HomeMy WebLinkAbout1983.10.04_City Council MinutesOn Tuesday, October 4, 1983 the Owasso City Council met in regular session in the Council Chambers at City Hall per the Notice of Public Hearing and Agenda posted on City Hall Bulletin Board at 4:00 p.m, on September 30, 1983. ITEM 1: CALL TO ORDER The meeting was called to order at 7:02 p.m, with Mayor Spencer presiding. ITEM 2: FLAG SALUTE Flag salute was led by Mayor Spencer. ITEM 3: ROLL CALL PRESENT: Boyd Spencer, Mayor Wauhilleau Webb, Vice-Mayor James Smalley, Councilman Dale Block, City Manager Ron Cates, City Attorney Ann Hendrickson, City Clerk ABSETdT: Von Stockler, Councilman Phyllis Gross, Councilwoman ITEM 4: APPROVAL OF MINUTES OF REGULAR SESSION OF OWASSO CITY COUNCIL, SEPTEMBER 20, 1983. Motion was made by Wauhilleau Webb, seconded by James Smalley, to approve the minutes of September 20,.1983, by reference made a part hereof. AYE: Messrs. Spencer, Smalley; Mrs. Webb NAY : TZone 1`~otion carried. ITEM 5: BUSINESS A. CONSIDERATION OF APPROVAL OF INVESTMENT OF 1983 GENERAL OBLIGATION BOND FUNDS. Mr. Alan Anderson of First Bank of Owasso and T~Ir. Frank Enzbrenner of Liberty Bank were present. Both banks accepted a portion of the funds as shown on the investment proposal for the General Obligation Bond Monies. Motion was made by James Smalley, seconded by Wauhilleau Webb, that, since all the funds from the 1983 General Obligation Bonds are not needed at this time, the Council would authorize the investment of funds as set forth in the Investment Proposal presented to the Council, by reference made a part hereof. OWASSO CITY COUNCIL PAGE TWO OCT. 4, 1983 AYE: Messrs. Spencer, Smalley; Mrs. Webb NAY: None Motion carried. B. CONSIDERATION OF MTTA CONTRACT REGARDING COMMUTER BUS SERVICE. The City Attorney. said that although the City of Owasso would be ho 1 ding harmless and agreeing to indemnify the Oklahoma Dept, of Trans- portation and the U.S. Dept. of Transportation from any damage they might suffer as a result of the commuter bus service, he caas aware that other cities were operating with similar contracts without problems. He said this was an area of secondary concern and there was no history of O.D.O.T or U.S.D.T, being involved in litigation. Z~Zotion was made by Mayor Spencer, seconded by Wauhilleau Webb, to approve the MTTA purchase of service contract. AYE: Messrs. Spencer, Smalley; Mrs. Webb NAY: None Motion carried. Items C and D were passed to the end of the agenda. E. CONSIDERATION OF REQUEST TO VACATE A PORTION OF 17.5 FT. UTILITY EASEPZENT LOCATED ON A RESIDENTIAL LOT, (LOT 20 BLOCK 5, EL RIO VISTA II. Motion was made by Mayor Spencer, seconded by James Smalley, to deny the request for vacation of a portion of 17.5 ft. Utility Easement (Lot 20, Bl. 5, El Rio Vista II). AYE: i!Iessrs. LAKERIDGE TERRACE FIRST ADDITION: REQUEST FOR APPROVAL O~A~IENDED NAl`ZE TO LAKERIDGE FIRST ADDITION FOR THE FINAL PLAT LOCATED NORTH AND WEST OF 86TH 5T. NORTH & 29TH E. AVENUE. Z7otion was made by Wauhilleau Webb, seconded by James Smalley to approve the request for amending name to Lakeridge First Addition. AYE: Messrs. Spencer, Smalley; Mrs. Webb NAY: None P«Zotion carried. OWASSO CITY COUNCIL PAGE THREE OCT. 4, 1983 G. CONSIDERATION OF REQUEST FOR PERMISSION TO CONDUCT RELIGIOUS TENT SERVICE. Mr. Frank Adams stated that he had received permission from Mr. H. D. Hale to use his property to hold a tent meeting from Sunday, October 9, to Sunday, October 16 and would like an option to continue for one more week. He stated he would hold two services on Sunday, 10:00 a.m, and 7:30 p.m, and one ser- vice during the week at 7:30 p.m. He stated the tent was certified fire retardant and fire extinguishers would be on the premises.- He stated the amplification. would not be excessive. He said there would be two portable toilets on the premises. He explained that there would be several entrances onto the lot and if traffic was a problem, they would get help from the police department for traffic control. Mr. Block said that he would require an inspection by the fire marshall when the tent is set up. Motion was made by Wauhilleau Webb, seconded by James Smalley, to approve the request of Frank Adams Ministries to conduct a religious tent service from October 9 through October 16 with an option of.another.week provided all above requirements are met. AYE:. Messrs. Spencer, Smalley;. Mrs. Webb NAY: None Motion carried. H. CONSIDERATION OF APPROVAL OF MAINTENANCE AGREEMENT/ BURROUGHS. Mr. Block stated that the Burroughs maintenance agreement could be renewed for a period of six months for a cost of $5,071.70. He said over $5,000 in repairs had already been incurred. He said he felt the main problem was in this particular model of equipment. He said if the City could acquire equipment with a maintenance agreement that would be quite a bit less expensive, the equipment could be paid for from the savings. He said the present machine is out of storage, so additional expense would be incurred in obtaining additional storage as well as maintenance expense that will also increase. Council asked Mr. Block to obtain proposals from IBi1 and two other computer companies for the October 18 meeting. Motion was made by James Smalley, seconded by Wauhilleau Webb, to approve the maintenance agreement with Burroughs in the amount of $5,071.70. AYE: Messrs. REPORT FROM CITY ATTORPJEY Mr. Cates informed the Council that a proceeding has been instituted by Olympic Homes, Inc, in District Court regard- ing denial of a variance of set back requirements by the Board of Adjustment. 7. REPORT FROM CITY MANAGER None at this time. 8. NEW BUSINESS P~Zr. Smalley asked about the status of the left turn sign at 86th St. No. Mr. Block said it had been installed on the center median pole. Mrs. Webb asked if the timing sequence at that intersection had been changed since she had recently noticed a backup problem there. Mr. Block said there had been no intentional change, but that the sequence could be affected by weather and he would check into it. Mrs. Webb asked if the City could do anything about contractors who frequently cut into utility lines and are not willing to , make restitution. Mr. Block said he would see if he could find anyone who has had success in dealing with the problem. 5. C. REQUEST FOR EXECUTIVE SESSION/CITY CLERK PERSONNEL P~IATTER l~iotion was made by Jame Smalley, seconded by Wauhilleau Webb, to recess into Executive Session. AYE: iZessrs. Spencer, Smalley; Mrs. Webb Nay; None Motion carried. Meeting recessed at 8:20 p.m, and reconvened at 9:~~5 p.m. 5. D. CONSIDERATION OF APPOINTMENT OF DEPUTY COURT CLERK. I-Zotion was made by Wauhilleau Webb, seconded by James Smalley, to ~- appoint Faye Smith as Deputy Court Clerk to assist the City Clerk only in the record-keeping .matters inunediately following court sessions and receipting of fines in City Clerk's absence. AYE: Messrs.
