HomeMy WebLinkAbout1982.01.05_City Council MinutesOn Tuesday, January 5, 1982, the Owasso City Council met in regular session in the Council Chambers at City Hall, per notice of Public fleeting and Agenda posted on the City Hall bulletin board at 2:00 P.PM. on December 31, 1981, and by reference is made a part hereof. ITEM l: CALL TO ORDER. The meeting was called to order at 7:00 P.M. with P7ayor Wasserman presiding. ITEM 2: FLAG SALUTE. Flag salute was led by Mayor Wasserman. ITENI 2-A: ROLL CALL. PRESENT: Lyle Wasserman, Mayor Phyllis Gross, Vice ?'Mayor Boyd Spencer, Councilman John Stadler, Councilman Jim Smalley, Councilman Ron Cates, City Attorney Kenneth Thompson, City Manager Sue Shelley, City Clerk ABSENT: None ITEM 3: APPROVE MINUTES OF SPECIAL CITY COUNCIL P~ETING ON DECEMBER ~l Motion was made by Joiin Stadler, seconded by Phyllis Gross to approve the minutes of December 22, 1981 Special Council Meeting and by reference is made a part hereof. AYES: Messrs. Wasserman, Stadler, Smalley, and Mrs. Gross NAYS.: None ABSTAIIQ: Mr. Spencer Motion carried. ITEM 4: APPROVE MINUTES OF REGULAR CITY COUiVCIL P~iEETING ON DECEMBER 15. 1981. City Manager requested some corrections Item 9-first paragraph "McDonald's" should be changed to"Dr's Hospital, the Developer" and"Bill Williams" should be changed to"Dale Williams". Item 9- second paragraph "Carol Dickey addressed the issue of connecting Dogwood to 4th Avenue to Cedar Street" should have read "Carol Dickey addressed the issue of connecting Dogwood to Cedar along 4th Avenue". Owasso City Council Page Two January 5, 1982 Motion was made by John Stadler, seconded by Phyllis Gross to approve minutes of December 15, 1981 Regular City Council `Meeting. AYES: Messrs. Wasserman, Spencer, Stadler, Smalley and Mrs. Gross NAYS: None Plotion carried. ITEM 5: WAIVE SUBDIVISION PLAT REQUIREiMENTS FROPM OM (OFFICE- N~DIUM INTENSITY TO CS ~CO~'INIERCIAL-SHOPPING ON PROPERTY Carol Dickey reported- the property was rezoned at the last meeting, according to the code there is a requirement that a subdivision plat be filed of record. This provision can be waived by the City Council, if no purpose would be served by the subdivision plat. Dr. Clark would only need to file his site plat for a building permit. Ms. Dickey further stated that since the Planning Commission recommended denial of rezoning no decision was made on subdivision requirements. Motion was made by Phyllis Gross, seconded by John Stadler to waive subdivision requirements on the property located at 11880 E. 86th Street North. AYES: Messrs. Wasserman, Spencer, Stadler, Smalley and Mrs. Gross NAYS: None 1`~'Iotion carried. ITEM 6: ORDINANCE 314 REZONIi~IG A 10 ACRE TRACT NW OF 76TH STREET NORTH AND A.T. & S.F. FROr'I AG AGRICULTURAL TO IL INDUSTRIAL- Carol Dickey gave a report on the recommendation from the Planning Commission, that the proposal to change to Industrial-Light is compatable with the comprehensive plan. A railroad switch station was the stated use of this property. Motion was made by Boyd Spencer, seconded by Mrs. Gross to adopt Ordinance 314. AYES: Messrs. Wasserman, Spencer, Stadler, Smalley and ~~rs. Gross 1AYS : None Motion carried. ITEM 8: PROPOSED FIRE DEPARTMENT r1AT1UAL OF RULES AND REGULATIONS. Motion was made by Phyllis Gross, seconded by Boyd Spencer to take no action until the manual is completed, AYES: T~Iessrs. Wasserman, Spencer, Stadler, Smalley and Mrs. Gross. NAYS: None. Motion carried. ITEM 9: PROPOSED EMERGENCY MEDICAL TECHNICIAN MANUAL OF PR(1Tfl('.AT. City Manager explained that this manual was comulete. Motion was made by Boyd Spencer, seconded by Mrs. Gross to accept the proposed Emergency ~~edical Technician Manual of Protocal. AYES: Messrs. Wasserman, Spencer, Smalley, and Mrs. Gross NAYS: Mr. Stadler Motion carried. ITEM 10: PROPOSED REVISIONS IN POLICE OPERATIONS MANUAL. Motion was made by Phyllis Gross, seconded by Jim Smalley to adopt the proposed revisions of Police Operations Manual. AYES: Messrs. Wasserman, Stadler, Smalley and Mrs. Gross NAYS: Mr. Spencer (not council item) Motion carried. ITET~I 11: REQUEST TO SET DATE FOR CITY ELECTION TO AUTHORIZE AN ADDITIONAL ONE CENT SALES TAX. City Manager gave a retort that a presentation was given at the last meeting on proposed improvements projects for the City, This was stated as an alternative that could finance these improvements. No motion was made until a committee could be set up to review this matter. Owasso City Council Page Four January 5, 1982 ITEr'I 12: