ry
tion. He asked how much they were anticipating this project would
cost. Mr. McClure stated that Mr. Kennedy realized the project
would be in six figures. Mr. Block expressed doubt as to the ade-
quacy of the size of the detention basin.
Mr. Sack stated that the building of the Skiatook Lake might improve
the 100 Year Flood problem and could result in the safeguards for
the development being more stringent than necessary.
Mr. Block asked what provisions were being made for evacuating people
from the park. Mr. McClure showed a plan which had been reviewed by
the County Engineer to raise the access road with a ramp coming up
to it. A temporary berm would be built to the expressway for emer-
entrance or exit only. Mr. Block asked what kind of surface would be
put on the earthen berm. Mr. Sack said they had planned a sod sur-
face, but it could be graveled. Mr. Block expressed concern over
the usability of a sod berm in time of extreme rainfall even if the
people were walking out. Mr. Block asked if provisions were included
for auxiliary power for the pump. Mr. Sack said a deisel pump would
be used.
Mrs. Gross questioned whether the present underground utilities would
still be in good condition and noted that some of the pads would
orobably have to be repaired.
Susan Young, a member of the audience, stated that she had talked to
the Corp of Engineers and they had told her the Skiatook Lake would
reduce the flood elevation of the subject area less than 1/10 of a
foot. She asked if the Corp had been consulted and if the newest

flood plain maps had been seen by the developer. Mr. Sack stated
that the improvements had been. designed according to a report they
received from the Corp of Engineers.
Mr. Mansur stated that raising the elevation around the perimeter
of t'ne parrs to 5~'1' is the minimum acceptable. He said he felt
uneasy about the people down inside the park because even struc-
turally sound designs could fail. The area could experience a
flood greater than the 100 Year level. Exits must be available for
use at a moment's notice. He expressed concern about the integrity
of the wall ten years from now.
Mr. Larkin. stated that he believed all requirements of the City had
been met by the plans as presented. He said that Mr. Kennedy is
aware that the cost of the project might be betT,aeen $300,000 and
$700,000. The park would add 150 homes to Owasso's tax rolls.
95% of the taxes would go to Owasso schools.
Ms. Dickey stated that the council should keep in mind that the
application under consideration is a zoning application which con-
siders the appropriateness of this kind of land use at that location.
Safety of the citizens is the first concern. Other objections to
a change in zoning would be that the area would not be buffered
from other noneresidential type o~mers. There would be poor access.
The sewage treatment plant is quite near. It is not in accordance
with the overall planning for the cityT in which the area has been
designated as industrial or light industrial.
Mrs. Webb asked if people moving into the park would be made aware
of the potential problem of flooding. Mr. Sack said they would be
required to have Feder-al Flood Insurance.

deny the rezoning request of Lloyd Kennedy, OZ-61.

A. CITY ATTORNEY
Mr. Cates reported that with regard to the sewer problems of Conner
and McLaughlin, both insurers of the city, the present insurer and
the past, have been contacted and reports are starting to flow in.
Mr. Cates said that when he had assimilated and studied them, he
will be able to report more in depth.

8. REPORT FROM CITY MANAGER
A. BID OPENING PROCEDURES
Mr. Block stated that he would like to change the method of bid
opening so that bids would be opened only in public meeting.
Mayor Spencer said the Council meetings were the proper place to
open bids.
Motion was made by Wauhilleau Webb, seconded by James Smalley,
that from this day forward all bids be opened in regular, or
if needed, special meeting of the Owasso City Council.

9. NEW BUSINESS
Mr. Block reported that the ambulance engine was back in Medic I.
The engine that was being prepared to put in the old ambulance
has been modified to the extent that it cannot be used in any
vehicle the City has nor can it be converted back. Medic II has
a cracked block. Mr. Block suggested that the City advertise
for bids on the modified engine so that money from its sale could
be used to help defray the cost of the new engine for Medic II.
Mr. Block felt it would be possible to purchase an adequate engine
for less than $2,000. Mrs. Webb asked if bids that are not accept-
able can be rejected. Mayor Spencer said a stipulation would be
made that bids would start at a certain level..
Mr. Block reminded the Council of the Municipal League meeting in
Tulsa at the Excelsior Hotel, Sent. 15-17.
Registration forms for the National League of Cities Conference
were submitted for Mrs. Webb, Mr. Smalley, Mr. Stockler and Mayor
Spencer. Mrs. Gross suggested that the Council designate one
council member to attend the NLC meetings. She stated that she
will not attend the NLC meeting, but will attend the Municipal
League meeting since it was in Tulsa and only $75.
Mrs. Webb stated that it would be impossible for one person to
cover all the events at the NLC. Mr. Smalley said there are 5 or
6 meetings going on every hour. Mrs. Gross asked if tapes were
available of the meetings: Mayor Spencer said some tapes were
available for a few of the meetings. He further stated that he
felt that meetings such as the National League of Cities should
be attended by members of the council as it was beneficial to

the City and all Council. members were entitled to go. Mr. Smalley
stated that these trips were not particularly a "fun time", but
were business trips for the City. Mrs. Gross asked if there were
ever twa councilmembers attending the same meeting? Mr. Smalley
said sometimes there wer-e, but this was beneficial in that two
viewpoints and opinions on the subject matter would be available.
Mr. Smalley said he feels it is definitely beneficial to the City
far members to attend and gain knowledge in many aspects of pity
government.
Being no further business before the Owasso City Council, the chair
adjourned at 8:35 p.m.
