regular session in the Council Chambers at City Hall per the
Notice of Public Meeting and Agenda posted on City Hall
bulletin board at 4:00 P,M. on April 30, 1982, and by reference
is made a part hereof.
ITEM l: CALL TO ORDER.
The meeting was called to order at 7:00 P.M. with Vice Mayor,
Phyllis Gross presiding.
ITEM 2: FLAG SALUTE,
Flag salute was led by Vice Mayor, Phyllis Gross.
ITEM 3: SEATING AND SWEARING IN OF WAUHILLEAU WEBB AS NEW CITY
C UNCIL MEMBER FROM WARD
Wauhilleau L. Webb was given the Oath of Office by the City Attorney
and seated as the Councilwoman for Ward 1.
ITEM 4: SEATING AND SWEARING IN OF VON E. STOCKLER AS NEW CITY
COUNCIL MEMBER FROM WARD 2.
Von E. Stockler was given the Oath of Office by the City Attorney
and seated as Councilman for Ward 2,
ITEM 5: SEATING AND SWEARING IN OF JAMES C. SMALLEY AS REELECTED
CITY COUNCIL MEMBER FROM WARD 5,
James C. Smalley was given the Oath of Office by the City Attorney
and swated as Councilman for Ward 5.
ITEM 6: ROLL CALL.

ITEM 7: ELECTION OF MAYOR,
Mrs. Gross nominated Von Stockler for Mayor.
Mr. Stockler withdrew his name stating that he was a new councilman
and wanted to do the best job he could as a councilman, not a mayor.

Motion was made by Jim Smalley, seconded by Wauhilleau Webb
to appoint Boyd Spencer as Mayor for a one year term of office
to expire May 2, 1983.
AYES: Messrs, Stockler, Smalley and Mrs. Webb
NAYS: Mrs. Grass
ABSTAIN: Mr, Spencer
Mr. Spencer was elected Mayor, and assumed the chair for the
remainder of the meeting.
ITEM 8: ELECTION OF VICE MAYOR.
Motion was made by Von Stockler, seconded by Jim Smalley to
appoint Wauhilleau Webb as Vice Mayor for a one year term of
office to expire May 2, 1983.
AYES: Messrs. Spencer, Smalley and Stockler
NAYS: None
ABSTAIN: Mesdames Webb and Gross
Wauhilleau Webb was elected Vice Mayor,
ITEM 9: APPROVE MINUTES OF APRIL 20, 1982, REGULAR MEETING OF
THE CITY COUNCIL OF OWASSO, OKLAHOMA,
Motion was made by Jim Smalley, seconded by Von Stockler to
approve the Minutes of the April 20, 1982 Regular Meeting.
AYES: Messrs. Spencer, Smalley and Stockler Mesdames Webb and Gross
NAYS: None
Motion carried.
ITEM 10: REQUEST TO DISQUALIFY FROM THE CITY PERSONNEL BOARD
FOR THE HEARING ON THE TERMINATION OF DAVID B. SLOANE.
Mr. Sloane stated that he was not asking for Mr. Randolph's
removal from the Personnel Board, only from Mr. Sloane's hearing.
Mrs. Gross inquired as to the question of "a fair hearing".
Mr. Sloane stated that he did not feel that Mr. Randolph could ~.,.,~
give him "a fair hearing".
Mr. Smalley stated that he did not feel that the Council should
disqualify Mr, Randolph, but that he should disqualify himself,