RE(~UEST APPROVAL AND SET DATE FOR A CITY BOND ELECTION FOR EXPANSION OF CITY HALL AND CONSTRUCTION OF A NEW CENTRAL GARAGE SERVICE CENTER. No motion was made until a committee could be set up_ to review this issue. ITEM 13: REQUEST AN APPOINTMENT OF AN ADVISORY COMMITTEE FOR THE SALES TAX ELECTION AND BOND ELECTION. City Manager gave a recommendation that an advisory board be set up to no less than 5 no more than 9, to be nominated out of volunteers to hold public hearings, not only for City Hall, City Garage, also for water and sewer improvements. Motion was made by John Stadler, seconded by Phyllis Gross to set up an advisory committee for the sales tax election and bond election. AYES: Messrs. Wasserman, Spencer, Stadler, Smalley and Mrs, Gross NAYS: None Motion carried, ITEM 14: REQUEST BY MR. WAYNE VINES TO CLARIFY ZONING CLASSIFICATION FOR LOT BLOCK 1, HALE ADDITION. Carol Dickey made a report that the subdivision plat was filed of record in 1967 while the property was in Tulsa County, it was not annexed into the City Limits of Owasso until 1969. In 1967 by State Statute under the jurisdiction of the TMACP for zoning and subdivision platting. No records have been found that this property was rezoned for Multi-family use. This property was platted 2 years before it was taken into the City of Owasso. Mr. Vines stated that this plat was drawn according to the City's requirements, the plat, covenants, the use of the property, signatures of City Mayor, and Planning Commission. City Attorney stated that there exists a conflict between the restrictive covenants and the deed of dedication and the zoning in the Owasso Zoning Base Map. He was concerned if the Council had the power to act, The Board of Adjustment is the action that should be taken is there is an error in the Owasso Zoning Base Map. The Planning Commission is the action that should be taken if this is a zoning problem. Mr. Vines stated that he approached the chairman of the Planning Commission and was told that it was not a Planning Commission action and should be brought to the City Council, He stated that he was not requesting a zoning change, and according to the covenants it was a multi-family zoning, and that the Owasso City Council Page Five January 5, 1982 zoning was changed without the knowledge of the property owners. Motion was made by Mayor Wasserman, seconded by Mr. Spencer to accept Mr. Vines request for zoning clarification.. AYES: Mr. Wasserman, and Mrs. Gross NAYS: Messrs, Spencer, Stadler and Smalley Motion carried. COMMENT: City Manager stated that he felt that the Council had passed an illegal motion. He had been involved in many zoning cases and that the Council invalidated the entire zoning ordinances of the City. There are legal remedies to solve the problem, those being the Board of Adjustment and the Planning Commission. ITEM 15: REQUEST FOR CONDITIONAL APPROVAL OF FINAL PLAT FOR ELM CREEK ESTATES, FIRST ADDITION, BLOCK 1 THROUGH Carol Dickey gave a report that this plat is for a residential plat for Elm Creek Subdivision. It has received conditional final approval from the Planning Commission. Most of the conditions for approval have been met, one major item was that none of the utilities construction plan have been approved. She reported that she recommends conditional approval, also Mr. Mansur agreed upon the completed items. The subdivision would be 46 acres and 178 lots. City Manager reported that the engineering needs to be completed to complete the construction of Elm Creek Park prior to granting any approval, also elevations of storm sewers to build the Elm Creek Retention Pond. Motion was made by Boyd Spencer, seconded by Phyllis Gross to grant conditional approval of final plat for Elm Creek Estates. AYES: Messrs. Wasserman, Spencer, Stadler, Smalley, and Mrs. Gross NAYS: None Motion carried. Owasso City Council Page Six January 5 , 1982 ~,..~ ITEM 16: APPROVE WARRANTS FOR PAYMENT. Mr. Gross made the comment that on Warrant 1411 to Harold Charney, it should be held until books and files are returned. Motion was made by Boyd Spencer, seconded by John Stadler to approve warrants for payment. ' AYES: Messrs. Wasserman, Spencer, Stadler, Smalley and Mrs. Gross NAYS: None Motion carried. ITEM 17: NEW BUSINESS. City ;tanager reported that it should be brought to the attention of the Council that the Municipal League of Cities Conference in Washington, D,C. on February 27 through March 2, 1982. January 21, 1982 the Oklahoma Municipal Government Day in Oklahoma City.
