HomeMy WebLinkAbout1981.05.19_City Council MinutesOn Tuesday, May 19, 1981, the Owasso City Council met in regular session in the Council Chambers at City Hall, per the Notice of Public Meeting and Agenda posted on City Hall bulletin board at 1:00 PM on May 16, 1981, and by reference made a part hereof. ITEM 1 - CALL TO ORDER. The meeting was called to order at 7:00 PM with Mayor Spencer presiding. ITEM 2 - FLAG SALUTE. Flag salute was led by Mayor Spencer. ITEM 3 - ROLL CALL. Present: Boyd Spencer, Mayor Dennis Burke, Vice Mayor Al Lambert, Councilman Phyllis Gross, Councilwoman Kenneth Thompson, City Manager Harold Charney, City Attorney Mary Griffin, Recorder Absent: Steven Clark, Councilman Wauhilleau Webb, City Clerk ITEM 4 - APPROVE ORDINANCE N0. 303 ANNEXING HILLSIDE ESTATES SUBDIVISION INTO CITY LIMITS. Motion was made by Dennis Burke, seconded by Al Lambert, to approve Ordinance No. 303 annexing Hillside Estates subdivision into the City limits, and by refer- ence made a part hereof. Ayes - Messrs. Burke and Lambert, Mrs. Gross Nays - Mr. Spencer Motion carried. ITEM 5 - APPROVE EMERGENCY CLAUSE TO ORDINANCE N0. 303. Motion was made by Dennis Burke, seconded by Al Lambert, to approve emergency clause to Ordinance No. 303. Ayes - Messrs. Burke and Lambert and Mrs. Gross Nays - Mr. Spencer Motion carried. ITEM 6 - REQUEST TO APPEAR BEFORE CITY COUNCIL BY MRS. DAISY M. GERMANY. Mrs. Germany was present and stated her case regarding the placement of her hus- band's grave. She further stated she had talked to Bill Williams and he said "nothing could be done about it". Mayor Spencer said this was a matter that Owasso City Council Page Two May 19, 1981 could be handled with the City Manager and it was agreed that Mrs. Germany would call and make an appointment with Mr. Thompson to resolve the issue. ITEM 7 - APPROVE WARRANTS FOR PAYMENT. Motion was made by Dennis Burke, seconded by Al Lambert, to approve Warrants No. 5240 through 5328 in the amount of $36,729.14, authorizing Mayor to sign same, and by reference made a part hereof. Ayes - Messrs. Spencer, Lambert, Burke and Mrs. Gross Nays - None Motion carried. ITEM 8 - PRESENTATION OF MARCH AND APRIL 1981 FINANCIAL STATEMENTS. Consensus from the Council was that there had not been enough time after the receipt of the Financial Statements to thoroughly review them and it was pre- ferred that this be put off until the June 2nd meeting. ITEM 9 - ORDINANCE AMENDING ORDINANCE N0. 233 WHICH GOVERNS THE USE AND/OR DEVELOPMENT OF FLOOD PRONE AREAS WITHIN THE CITY OF OWASSO, Mr. Charney stated that since he had not had time to study the amendment, if there was no emergency, he would like to have this postponed. P4r. Thompson is to get someone out to explain the Flood Plain program. Mayor Spencer stated it did not affect much of the immediate area in and around town, only outlying areas. This item was tabled to the June 2nd meeting. ITEM 10 - REVIEW PROPOSED ONE YEAR CONTRACT WITH TULSA PSYCHIATRIC CENTER INC. FOR TESTING OF POLICE APPLICANTS. Mr. Lambert stated this item was on the agenda at his request as it had been postponed from the last meeting. Mrs. Gross stated she thought Mr. Lambert and Dr. Clark were going to do some further study on this and Mr. Lambert said that was not his impression, he just wanted to see it before the Council. He stated it does afford some protection as it relates to a new employee in the police division. This contract has expired as Mr. Lambert stated. He likened this testing to malpractice insurance. He thought the City would be well advised to renew the contract, and if we found another psychiatric testing center that would do a better job (or psychiatrist) then we could cancel the other contract with a thirty day notice. In the meantime, he thought we should go ahead and use the Tulsa Psychiatric Center as "insurance". Mrs. Gross