HomeMy WebLinkAbout1983.05.03_City Council MinutesOn Tuesday, May 3, 1983, the Owasso City Council met in regular session in the Council Chambers at City Hall per the Notice of Public Hearing and Agenda posted on City Hall Bulletin Board at 4:00 p.m, on April 29, 1983, and by reference is made a part hereof. ITEM l: CALL TO ORDER The meeting was called to order at 7:02 p.m, with Mayor Spencer presiding. ITEM 2: FLAG SALUTE Flag salute was led by Mayor Spencer ITEM 3: SEATING AND SWEARING IN OF JAMES C. SMALLEY AS REELECTED CITY COUNCIL MEMBER FROM WARD 5. James Smalley was given the Oath of Office by the City Clerk and seated as the Councilman for Ward 5. ITEM 4: ROLL CALL PRESENT: Boyd Spencer, Mayor Wauhilleau Webb, Vice-Mayor Phyllis Gross, Councilwoman James Smalley, Councilman Von Stockler, Councilman Dale Block, City Manager Ron Cates, City Attorney Ann Hendrickson, City Clerk ABSETIT : None ITEM 5: ELECTION'OF MAYOR Motion was made by James Smalley, seconded by Wauhilleau Webb, to appoint Boyd Spencer as Mayor for one year term of office to expire May 1, 1984, as set forth in the City Charter of the City of Owasso, Article 2, Sec. 2-2. AYE: Messrs. Smalley, Stockler; Mrs. Webb NAY: None ABSTAIN: Mrs. Gross, Mr. Spencer Motion carried. 6. ELECTION OF VICE MAYOR Motion was made by Von Stockler, seconded by James Smalley, to appoint Wauhilleau Webb as Vice Mayor for a one year term of office to expire May 1, 1984, as set forth in the City Charter of the City of Owasso, Article 2, Sec. 2-2. APPROVAL OF MINUTES OF REGULAR SESSION OF OWASSO CITY COUNCIL, APRIL 19, 1983. Motion was made by James Smalley, seconded by Wauhilleau Webb, to approve the minutes of April 19, 1983, by reference made a part hereof. AYF: Messrs. Spencer, Stockler, Smalley; Mrs. Webb, Gross TJAY : None Motion carried. 8. BUSINESS: A. CONSIDERATION OF APPOINTMENT OF MUNICIPAL COURT JUDGE OR TWO YEAR TERM IN ACCORDANCE WITH SECTION 1 - OF THE OWASSO CITY CODE. Motion was made by Mayor Spencer, seconded by Von Stockler, to retain Judge Jerry Pickerill for a two year term as Municipal Court Judge in accordance with Section 12-8 of the Owasso City Code. AYE: Messrs. Spencer, Stockler, Smalley; Mesdames. Webb, Gross NAY: None Motion carried. The City Manager and City Clerk voiced their appreciation of the high quality of work done by Judge Pickerill and their pleasure in working with him., B. CONSIDERATION OF APPOINTMENT TO PERSONNEL BOARD Mayor Spencer announced that the term of Gary Pritchard had expired and that Mr. Pritchard had voiced his willingness to serve another term, riayor Spencer put forth his name in nomination. Phyllis Gross asked that Mr. Jerry Sharp be considered for the F,.,~ position. Mr. Sharp is a citizen of Owasso, works. at the Hilti Corporation and has had a number of years of personnel manage- ment experience. Mr. Smalley asked if he would be willing to OWASSO CITY COUNCIL PAGE THREE MAY 3, 1983 serve on the board. Mrs. Gross said that he would. Mrs. Webb asked if the position needed to be filled immediately. Mr. Block said it did not have to be done immediately, but should be done soon as a matter is pending before the Soard. Mrs. Gross suggested the matter be brought up at the next Council meeting and both Mr. Pritchard and Mr. Sharp could be present. Mrs. Webb asked when the next opening would be. Mayor Spencer said Rev. O'Ke11y's position would expire June 30, 1983: Mayor Spencer stated that he felt the City Charter should be changed so that members of the Personnel Board would be termi- nated after a case was .finished and a new Personnel Board would be appointed. Motion was made by James Smalley, seconded by Von Stockier, to appoint Mr. Gary Pritchard to fill the expired seat on the Personnel Board, for