HomeMy WebLinkAbout1982.01.19_City Council MinutesOn Tuesday, January 19, 1982, the Owasso City Council met in regular session in the Council Chambers at City Hall, per Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 2:00 P.Pv7. on January 15, 1982, and by reference is made a part hereof. ITEM l: CALL TO ORDER. The meeting was called to order at 7:20 P.1, with Mayor Wasserman presiding. ITEM 2: FLAG SALUTE. ITEM 3: ROLL CALL. PRESENT: Lyle Wasserman, Mayor Phyllis Gross, Vice Mayor Boyd Spencer, Councilman John Stadler, Councilman Jim Smalley, Councilman Ron Cates, City Attorney Kenneth Thompson, City rlanager Sue Shelley, City Clerk ABSENT: None ITEM 4: APPROVE P•7INUTES OF JANUARY 5, 1982 REGULAR CITY COUNCIL MEETING. John Stadler stated that on Item 14 ''Nays" should have been ''Abstain by Messrs. Spencer, Stadler and Smalley". Motion was made by John Stadler, seconded by Phyllis Gross to approve minutes of January 5, 1982, Regular City Council i2eeting with the correction as stated above. AYES: Messrs, Wasserman, Spencer, Stadler, Smalley and P•7rs, Gross NAYS: None Motion carried. ITEM 5: APPOINTMENT OF AN ADVISORY COMPIITTEE FOR THE PROPOSED SALES TAX AND PUBLIC IMPROVEMENTS BOND ELECTION. Boyd Spencer stated that he was 100% against the sales tax and bond election. Mr. Stadler stated that he had one person who would serve. ?7rs. Gross stated that each council member should get one person to serve from their ward. City Manager suggested that it be placed on the next agenda. No Motion was made. Owasso City Council Page Two January 19, 1982 ITEM 6: A RESOLUTION SETTING DATES FOR 1982 CITY COUNCIL ELECTIONS AND SPECIFYING THE W DS FOR WHICH CANDIDATES MAY FILE. Primary Election set for March 16, 1982, files the General Election would be April 3 years, Ward 2 for 3 years, Ward 5 for 1 Motion was made by Boyd Spencer, seconded dates for 1982 City Council Elections and candidates may file. if more than one person 6 , 1982 . Ward 1 for year. by John Stadler to set Wards for which AYES: Messrs. Wasserman, Spencer, Stadler, Smalley and Mrs. Gross NAYS: None Motion carried. ITEM 7: INQUIRY AS TO LEGALITY IN TERMS OF THE EFFECT OF, AS WELL AS THE ACTION TAKEN CONCERNING THE LETTER DATED AUGUST 8. 198 BY L DEPARTMENT. i~irs. Gross asked that this item be placed on the agenda, the . ,. letter regarded an increase of 5% cost-of-living increase to City rlanager and City Clerk retroactive July 1, 1981. She felt that this should have been a council action. Mr. Spencer stated that on June 16, 1981, a vote was taken to adopt the Budget, four councilmen voted in favor, and motion carried, Mrs. Gross was not present at that meeting. The S% cost-of-living included all employees, the City PZanager and the City Clerk did not receive the adopted raise as did the other City Employees and T-2r. Spencer signed as Mayor (Department Head) a memo to activate the 5% raise included in the approved budget. Mr. Cates stated that no council action was necessary, because Resolution 80-5 adopted the Municipal Budget Act. Z•Zotion was made by Boyd Spencer to strike from the Agenda. No Second was made. P-Zotion was made by Jim Smalley, seconded by Boyd Spencer to move on to the next item on the Agenda. AYES: T~Iessrs. Owasso City Council Page Three January 19, 1982 ITEM 8: RECONSIDERATION OF CITY COUNCIL ACTION TAKEN AT THE JANUARY 5, 1982, MEETING ON THE REQUEST OF PMR. VINES TO CORRECT ZONIi~IG MAP FOR LOT 1. BLOCK 1. HALE ADDITION. City Manager reported that he was concerned about the consequences of the action taken on Mr. Vines property. Mr. Vines has agreed to go to the Board of Adjustment for interpretation, if no satisfaction he will then appeal to the Planning Commission, at the City's expense. Motion was made by Phyllis Gross, seconded by Boyd Spencer to rescind the motion regarding Mr. Vines property made at the last council meeting. AYES: Messrs. Spencer, Stadler, Smalley and Mrs. Gross NAYS: Mr. Wasserman Motion carried. ITEM 9: REQUEST TO SHARE ONE-HALF