HomeMy WebLinkAbout1982.11.16_City Council MinutesOn Tuesday, November 16, 1982, the Owasso City Council met in regular session in the Council Chambers at City Hall per the Notice of Public Hearing and Agenda posted on City Hall bulletin board at 4:00 p.m. on November 12, 1982, and by reference is made a part hereof. ITEM l: CALL TO ORDER. The meeting was called to order at 7:05 p.m. with Mayor Spencer presiding. ITEM 2: ROLL CALL Flag salute was led by Mayor Spencer. ITEM 3: ROLL CALL. PRESENT: Boyd Spencer, Mayor Wauhilleau Webb, Vice Mayor James Smalley, Councilman Von Stockler, Councilman Ron Cates, City Attorney Dale Block, City Manager Ann Hendrickson, City Clerk ABSENT: Phyllis Gross, Councilwoman ITEM 4: APPROVAL OF MINUTES OF REGULAR SESSION OF OWASSO CITY COUNCIL, NOVEMBER 2, 1982. Motion was made by Wauhilleau Webb, seconded by Von Stockler, to approve the minutes of November 2, 1982. AYE: Messrs. Spencer, Smalley, Stockler; Mrs. Webb NAY : iQone Motion carried. ITEM 5: BUSINESS A. DISCUSSION OF PRIVATE CLUB ORDINAivCE T~Zr. Ted Hodge, owner of the Gazebo Restaurant and his attorney, Mr. Steve Burris appeared before the Council asking for clarifi- cation of the section of the city code pertaining to private clubs. Mr. Burris stated that the restaurant was not at this time allowing any children in the facility, but were having to turn away many families who wished to have dinner there because they had their children with them. Mr. Hodge explained that his restaurant is classified as an "11 to 11" operation (opening and closing hours), that they have beer on the premises and that people bring other alcoholic beverages to be served to them. He stated that his sales were running about 92% food, 8% beverage, which included all beverages sold. OWAS50 CITY COUNCIL PAGE TWO NOVEMBER 26, 1982 .~,,. Mr. Cates asked if they mentioned in their original application the desire to serve families. Mr. Burris said they did not as the application only pertained to obtaining a license to overate a private club and their intent was for everyone entering the premises to be a member. Mr. Cates suggested that they submit an amended application outlining their desire for guests to be allowed and under what conditions. Mr. Stockler stated that he did not like the idea of children of Owasso being in any place where people are drinking alcoholic beverages. Mayor Spencer expressed his concern about the law being strictly followed at all times in the establishment. B. REQUEST FOR REIMBURSEMENT ON SEWER DLu~IAGES/WILSON. Mr. Block reported that an Owasso residence had incurred sewer damage due to a sewer main backup. The insurance carrier declined coverage, saying that the City was not negligent. Mr. Block stated that even though the City was not negligent, he felt the City had a responsibility to the resident. Mr. Cates stated that he could not find in the insurance policy a specific reference to "Negligence". being a prerequisite to payment of a claim. He further stated that he believed the City would have a cause of action against the insurance company if they would not pay. ,_„ NIr. Smalley said that if the City is paying a premium for a policy that will not pay on situations like this, that the city should consider putting the money somewhere else. Mr. Block stated that the Wilsons are willing to give the city a release of responsibility for the amount of $760. ~,9.~'~Ji~` Motion was made by Von Stockler;~'seconded by Mayor Spencer that the City pay Mr. & Mrs. Melvin Sir $760 for sewer damage in exchange for a total and full release of all claims to the City and Owasso Public Works Authority. AYE: Messrs. Smalley, Stockler, Spencer; Mrs. Webb NAY: None Motion carried. C. REQUEST TO PURCHASE TWO POLICE UNITS FROM THE STATE CENTRAL PURCHASING. Mr. Block asked for approval to purchase two police units from the State Central Purchasing. He explained that there were funds in the 1982-83 budget set aside for this purchase, that the units would be a police-pursuit package and that delivery could be expected .. within 45 to 60 days. OWASSO CITY COUNCIL PAGE THREE NOV. 16, 1982 Motion was made by Wauhilleau Webb, seconded by James Smalley to purchase two 1982 police units for approximately $8,286 each through Oklahoma Central State Purchasing system. AYE: Messrs. Stockler, Spencer, Smalley; Mrs. Webb NAY: None Motion carried. 6. REQUEST FOR EXECUTIVE SESSION/CITY OFFICIALS Motion was made by Mayor Spencer, seconded by Von Stockler to adjourn the meeting for an executive session concerning personnel. AYE: Messrs. Spencer, Stockler, Smalley; Mrs. Webb NAY: None Motion carried. Meeting was adjourned at 8:12 p.m. and reconvened at 9:05 p.m. 7. REPORT FROM CITY ATTORNEY i~r. Cates reported that the city will be taken into District Court on the appeal from the Board of Adjustment denial of the Norton application for special variance. He has received the statutory notice acid is putting together the record. He will advise the Council in Executive Session at a ater date when all information is gathered. 8. REPORT FROM CIT-Y MANAGER A. REQUEST FOR CERTAIN REMODELING WORK IN CITY HALL. Mr. Block reviewed the areas in City Hall to be remodeled including the creation of a new lounge area in the basement in the northwest corner of the Civil Defense area with the present lounge area then being available for police personnel for interrogation and general office use. The West four feet of the City Manager's office would be partitioned off with access from the hall for much needed storage space. Also more space for storage would be created in the North stairwell. One wall in the City Clerk's office would be moved and a reception area would be made in the entryway. The anticipated cost of this remodeling work would be less than $1000. 9. APPROVAL OF CLAIr1S T~Zotion was made by Wauhilleau Webb, seconded by James Smalley to OWASSO CITY COUNCIL PAGE FOUR NOVEMBER 16, 1982 approve the General Fund claims for a total of $92,619.47, the Revenue Sharing claims of $1,352.43, and the City Garage claim of $7,367.99 for a grand total of $99,987.46. AYE: Messrs. Smalley, Spencer, Stockler; Mrs. Webb NAY: None i~iotion carried. 10. NEW BUSINESS There being no new business before the Owasso City Council, chair adjourned at 9:45 p.m. BOY M.
