HomeMy WebLinkAbout1982.12.21_City Council MinutesOn Tuesday, December 21, 1982, the Owasso Ctiy Council met in regular session in the Council Chambers at City Hall per the Notice of Public Hearing and Agenda posted on City Hall bulletin board at x:00 p.m. on December 1:7, 1982, and by reference is made a part hereof. ITEM l: CALL TO ORDER. The meeting was called to order at 7:00 p.m. with Mayor Spencer presiding. ITEM 2: FLAG SALUTE Flag salute was led by Mayor Spencer. ITEM 3: ROLL CALL PRESENT: Boyd Spencer, Mayor Wauhilleau Webb, Vice-Mayor Von Stockler, Councilman Dale Block, City Manager Ron Cates, City Attorney Ann Hendrickson, City Clerk ABSENT: Phyllis Gross, Councilwoman James Smalley, Councilman ITEM 4: !~YPROVAL OF MINUTES OF REGULAR SESSION OF OWASSO CITY COUNCIL, December 7, 19 2. Motion was made by Wauhilleau Webb, seconded by Mayor Spencer, to approve the minutes of December 7, 1982. AYE: Messrs. Stockler, Spencer; Mrs. Webb NAY: None Motion carried. ITEM 5: BUSINESS A. CONSIDERATION OF CITY MANAGER'S RECOMMENDATIONS__ON BIDS RECEIVED FOR FIRE TRUCK AND STORM WARNING SIRENS. Mr. Block stated that he examined the bids with the fire chief on the fire truck and with the director of civil defense for the sirens and that the city would recommend the low bids as also the best bids. The low bidder on the fire truck is Boardman of Oklahoma City at $57,825.00. The low bidder on .the siren is Goddard Enterprises with a low bid of $5,237.75 for hsirens installed. He said he was familiar with the bidders and that each bid met the City's speci- fications. Motion was made by Von Stockler, seconded by Wauhilleau Webb, to accept the recommendation of the City Manager on acceptance of the low bids for Boardman on the. fire truck and Goddard on the siren. Motion was made by Mayor Spencer, seconded by Von Stockler to enter into the fire run contract presented by Carolyn J. Wilson. AYE: Mr. Spencer, Mr. Stockler; Mrs. Webb NAY: None Motion carried. 5.C. OWASSO POST OFFICE ADDITION. REQUEST FOR APPROVAL OF THE PRELIMINARYjCONDITIONAL FINAL PLAT FOR A 1.46 ACRE TRACT LOCATED NORTHEAST OF 86TH ST. NORTH AT CEDAR. Carol Dickey explained that the plat was submitted as a preliminary and conditional/final plat because it is a very simple piece of property with no major problems. She said there were no utilities to add as they can hook up to existing utilities. With regard to the street to be built on the south side of the property, there was discussion as to whether the street should be private or dedi- cated to the city. Mr. Sokolosky said he could build it to city specifications and Mr. Block said if the standard were followed as set it would be acceptable to the City and that the City would work with Mr. Sokolosky to make the street acceptable for dedication. Motion was made by Wauhilleau Webb, seconded by Von Stockler to approve the preliminary/conditional final plat for the Owasso Post Office Addition. AYE: Mr. Spencer, Mr. Stockler; Mrs. Webb NAY: None Motion carried. S.D. PUD-6 RAMSHEAD CONDOMINIUMS. REQUEST FOR APPROVAL OF A PLANNED UNIT DEVELOPMENT FOR TOWNHOUSES ON A 6.92 ACRE TRACT ZONED RM- 2 LOCATED NORTH OF 83RD ST. NORTH AND 116th E. AVENUE. Ms. Dickey reported that the piece of property is presently zoned for RM-2 multi-family dwellings and that the developers have requested to come in with a planned unit development overlay. They would keep the ~,_~,, same zoning, using the same density they would be allowed under RM-2 and develope townhouses instead of apartments. They have proposed 80 individually owned townhouse homes. The Technical Advisory Com- mittee and Planning Commission have worked with the developers and find the plat acceptable as now presented. Mayor Spencer asked about parking and Ms. Dickey said there would be 3a spaces per unit plus OWASSO CITY COUNCIL PAGE THREE DECEMBER 21, 1982 visitor parking. Mr. Block said he asked the developer to let each owner know that even though the streets are private, they will be fire lanes and as such are for the conveyance of traffic only and no parking. A representative of the developer