questioned why it was necessary to have a contract at all, would they not just do it on a person- to-person basis. Mr. Lambert stated this is the way the contract was presented last year; Tulsa Psychiatric Center wanted a contract and supposed they did this year, as they did last year. Mrs. Gross stated she thought this should not just apply to new policemen, but those that were hired with even ten years experience. Ayes - Messrs. Spencer, Lambert, Burke and Mrs. Gross Nays - None Motion carried. Motion was made by Phyllis Gross, seconded by Dennis Burke, to give psychiatric testing to ALL police applicants. Ayes - Messrs. Spencer, Lambert, Burke and Mrs. Gross Nays - None Motion carried. ITEM 11 - REQUEST TO APPEAR BEFORE THE CITY BY PAUL F. MCTIGHE, JR., ATTORNEY AT LAW. Mr. T1cTighe stated he did request in writing to appear before the Council and he is representing Mr. Ed Scott as well as Mr. Robert Shouse. He said he observed that Mr. Shouse was not afforded proper due process in that he was terminated sometime in January and did not have a hearing until the middle or latter part of March. He said he didn't want the same thing to happen to Mr. Scott. He said it was his understanding that the reason Mr. Shouse was "left handing" was that the Board had some problem in appointing a third person to the Personnel Board. He requested, if the City felt it was necessary to have three people on the Personnel Board, to appoint someone to it. Next, since Mr. Scott has re- quested a hearing before the Personnel Board, to instruct the City Clerk, who is the Secretary to the Personnel Board, to set Mr. Scott's appeal for hearing in the next ten days. Mr. Lambert asked if there was anyone who was willing to serve on the Board, who is unbiased, because just a random appointment is not sufficient. He stated he would not vote for someone "who was just plucked out of thin air". Mayor Spencer said he would not either, and that he had another problem with the Personnel Board. He said he thought Mr. Wasserman should relinquish his post on the Per- sonnel Board because he has been in close ties with Mr. Scott for the last month. Mr. McTighe said that under the City Charter we could have a public hearing to remove Mr. Wasserman. Mr. Burke stated he was going to request thwt be put on the next agenda. Owasso City Council Page Four May 19, 1981 Further discussion ensured regarding the fact that Mr. McTighe asked to dis- qualify Mrs. Odom at the hearing on Mr. Shouse and that angered her~:somewhat and she felt she could not serve the City. Mr. McTighe said he did not ask her to resign but just to be disqualified from hearing that appeal. Mr. Thompson said it would be in order to set a special meeting to take care of these items. ITEM 12 - APPROVE MINUTES OF MAY 5, 1981 REGULAR MEETING. Motion was made by Al Lambert, seconded by Dennis Burke, to approve minutes of May 5, 1981 regular meeting, and by reference are made a part hereof. Ayes - Messrs. Spencer, Lambert, Burke and Mrs. Gross Nays - None Motion carried. ITEM 13 - APPROVE MINUTES OF MAY 12, 1981 SPECIAL MEETING. Motion was made by Dennis Burke, seconded by Al Lambert, to approve minutes of May 12, 1981 special meeting, and by reference are made a part hereof. Ayes - Messrs. Spencer, Lambert, Burke and Mrs. Gross flays - None Motion carried. ITEM 14 - NEW BUSINESS. Item Mr. Burke asked we place the Personnel Board appointments on the next agenda. He said he had discussed with Mr. Charney the situation with Mr. Wasserman and that he had no desire to remove Mr. Wasserman permanently from the Personnel Board but he felt he would be biased as he has been very closely tied to Mr. Scott. He only wishes him to disqualify himself or step down temporarily for Mr. Scott's hearing. After much more discussion the Mayor called for a Special meeting on May 27th at 7:00 PM.