the period of time ending June 30.,.1985,. as set forth in the Owasso City Charter, Article 8, Sec. 8-Z. AYE: Messrs. Spencer, Stockier, Smalley; Mrs. Webb NAY: Mrs. Gross Motion carried. C. CONSIDERATION OF APPOINTMENT OF AUTHORIZED AGENT FOR OML PENSION BOARD. Per. Block said the Pension Board asked that the Council appoint an authorized agent to correspond with them concerning employees and the pension ftmd, He said Mary Griffin had been doing this cor- respondence and asked that the Board make this official. Motion was made by Wauhilleau Webb, seconded by Von Stockier, to appoint Mary Griffin as the City's authorized agent to cor-respond with the Oklahoma Municipal League Pension Board. AYE: Messrs. Spencer, Stockier, Smalley; Mrs, Webb, Mrs. Gross NAY: None Motion carried, D. CONSIDERATION OF PROPOSED AMENDMENT TO ORDINANCE ~k326. Mr. Cates explained that the intent of the Council had been fox the ordinance to be in effect only for the time needed to retire the General Obligation Bonds. However, this was not specified in the Ordinance. Mr. Cates submitted an amended to Ordinance ~k326 specifying that the ordinance shall remain in effect until such time as the principal and interest requirements on the $2,775,000.00 General Obligation Bonds of 1983 of the City are paid in full. OWASSO CITY COUNCIL PAGE FOUR MAY 3, 1983 He said that an Emergency Clause had been included in the Amend- ment, but not put on the Agenda. He said the Emergency Clause could be deleted as the Sales Tax, if approved, would not become effective before July 1, 1983. Motion was made by Wauhilleau Webb, seconded by Phillis Gross, to adopt Ordinance ,326 Amended with Section 3 of said Ordinance deleted. AYE: Plessers. Spencer, Stockler, Smalley; Mesdames Gross, Webb. NAY: None Motion carried. E~ CONSIDERATION OF APPROVAL OF AGREEMENT WITH OWASSO SOCCER CLUB FOR ELNI CREEK PARK SOCCER FIELDS. In discussion of the submitted agreement, Mr. Cates pointed out in particular Section 3 which outlines the duties and responsi- bil,ities of the Owasso Soccer Club and the City of Owasso. He explained the provision relating to "quiet enjoyment" stating that if another soccer association within the city limits of Owasso, desires to use the soccer fields, arrangements would have to be made to accomodate that association. The City would be the final arbitor as to the extent of the use. Mrs. Webb asked if the fields in question were designed specif- ically for soccer. Mr. Block said that they were, that the original design of the park called for two soccer fields. She asked for clarification as to who would be allowed to play on the soccer fields, r'Ir. Henry explained that anyone in an orga- nized league in Owasso, ages six to nineteen, would be allowed to play on the soccer fields. Motion was made by James Smalley, seconded by Von Stockler, to accept the lease agreement between the City of Owasso and the Owasso Soccer Club for the Elm Creek Park Soccer Fields. AYE: Messrs. Spencer, Stockler, Smalley; Mesdames. Webb, Gross NAY: None Motion carried. 9. REPORT FROM CITY ATTORNEY A. OWASSO BAPTIST CONVENTION CENTER VS. CITY OF OWASSO/ REQUEST FOR EXECUTIVE `SESSION. Mr. Cates asked that items A, B, and C under his report be con- sidered together in Executive Session and that the Council ask for any statement from individuals before they recess into Executive Session. ~. ~, OWASSO CITY COUNCIL PAGE FIVE MAY 3, 1983 There was no one present from the Owasso Baptist Convention Center. Mr. Key had nothing to add to his claim. Mrs. McNiel said that there were three items on her claim that she would be willing to compromise on: the dresser from Manhatten; eating out and full time help. Motion was made by Wauhilleau Webb, seconded by James Smalley to