mentioned that the Planning Commission had received a petition signed by homeowners in the area expressing their approval of the use of the land. S.E.CONSIDERATION OF RECOMMENDATION OF CITY MANAGER ON COMPANY TO DO RECODIFICATION WORK ON CITY CODE. Mr. Block recommended the Oklahoma Municipal League to do the re- codification work on the basis of their quote and favorable comments from other cities. He suggested we try to get a representative to come to Owasso the day of the next council meeting and meet with him and the City Clerk and then attend the Council meeting that night. Mayor Spencer asked that the matter be put on the next agenda. S.F. CONSIDERATION OF APPROVAL OF ASSIGNMENT OF CONESTOGA CABLEVISION, INC.. TO TCI GROWTH.. INC. Mr. Cates reported that he had requested that before the City consent to an assignment an agreement should be prepared stating that Cones- toga realizes that there would be a dissolution of any obligations owed to Connestoga. He also requested a letter stating that TCI would assume and agree to faithfully abide by Ordinance 275 with the one exception as such relates to the pay cable tv rates. These stipulations have been met. Motion was made by Mayor Spencer, seconded by Von Stockler, to approve the assignment of Conestoga Cablevision, Inc. to TCI Growth, Inc. AYE: Mr. Stockler, Mr NAY: None Motion carried. Spencer; Mrs. Webb 6. REPORT FROM CITY ATTORNEY Mr. Cates read to the Council a letter from Mr. Levy replying to a letter he sent at Council's request regarding Lot 1, Block 1, Owasso Business Park. The letter stated that the North 40' of Lot 1, Block 1, had been sold to Mr. Dale Williams, and could not be included in the purchase as presented by Mr. Levy. Mr. Cates suggested four alternatives: (1) do nothing, (2) proceed OWASSO CITY COUNCIL PAGE FOUR DECEMBER 21, 1982 to enforce the option - such action being directed to the Doctors Family Medical Clinic, Inc., (3) buy 100 x 112.82 as presented at a reduced price (4) consider obtaining the South 40' of Lot 2 to replace the 40' sold to Mr. Williams. Mr. Spencer asked if Mr. Levy had the legal right to sell the 40' without a lot split. Mr. Cates said if Mr. Williams tried to sell the property, there would be a cloud on the title and he would have to come before the Plan- ning Commission and ask for a lot split. Mr. Block said it was his understanding that the City had been offered the North 40' of Block 2 as part of the lot split. Ms. Dickey stated that the matter could be cleared up by a lot split application splitting off the North 40' of Lot 1 and adding the North 40' of Lot 2. Mr. Spencer asked if Mr. Williams knows on the lot. Mr_. Cates suggested that a find out when the 40' was sold to Mr. W with him to discuss it. He has had no contact with Kraftours. A used sand spreader has been purchased for $500 with an extra $30 expended to put it in working order. This was a considerable savings as new spreaders cost at least $3,500. Mr. Block explained that there .was a strong suspicion of gasoline theft and he would like to move the gasoline tanks to the city garage area for better control and security. He also explained a new system for keeping track of usage. He asked if it would be possible to move a mobile home into that area so that one of the city employees could live there and serve as night watchman. This would be a deterrant to vandalism and misuse of our equipment as well as added security for our treatment facility. Mayor Spencer asked if there would also be some fencing put up around. the area and Mr. Block said he had plans for doing that. 8. APPROVAL OF CLAIMS Motion was made by Wauhilleau Webb, seconded by Von Stockler to approve the General Fund November claims in the amount of $118,405.20 and $7,004.07. AYE: Mr. Spencer, Mr. Stockler; Mrs. Webb NAY: None ~.~. Motion carried. NEW BUSINESS Dr. Clark brought up a problem concerning his mobile home park. The Mayor asked him to wait until the Owasso Public Works Authority was in session to have the discussion and Mrs. Webb suggested he speak with the City Attorney during the recess between meetings.
