regular session in the Council Chambers at City Hall per the
Notice of Public Hearing and Agenda posted on City Hall bulletin
board at 3:00 p.m. Sept. 17, 1982 and by reference is made a
part hereof.
ITEM l: CALL TO ORDER
The meeting was called to order at 7:55 p.m. with Mayor Spencer
presiding.

ITEM 5: BUSINESS
A. RE UEST FOR USE OF OWASSO RECREATION CENTER
Mr. Block introduced applicants wishing to use the Owasso Recreation
Center for a gun show Saturday, December 11 and Sunday, December 12,
and referenced their letter outlining the requirements they would
fulfill and their request for a waiver of a peddler's license for
each exhibitor.
Mr. Spencer asked how many exhibitors were expected and what they
would be charged for space at the gun show. The fee stated was
$20 for approximately 70 dables. Payment to the City, the amount
of time the facility would be used and the possibility of serving
food were discussed.
Mr. Cates said he would like to examine the proposed liability

insurance and suggested that a "hold harmless and indemnification"
agreement be executed for the benefit of the city. He also ex-
plained that there is a provision in the City Code covering a
license fee on the sale of any pistol or revolver and requiring
a report of each sale to be filed with the Owasso Police Dept.
He stated that this provision could possibly be waived and
that possibly other compensation could be made. Mr. Gill said
that accounting for each gun sale would be extremely difficult
and that exhibitors would not want to take part in a gun show
in Owasso if there was such a requirement.
The request was passed until the October 5 Council meeting.
B. CONSIDERATION OF HEALTH INSURANCE POLICY
Mr. Block reported that our City insurance would increase by
approximately 28Q/a effective October 1, 1982. He suggested that
the City investigate the possibility of changing insurance
companies or modifying the present policy. The Council asked
Mr. Block to obtain proposals from several insurance companies
including Oklahoma Municipal League and to present the proposals
at the October 19 meeting.
C. REVIEW OF CONDITIONAL FINAL PLAT: ATCHISON, TOPEKA & SANTA
FE (NORTHWEST OF 76th ST. N0. AND THE A.T. & S.F. RAILROAD
The Planning Commission recommended approval subject to the
completion of several minor requirements. A representative of
Hammond Engineering asked that a 20' easement parallelling the
railroad on the Northeast side be removed. He said that all
utilities companies had been consulted and there was no objec-
tion.
Motion was made by Wauhilleau Webb, seconded by Von Stockler to
accept the conditional final plat on A.T. & S.F. includint the
removal of the 20' easement parallelling the railroad line on
the Northeast side.
AYE: Messrs. Spencer, Stockler, Smalley; Mrs. Webb

Motion carried.
D. REVIEW OF CONDITIONAL FINAL PLAT: ELM CREEK CONDOMINIUMS
SOUTH OF 86th ST. N0. AT 125TH E. AVE.
Motion was made to accept the conditional final plat of the Elm
Creek Condominiums by James Smalley, seconded by Wauhilleau Webb.

E. REVIEW OF CONDITIONAL FINAL PLAT: EL RIO VISTA II (NORTH-
WEST OF 96TH ST. N. AND GARNETT).
Passed to October 5 meeting at request of applicant.
6. REPORT FROM CITY ATTORNEY
Mr. Cates reported that after examination of Ordinance ~~309, he
had questions about Section 8, in that it makes a violation of
this ordinance a criminal offense. The State requires that a
criminal ordinance must be enacted by a council and be part of
the Code. Our Code does not make provision for this kind of
penalty. He advised the City not to enforce any penalties at
this time.
Mr. Cates also questioned the part of Section 3 covering liabil-
ity insurance and workman's compensation. He does not believe
this section is relevant to the .rest of the ordinance, partic-
ularly for those people only involved in maintenance of signs.
Mayor Spencer asked that Mr. Cates meet with the City Manager
to consider changes in the Ordinance.
7. REPORT FROM CITY MANAGER
A. Mr. Block reported that the Mayor had received information
about a federal program for which the City might qualify regard-
ing a bus transportation program.. It was found that while the City
might qualify, it would be low on the priority list. In exploring
other possibilities, MTTA was contacted and expressed an interest
in trying to furnish Owasso with a bus system. With an established
bus system, it might be possible to obtain a subsidy from a fed-
eral program to supplement the money received from the fare box
for support of the system. Mr. Block submitted a possible routing
covering morning and evening service to American Airlines, Rock-
well, and the airport area, with an intracity route during the
day so that maximum use of the bus could be achieved. MTTA would
be willing to have a six month trial bus service. The bus fare
would be set by the Council. MTTA stated that their reliability
factor would be a three minute variance on time of arrival at each
stop.
The Council asked Mr. Block to pursue the six month trial service.
Mr. Block presented a letter from John Scott, Owasso High School
Athletic Director, regarding their desire for a ten year lease
of the baseball park in exchange for all care and maintenance of
the park. Questions were raised as to the desirability of a lease
of that duration and possible conflict with the American Legion
Baseball Program and others wishing to use public property. The
Council asked Mr. Cates to draw up a lease of no more than a five
year period with renewal options.

8. APPROVAL OF CLAIMS
Motion was made by James Smalley, seconded by Mayor Spencer
approve the claims list as submitted, by reference made a part
hereof.

9. NEW BUSINESS
There was no new business.
With no further business before the Owasso City Council, chair
adjourned at 9:54 p.m.