THE COST WITH TULSA COUNTY City :Manager reported that this was not a budget item. He stated that he would recommend that it should be purchased from the revenue sharing fund. Mr. Leach was available for questions, he stated that no money has been spent for equipment of this kind. He stated that approximately 280 people per day utilized this facility and this should enhance the program as per-the use of this facility by men. Six people can work out on the machine at one time. The County would share one- half the total cost of this machine., Motion was made by Boyd Spencer, seconded by Phyllis Gross to purchase weight machine, with Tulsa County sharing one-half the cost. Owasso City Council Page Four January 19, 1932 ITEM 10: REQUEST FOR CHANGE OF BIDDERS FOR CONCRETE WORK I1y ELM CREEK PARK. City Manager reported that two bids were taken for concrete work in Elm Creek Park. The low bidder was approved by the Council, he requested that the City furnish all the forms for the concrete work and the City PTanager believes that he wants out of his contract. To save rebidding, the other eligible bidder, Damon Davis bid is for $500.00 more. Motion was made by Phyllis Gross, seconded by Boyd Spencer to change bidders to Damon Davis for concrete work in Elm Creek Park. AYES: Messrs. Tilasserman, Spencer, Stadler, Smalley and Mrs. Gross NAYS: None Motion carried. ITEM 11: REVIEW FINANCIAL STATEMENTS FOR NOVEMBER AND DECE~-1BER City Manager reported on the December report, the mid-year statement. Revenue was 5% under projected for tine year, because of construction slowdown. Sales tax was ahead of schedule. Expenditure was about 22% over. General government has already exceeded the budget, this involves some transfers. Police Department is over budget, because of personnel costs and overtime costs, City Manager reported that he would like to wait until the January Report to decide whether or not to recommend the 5% cost-of-living raises. ITEM 12: APPROVE WARRANTS FOR PAYMENT. City Manager answered questions on ~~1529 used by recreation center and street department; ~k1435/1503 higher because of 3 payrolls in December-Workman's Comp. a possible solution was suggested of self-insurance by the City; ~~1517 Volare worked on to be used by Meter Reader; ~k1510 monthly bill by Ron Cates; ~~1513 Disk for computer; ~~1438 cancelled and replaced by ~~1440 and amount of $135.00 deducted from total because~of Phyllis Gross's cancellation to National League of Cities Conference. Motion was made by Phyllis Gross, seconded by John Stadler to approve warrants ~~1437 throu h ~~1557 with the exception of ~k1438 for a corrected total of 45,772.46. AYES: Messrs. Owasso City Council Page Five January 19, 1982 NEW BUSINESS: City Manager put a copy of the design criteria for development prepared by City Engineer for paving, drainage, and detention to be put on Agenda in the near future. City Manager reported that the speed limit reduction on US-169 and request for left-turn indicator at 86th Street North, at the City's expense, according to a letter from the State Department of Transportation. Bids will need to be taken for the left-turn indicator. City Manager reported that the meter installation by the City of Tulsa was excessive and that he would appeal this bill of $7,000.00. City manager reported that the City Planner would like to have the City Attorney at City Planning Commission Meeting to discuss OZ-61. Boyd Spencer requested a report from the City Manager and the Building Inspector on the Whitfield Building condition, permit, and the qualification of the employees putting in the plumbing. Cheif Reyes stated that on January 12, 1982 the City had a strong arm robbery,, S.ix citizens chased and apprehended the thief, the Chief awarded to these six an Award of Outstanding Citizenship and a letter of commendation from the Police Department. Receiving these awards were Clyde Wampole, Joey Wampole, Larry Thomas, Olen Lackadoo, Ruth Atherton and TZrs. Bruner(the victim).
