HomeMy WebLinkAbout1982.09.07_City Council MinutesOn Tuesday, September 7, 1982, the Owasso City Council met in regular session in the Council Chambers at City Hall per the Notice of Public Hearing and Agenda posted on City Hall bulletin board at 10:00 a.m. on September 3, 1982, and by reference is made a part hereof. ITEM 1: CALL TO ORDER The meeting was called to order at 7:02 p.m. with Mayor Spencer presiding. ITEM 2: FLAG SALUTE Flag salute was led by Mayor Spencer ITEM 3: ROLL CALL PRESENT: Boyd M. Spencer, Mayor Phyllis Gross, Councilwoman Von Stockler, Councilman Dale Block, City Manager Ron Cates, City Attorney Ann Hendrickson, City Clerk ABSENT: Wauhilleau Webb, Vice-Mayor James Smalley, Councilman ITEM 4: APPROVE MINUTES OF REGULAR SESSION OF OWASSO CITY COUNCIL AUGUST 17, 1982. Motion was made by Mayor Spencer, seconded by Phyllis Gross, to approve the minutes of August 17, 1982, and by reference is made a part hereof. AYE: Messrs. Spencer and Stockler; Mrs. Gross NAY: None Motion carried ITEM 5: BUSINESS A. STREET DEDICATION FOR ELM CREEK, INC. - ELM CREEK III Motion was made by Von Stockler, seconded by Mayor Spencer to approve the street dedication of Elm Creek III, Blocks 1 through 6. AYE: Messrs. Spencer and Stockler, Mrs. Gross NAY: None Motion carried. OWASSO CITY COUNCIL PAGE TWO SEPT. 7, 1982 B. A RESOLUTION AUTHORIZING THE OWASSO MUNICIPAL JUDGE AS SIGNATORY ON THE MUNICIPAL COURT FUND CHECKING ACCOUNT. Motion was made by Mayor Spencer, seconded by Von Stockler, to authorize the Owasso Municipal Judge as signatory on the Municipal Court Fund Checking Account. AYE: Messrs. Spencer and Stockler; Mrs. Gross NAY: None Motion carried. C. APPROVAL OF RESOLUTION ON OKLAHOMA MUNICIPAL RETIREMENT FUND. Motion was made by Mayor Spencer, seconded by Phyllis Gross, to approve a resolution approving Amendment Number 2 to the Oklahoma Municipal Retirement Fund Trust Indebture. AYE: Messrs. Spencer and Stockler; Mrs. Gross NAY: None Motion carried. D. REQUEST FOR WAVIER - NUISANCE ORDINANCE (BLASTING Applicant was not present. No action was taken. E. APPROVAL OF LABOR CONTRACT - OWASSO FIRE DEPARTMENT Mayor Spencer asked to have a meeting with the attorney responsible for drawing up the contract. Mr. Cates said the meeting should be in an executive session. Mr. Block agreed to arrange the meeting and the subject was tabled until October 19,1982 City Council meeting. F. LIBERTY BANKING CENTER - REQUEST FOR APPROVAL OF THE CONDITIONAL_ FINAL PLAT LOCATED ON TWO ACRES AT THE NORTHEAST CORNER OF 86TH ~TRFRT NnRTN ANn NT~NWAY lh9_ Carol Dickey reported that all Planning Commission requirements had been met and that a requested waiver of one requirement (a change of the 50' set back to 25') had been denied. Mr. Bill Lewis, rep- resenting Liberty Banking Center, again requested the 25' building set back on the west side of the site plan. Motion was made by Mayor Spencer, seconded by Phyllis Gross to approve the Conditional Final Plat of Liberty Banking Center with the require- ments set forth by the Planning Commission plus the approval by the Council of the 25' building set back on the west. AYES: Messrs. Spencer and Stockler; Mrs. Gross NAYS: None Motion carried. OWASSO CITY COUNCIL PAGE THREE SEPT. 7, 1982 6. REPORTS FROM OFFICERS & BOARDS A. CITY ATTORNEY - REQUEST FOR EXECUTIVE SESSION - RAY KENNEDY VS. CITY OF OWASSO and LARKIN BAILEY, ET. UX. VS. CITY OF OWASSO, OKLAHOMA, ET. AL. C-82-1952. Motion was made by Mayor Spencer, seconded by Von Stockler, for the City Council to go into Executive Session for the purpose of dis- cussion of the abovementioned law suits. AYE: Messrs. Spencer and Stockler; Mrs. Gross NAY: None Motion carried. The Owasso City Council was reconvened at 7:50 p.m. Motion was made by Phyllis Gross, seconded by Mayor Spencer, to authorize City Attorney, Ron Cates, to execute a disclaimer of interest on behalf of the City of Owasso in the District Court proceeding, C-82-1952, Larkin Bailey and Elsie S. Bailey, vs. City of Owasso. AYE: Messrs. Spencer and Stockler; Mrs. Gross NAY: None Motion carried. 7. REPORT FROM CITY MANAGER A. SIGN ORDINANCE Mr. Block asked the Council for advice concerning the enforce- ment of Ordinance ~~309. He stated that he believes the ordinance is very sophisticated and a good one for the future of Owasso. He said that there are a number. of violations, and that before he could ask new businesses to comply, either the ordinance should be amended or all offenders should be made to comply. The concensus voiced by members of the audience was that they would be willing to cooperate if the ordinance were applied equally to every offender in the city. The members of the Council agreed that the ordinance was a good one and for the good of the City's future, should be enforced. Mr. Spencer suggested that Mr. Cates review the ordinance with regard to enforcement. B. DESIGN STANDARDS - OFF-STREET PARKING - SEALED SURFACES Mr. Block stated that city regulations require that off-street parking areas shall be surfaced with a dust-free, all-weather material and shall be graded and drained so as to carry surface water to the nearest street or accessible storm sewer. He said that there are a number of businesses in non-compliance and recommended that a fair amount of time be given to these people to comply, ,possibly a year. OWASSO CITY COUNCIL PAGE FOUR SEPTEMBER 7, 1982 Mr. Cates stated that this might be an area of conflict with the Board of Adjustment. He said that after a business has been cited in violation of the ordinance, they have the right to appeal to the Board of Adjustment for a variance from that requirement. Mrs. Gross suggested that a letter be sent to the offenders warning them of a citation to be issued and informing them of their alter- natives. Mr. Cates said such a letter should be issued from the office of the City Manager. C. CONSIDERATION OF HANDICAP PARKING ORDINANCE Mr. Block stated that the City needs to consider an ordinance covering the needs of the handicapped people in our community and that he had given the Council information pertaining to the ordinance passed by the City of Tulsa in this regard. Mr. Cates stated that Tulsa's or- dinance did nat cover all that was possible under State law. He asked if the Council would like the ordinance patterned after the City of Tulsa or enlarging upon it within the limits allowed by State law. Mayor Spencer said he recommended using the State Law as a guideline. Mr. Wayne Vincent spoke to the Council of the problems of handicapped people and things to consider when drawing up an ordinance covering parking for handicapped people. 8.
