HomeMy WebLinkAbout1983.05.17_City Council MinutesOn Tuesday, May 17, 1983, the Owasso City Council met in regular session in the Council Chambers at City Hall per the Notice of Public Hearing and Agenda posted on City Hall Bulletin Board at 4:00 p.m, on May 13, 1983, and by reference is made a part hereof. ITEM l: CALL TO ORDER The meeting was called to order at 7:00 p.m, with Mayor Spencer presiding. ITEM 2: FLAG SALUTE Flag salute was led by Mayor Spencer. ITEM 3: ROLL CALL PRESENT: Boyd Spencer, Mayor Wauhilleau Webb, Vice-Mayor Von Stockler, Councilman James Smalley, Councilman Ann Hendrickson, City Clerk Dale Block, City Manager Ron Cates, City Attorney ABSENT: Phyllis Gross, Councilwoman. ITEM 4: APPROVAL OF MINUTES OF REGULAR SESSION OF OWASSO CITY COUNCIL, MAY 3, .1983. Potion was made by James Smalley, seconded by Von Stockler, to approve the minutes of May 3, 1983, by reference made a part hereof, AYE: Messrs. Spencer, Stockler, Smalley; Mrs. Webb NAY: None Motion carried. ITEM 5: BUSINESS: A. CONSIDERATION OF RENEWAL OF LEASE WITH OWASSO RODEO CLUB. The City Attorney said that he had renewed the lease and pointed out that the lease has an option to renew for five years on the same terms and conditions and that the Council has six months to renew the lease. He said if there has been .compliance with the provisions of the lease in the past and the City wishes to renew it, the six months period can be waived. Mr, Smalley asked if he was understanding it correctly to be a renewal of the lease for five years only. Mr. Cates said that was correct and a letter should be written stating that to ..avoid any misunderstanding. Motion was made by James Smalley, seconded by Von Stockler, to renew the lease with the Owasso Roundup Club for five years effective immediately, with the same terms and conditions as previously set out. OWASSO CITY COUNCIL PAGE TWO MAY 18, 1983 AYE: Messrs. Spencer, Stockier, Smalley; Mrs. Webb. NAY: None Motion carried. 5. B. CONSIDERATION OF CITY'S ACCEPTANCE OF STREET SYSTEM/ EL RIO VISTA II. Mr. Block said the streets were done in an acceptable manner and recommended that the streets be accepted as part of the City's street system. Motion was made by Von Stockier, seconded by James Smalley,_to accept the street system of El Rio Vista II into the City of Owasso. AYE: Messrs.. Spencer, Stockier, Smalley; Mrs. Webb NAY: None Motion carried. 6. REPORT FROM CITY ATTORNEY A. CONSIDERATION OF ACCEPTANCE OR DENIAL OF SEWER DAP7AGE CLAIM- KEE REQUEST FOR EXECUTIVE SESSION. B. CONSIDERATION OF ACCEPTANCE OR DENIAL OF SEWER DAMAGE CLAIM- McNIEL REQUEST FOR EXECUTIVE SESSION. C. DURBIN VS. CITY OF OWASSO/REQUEST FOR EXECUTIVE SESSION Motion was made by mayor Spencer, seconded by James Smalley, to recess into Executive Session for the purpose of discussing items A, B, and C under ~~6 on the Council Agenda. AYE: Messrs. Spencer, Smalley, Stockier; Mrs. Webb NAY: None Motion carried. Council recessed at 7:12 p.m, and reconvened at 8:00 p.m. A. notion was made by James Smalley, seconded by Mayor Spencer, that. Mr. Kee's claim as presented to the City. Council be denied. AYE: Messrs. Spencer, Stockier, Smalley; Mrs. Webb NAY: None Motion carried. OWA~SO CITY COUNCIL PAGE THREE MAY 18, 1983 B. Motion was made by James Smalley, seconded by Von Stockler, that Mrs. McNiel's claim as presented to the City Council be denied. AYE: Messrs. Spencer, Stockler, Smalley; Mrs. Webb NAY: None Motion carried. C. Motion was made by Wauhilleau Webb, seconded by Von Stockler, that the Council authorize Mr. Cates to have this matter tried to the court rather than a jury trial. AYE: Messrs. Spencer, Stockler, Smalley; Mrs. Webb NAY: None Motion carried. Mrs, ricNiel asked why the claim was denied. Mr. Cates said the claims as presented were not pr-oiler in terms of liability, items and amounts. Mr. Kee asked if the City held itself responsible in any way for anything that happens with the sewer system. Mr. Cates said he could not answer that question. Mr. Smalley said that the matters would be turned back to the insurance carrier. Mrs. McNiel-said she could not understand haw the City could deny a claim when the Council knows the City is responsible for what happened. Mr. Kee said he could not understand how the City could deny liability on damages to his property. Mr. Smalley said that the City has an insurance carrier to cover these kind of things. Mr. Cates said that since the claim has been denied and this is pursuant to notice under the Political Subdivision Tort Claims Act, he would recommend that communications cease and the matter be referred to the insurance carrier. 7. REPORT FROM CITY c~1ANAGER A. UPDATE ON LABOR NEGOTIATIONS Mr. Block said that more progress had been made with the Fire- fighters than with the Fraternal Order of Police because the City has been working with a contract with the firemen and not everything in the contract has to be negotiated every year. The situation with the FOP requires all new language and Mr. Lindsey, the City's bargaining agent, seemed to th~_nk that progress was being made. T~1r. Block said a meeting would be set up soon between Mr. Lindsey and the Council for review and discussion. Mr. Block asked that any Council members who were interested in attending the OT•TL workshop for city officials to let him know OWASSO CITY COUNCIL PAGE FOUR MAY 19, 1983 so that reservations could be made. Mr. Block said the sirens have arrived and will be installed as soon as possible. Mayor Spencer asked where they would be installed. Mr. Block said one would be installed in the area of Rayola Park and another one just south of German ,Corner. The Mayor asked why one would be put at Rayola Park when there is one across the highway. Mr. Block said the Civil Defense officer had a study done as to where the sirens should be located. Mr. Block reported that the new fire truck should be delivered in about six weeks. He said that since it appears the City would get through the fiscal year in good shape financially, he would like to spend some of the budgeted money. He would like to take bids on a sewer truck and begin expansion of the City garage. 8. APPROVAL OF CLAIMS Motion was made by James Smalley, seconded by Wauhilleau Webb, to approve the General Fund claims for April in the amounts of $88,706.37, $1,632.53 and $41.70. AYE: Messrs. Spencer, Stockier, Smalley; Mrs. Webb ,. . NAY: None Motion carried. 9. NEW BUSINESS There being no new business before the Owasso City Council, chair adjourned at 8:18 p,m, ~~` BOY M.
