HomeMy WebLinkAbout1981.11.03_City Council MinutesOn Tuesday, :v'overnber 3, 1981, the Owasso City Council met in regular session in the Council Chambers at City Hall, per the Notice of Public Meeting and Agenda posted on City Hall bulletin board at 9:00 AM on October 30, 1981, and by refer- ence is made a part hereof. ITEM 1 - CALL TO ORDER. The meeting was called to order at 7:05 PM with Mayor Wasserman presiding. ITEM 2 - FLAG SALUTE. Flag salute was led by Mayor Wasserman. ITEM 3 - ROLL CALL. Present: Lyle Wasserman, Mayor Phyllis Gross, Vice Mayor Boyd Spencer, Councilman James Smalley, Councilman John Stadler, Councilman Harold Charney, City Attorney Kenneth Thompson, City Manager Wauhilleau Webb, City Clerk Absent: None ITEM 4 - APPROVE MINUTES OF OCTOBER 20, 1981 REGULAR MEETING. Mr. Thompson said on Item 10 concerning the telecommunications system the min- utes should indicate the cost is $3,600.00 "per year" rather than just read $3.600.00. Motion was made by Boyd Spencer, seconded by John Stadler, to approve Minutes of October 20, 1981 regular meeting with the amendment of placing "per year" after $3,b00.00 in Item 10 on page three, and by reference are made a part hereof. Ayes - Messrs. Wasserman, Spencer, Smalley, Stadler and Mrs. Gross Nays - None Motion carried. ITEM 5 - APPP.OVE MINUTES OF OCTOBER 26, 1981 SPECIAL MEETING. Motion was made by John Stadler, seconded by Jaries Smalley, to approve Minutes of October 26, 1981 Special Fleeting, and by--reference are made a part hereof. Ayes - Messrs. Wasserman, Smalley and Stadler Nays - None Abstain - Mr. Spencer and Mrs. Gross Owasso City Council Page Two November 3, 1981 _ITEM 6 - REQUEST FOR CONDITIONAL APPROVAL OF THE FINAL PLAT FOR OWASSO OFFICE PARK SUBDIVISION. Mr. Thompson said the attorney for the applicant requested this item be tabled until the November 17th meeting. ITEM 7 - APPROVE ORDINANCE N0. 313 REPEA~.ING ALL SECTIONS OF THE CITY CODE WHICH CREATED THE DEPARTMENT OF PUBLIC SAFETY. Motion was made by Phyllis Gross, seconded by John Stadler, to approve Ordinance No. 313 repealing all sections of the City Code which created the Department of Public Safety, and by reference is made a part hereof. Ayes - Messrs. Wasserman, Stadler, Smalley and Mrs. Gross Nays - None Abstain - Mr. Spencer Motion carried. Motion was made by Phyllis Gross, seconded by John Stadler, to approve Emergency Clause to ordinance No. 313. Ayes - Messrs. Wasserman, Stadler, Smalley and Mrs. Gross Nays - None Abstain - Mr. Spencer Motion carried. ITEM 8 - DETERMINE ELIGIBILITY OF COUNCILWOMAN PHYLLIS GROSS TO HOLD OFFICE AS REPRESENTATIVE OF WARD 3 DUE TO QUESTION OF CHANGE IN RESIDENCE. Mr. Smalley distributed copies of General Warranty deeds showing Phyllis and Hubert Gross as the owners of property at 304 East 22nd Street and requested the Mayor to make a determination if Mrs. Gross is eligible to serve as Council- person for Ward 3. The deeds indicated her son as the owner of the home at 111 West 10th. Mr. Spencer personally hired Harold Charney to draw up an affidavit for Phyllis Gross to sign attesting that she is a resident at 111 West 10th. The affidavit was publicly read and Mr. Spencer requested it be made a part of the record. Mrs. Gross said she does reside at 111 West 10th but she would not sign the affidavit. She said her husband is living at 304 West 22nd. Mr. Wayne Vines said he lives next door to the 304 West 22nd address and he sees her there but could not verify it as her permanent address. ,~. ,,~ Mr. Jim Lambert asked how the charter reads and Mr. Charney said it is clear that the charter provides they must be a qualified elector from their ward. ~"~° Mr. Spencer commented each ward is entitled to a representative from their district. O~~asso City Council Page Three itiTOVember 3, 1931 Mr. Wasserman commented we wanted to get qualified and professional people to run the city and we are making advances in that way but the Council continuously bickers over laws and rules that are not definite. He stated he felt the Char- ter should be rewritten. He said as far as Mrs. Gross, he has seen her at both houses and tali:,ed to her at both houses and as long as she is getting down and talking to the people in her ward the Council should not worry about it. Mr. Spencer commented where the bickering all started was last i'-lay as we had a good Council until that time and feels the people from Ward 3 should have a re- presentative. ITEM 9 - REVIE?a BIDS FOR TWO EMERGENCY G1AR,NING SIRENS . Mr. Thompson recommended that the Council reject the bids that were opened and readvertise to get more competitive bids. Motion was made by John Stadler, seconded by Phyllis Gross, to reject all bids for the two emergency warning sirens and relet the bids. Ayes - Messrs. Wasserman, Spencer, Smalley, Stadler and ?