Mr. Cates stated that the Personnel Board does sit at the Council's
leisure. He stated that there is not charter provision for
disqualification.
Motion was made by Phyllis Gross, seconded by Jim Smalley to
dney the request to disqualify Bob Randolph from the City Personnel
Board.
AYES: Messrs. Smalley and Mrs. Gross
NAYS: Mrs. Webb
ABSTAIN: Messrs. Spencer and Stockler
Motion carried.
ITEM 11: AMENDMENT OF ORDINANCE 108, SECTION 4, TO PROVIDE THAT THE
CITY CLERK OF THE CITY OF OWASSO OR A DEPUTY THEREOF SHALL ALSO BE
AND ACT AS CLERK OF THE MUNICIPAL COURT.
Mr. Fugate stated that the Ordinance was prepared in accordance
with the Council's wishes.
Mr. Cates stated that the Ordinance was changed only by adding
"or a deputy thereof".
Motion was made by Phyllis Gross, seconded by Von Stockler to
accept the amendment of Ordinance 108, Section 4.
AYES: Messrs. Stockler and PZrs. Gross
NAYS: Messrs. Spencer, Smalley and Mrs. Webb
Motion failed.
ITEM 12: EMERGENCY CLAUSE ON AMENDMENT OF ORDINANCE 108, SECTION 4.
In accordance with Item 11, the motion failed, and there was no need
for an emergency clause.
ITEM 13: RESIGNATION OF ROBERT A. FUGATE AS DEPUTY CITY CLERK.
Mr. Fugate stated that because of the work load of being Acting
City Manager and City Treasurer, he asked that he be relieved of
his duties as Deputy City Clerk.
Motion was made by Phyllis Gross, seconded by Boyd Spencer
to accept the resignation of Robert A, Fugate as Deputy City Clerk.
AYES: Messrs. Spencer, Smalley and Stockler Mesdames Webb and Gross
NAYS: None

ITEM 14: APPOINTMENT OF DEPUTY CITY CLERKS.
Mr. Fugate stated to the Council that he recommends Marla Myers
as Deputy City Clerk.
Mr. Spencer stated that he wanted the position to be temporary
for 3 months, so that the new City Manager could be informed
of this position.
Mrs. Shelley stated that she would need someone to do court
during the International Municipal Clerk's Conference on
May 27, 1982.
Mr. Spencer stated that Mrs. Rosalee Roberts would be able to
hand the Court on that day.
Mr. Cates stated that Mrs. Roberts should take the Oath of
Office before she goes into court.
Motion was made by Phyllis Gross, seconded by Wauhilleau Webb to
appoint Marla Myers as Deputy City Clerk for a 3 month temporary
position, not to do Court.

ITEM 15: PETITION OF RESIDENTS OF ELM CREEK ADDITION TO HAVE A
PRIVACY FENCE ERECTED ON THE NORTH AND EAST BOUNDARIES OF THE
CITY CEMETARY.
Mr. Fugate stated that he Izad a petition signed by 10 residents
requesting a privacy fence. He stated that he thought there were
2 items that needed to be placed above this request. Those
being permanent concrete corner markers for lots and blocks
and an equipment shed. He stated that a privacy fence would
cost approximately $12,500.00 and that there was about $32,000.00
in the Cemetary Trust Fund.
Mr. Stockier stated that the Cemetary preceded the housing
development and the residents knew that there was a Cemetary
when they moced in. He requested that the 2 additional priority
needs be put on a future Council Agenda.
Motion was made by Von Stockier, seconded by Boyd Spencer to
deny the Petition to have a privacy fence erected.

ITEM 16: APPROVE WARRANTS FOR PAYMENT,
Mrs. Webb questioned Regeneration Fitness ~k2110.82 for $1,950.00.
Mr. Fugate stated that this amount was for 1 year for 13 Fireman
with any change in personnel, the new person could assume the membership.
Mr. Spencer stated that he wanted the personnel assumption in writing,
and resubmit the warrant at the next meeting.
Motion was made by Phyllis Gross, seconded by Wauhilleau Webb
to approve warrants 2029-82 through 2109-82 with the exception
of 2110.82 far $1,950.00 for a corrected total of $43,145.16;
Park Grant Fund ~~2145-82 for $43.50; Revenue Sharing ~p2146-82
through 2132-82 for a total of $37,279.26; Teletype Fund 2150-82
for a total of $297.00.

Motion carried.
ITEM 17: NEW BUSINESS.
Mr. Smalley recommended that the Council interview Mr. Dale Block
from Sapulpa.
Mr. Spencer asked that the interview be on Thursday, May 6, 1982
at 7:00 P.M.
Mr. Fugate stated that he was resigning as of June 30, 1982, and
finding a City Manager should be done as soon as possible.
Mr. Cates thanked the Council for allowing him to attend the
anti-trust seminar in Dallas. He requested that he be allowed
to report to the Council at a later date on his information.
Being no further business before the Owasso City Council, the
chair adjourned at 7:50 P.M.