convene into executive session to discuss the three items under ~~9 on the agenda. AYE: Messrs. Spencer, Stockler, Smalley; Mesdames Webb, Gross NAY: None Motion carried. Meeting recessed at 7:42 p.m, and reconvened at 8:58 p.m. Motion was made by Wauhilleau Webb, seconded by Von Stockler, on - the matter of Owasso Baptist Convention Center vs. City of Owasso, to authorize the City Attorney to execute a decree of vacation. AYE: Messrs. Smalley, Stockler, Spencer; Mesdames Gross, Webb NAY: None Motion carried. B. CONSIDERATION OF ACCEPTANCE OR DENIAL OF SEWER DAMAGE CLAIM-KEY REQUEST FOR EXECUTIVE SESSION. C. CONSIDERATION OF ACCEPTANCE OR DENIAL OF SEWER DAMAGE CLAIM-McNEIL REQUEST FOR EXECUTIVE SESSION. Motion was made by Phyllis Gross, seconded by James Smalley, to table items 9. B and 9. C to the next Council meeting, P-1ay 17, 1983, and to instruct City Manager and City Attorney to contact Crawford and Company to verify their position on the matter. AYE: Messers. Stockler, Smalley; Mesdames Webb, Gross NAY: None ABSTAIN: Mayor Spencer Motion carried. Mr. Key asked if the letter they had received from the insurance company was not sufficient. Mr. Block said they needed to get. more information about the refusal. Mayor Spencer asked Mr.. Key and Mrs. McNeil if their homeowners OWASSO CITY COUNCIL PAGE SIX MAY 3, 1983 insurance had paid on the claim. Mr. Key and Mrs. McNeil said no. The Mayor asked if they had turned in a claim. Mr. Key said he had not. Mrs. McNeil said she had not because she had been advised by her insurance company that they would not accept such a claim. He asked what insurance companys they used for their home. Mr. Key said he has State Farm and Mrs. McNeil said she has Farmers Insurance. Mr. Key said his company said they would consider paying on the damages outside his house. 10. REPORT FROM CITY MANAGER Mr. Block reported that the firefighters meeting scheduled for this date had been postponed, so he could not report on it as anticipated. The F.O.P, are meeting this evening and at this point there is nothing specific to report... They are in the process of prioritizing their requests. The City has not made any offers as yet. Mayor Spencer asked for a list of requests. Mr. Block said a list from the firefighters should be available by the end of the week, and from the F.O.P, before next Council meeting. He said he would ask the negotiator, i`'Ir. Lindsey to be at the next Council meeting. Mr. Block discussed the .policy on use of City vehicles. After careful review, he said he felt the existing policy was adequate. Necessary steps will be taken so that all personnel are in com- pliance with the policy. City vehicles will only be taken home by employees residing within the city limits who have express permission of the City Manager.. to do so. Mr. Smalley voice his agreement with the policy as written and appreciated it being brought to the Council's attention. Mr. Block said the current report on revenue reflects that the City should be able to finish the fiscal year within the budget. He said he was concerned now as the new budget is being prepared about not knowing positively that we will have the revenue sharing program. This will probably not be known until October. Mr. Block said that not only would we be having lower rates on our Workman's Comp program as a result of his visit to the Oklahoma City office, we would also be receiving a refund on past overcharges. He reported that the water paybacks to Terry L. Davis which had been set to recommence in April will be somewhere between $1,000 and $2,000 according to water usage. Motion was made by James Smalley, seconded by Wauhilleau Webb, to leave the Policy and Procedure Manual on the use of City vehicles as it is written.