~1rs. Gross Nays - clone Motion carried. ITEM 10 - CONSIDER AMENDING PERSONNEL RULES TO ALLOW PERMANENT EMPLOYEES WORK- ING 20 HOURS OR MORE PER WEEK TO OBTAIN PRO-RATA SHARE OF FULL TIME EMPLOYEE BENEFITS. Mr. Thompson's recommendation on this item was for the City to pay all of the health insurance but a pro-rated share of sick leave and vacation. Mr. Smalley's opinion was the benefit of having part-time employees is to save on paying benefits. Mr. Wasserman questioned how we would determine a permanent part-time employee and Mr. Thompson said it would be an established position in our Personnel Pay Plan. Motion was made by Phyllis Gross, seconded by John Stadler, to insert in the Personnel Rules the part-time permanent employee position as those working 20 hours or more. Ayes - Messrs. basserman, Spencer, Smalley, Stadler and Mrs. Gross Nays - None Motion carried. Mr. Charney commented everything can be pro-rated to the extent that our insur- ance will allow. Owasso City Council Page Four November 3, 1981 ~.~, ITEM 11 - CONSIDER RESOLUTION AUTHORIZING PARTICIPATION IN LITIGATION TO RE- SOLVE WHETHER THE CITY'S CHARTER PROVISION OR STATE LAW PREVAILS ON THE QUESTION OF POLITICAL ACTIVITY OF MUNICIPAL EMPLOYEES. Mr. Thompson commented the Attorney General has ruled it constitutional fQr employees to participate in political activity but the Municipal League is questioning why it does not apply to municipalities over 100,000. He said the provision was put in charters to protect the employees and keep them out of municipal politics. They are asking for financial assistance and Mr. Thompson's recommendation was not to exceed $500.00. Mrs. Gross commented employees should not get involved in politics and the greatest thing an employee can have is their vote. Mr. Stadler said he is torn two ways but still thinks an employee lives in this town and has a right to voice their opinion and in the last campaign employees did voice their opinion. Motion was made by Phyllis Gross, seconded by James Smalley, to approve a re- solution authorizing Owasso's participation in the litigation to resolve whether the City Charter provision or the state law prevails on the question of political activity of Municipal employees and limit the amount to $500.00. Ayes - Messrs. Wasserman and Smalley and Mrs. Gross `'a Nays - Mr. Stadler Abstain - Mr. Spencer Motion carried. ITEM 12 - REQUEST TO AUTHORIZE APPRAISAL OF CITY PROPERTY FOR INSURANCE PUR- POSES. Mr. Thompson said it will cost approximately $2,478.00 for the appraisal and then the balance of the specifications can be written so we can go out on bi~d~ He said we are presently in the ~'.t31'1.E?ral A~-ust2±~mt Bureau of the ?~.m-~cinal ~'~ ~~~~ League. He committed to Council he can get it appraised in about 30 days then x4.~ in about another 30 days get the group together to write the specifications. Motion was made by John Smalley, seconded by Boyd Spencer, to authorize appraisal of City property for insurance purposes. Ayes - Messrs. Wasserman, Spencer, Smalley, Stadler and Mrs. Gross Nays - None Motion carried. ITEM 13 - REVIEW BIDS ON CONCRETE WORK FOR ELM CREEK PARK. Owasso City Council Page Five November 3, 1981 Motion was made by John Stadler, seconded by Phyllis Gross, to reject all bids on concrete work for Elm Creek Park and relet 'tlie bids. Ayes - Messrs. Wasserman, Spencer, Smalley and Stadler and Nirs. Gross Nays - None Motion carried. ITEM 14 - APPROVE WARRANTS FOR PAYMENT. Motion was made by Boyd Spencer, seconded by James Smalley, to approve General Fund warrants 769 through 900 for $39,665.91, Revenue Sharing warrants 2 through 4 for $19,806.70, Park Grant warrants 8-82 and 9-82 for $1,176.92, authorize Mayor to sign same, and by reference are made a part hereof. Ayes - Messrs. Wasserman, Spencer, Smalley and Stadler Nays - None Abstain - Mrs. Gross Motion carried. ITEM 15 - ACCEPT RESIGNATION OF CITY CLERK. Mayor Wasserman read Mrs. Webb's resignation and he requested Mr. Smalley and Mr. Stadler to interview applicants. Mr. Spencer felt everyone on the Coun- cil should have a copy of the applications. Motion was made by Phyllis Gross, seconded by John Stadler, to accept Wauhilleau Webb's resignation effective at 5:00 PM on November l~, 1981. Ayes - Messrs. Spencer, Wasserman, Stadler, Smalley and Mrs. Gross Nays - None Motion carried. TT1+.M 1 h _ NPT1 RTTRTNFCC _ Item Mr. Charney requested the City to pay his mileage and expenses to attend a sem- inar at OSU and it will be on the next warrant list. Item Mrs. Gross asked Mr. Charney if he has made any attempts to sit down and nego- tiate with the attorney for Mr. Shouse and Mr. Scott regarding their lawsuits Owasso City Council Page Six November 3, 1981 a <,. against the City. Mr. Charney said their attorney is very antagonistic towards him and does not return his calls and also he has had no direction from the Board to try to negotiate. Mrs. Gross recommended Mr. Charney make one more effort to negotiate with Mr. McTighe and that Mr. Charney listen to Mr. McTighe. Item Mr. Alan Walton questioned why he received an ambulance bill when he has an ambulance subscription and Mr. Wasserman directed him to take it to the City Manager.
