HomeMy WebLinkAbout1981.03.17_City Council MinutesOn Tuesday, March 17, 1981, the Owasso City Council met in regular session in the Council Chambers at City Hall, per the Notice of Public Meeting and Agenda posted on City Hall bulletin board at 1:00 PM on March 13, 1981, and by refer- ence made apart hereof. ITEM 1 - CALL TO ORDER. The meeting was called to order at 7:35 PM with Mayor Spencer presiding meeting convened later than regular due to City elections. ITEM 2 - FLAG SALUTE. Flag salute was led by Mayor Spencer. ITEP1 3 - ROLL CALL. Present: Boyd Spencer, Mayor Robbie Fickle, Vice PZayor Al Lambert, Councilman Dennis Burke, Councilman Harold Charney, City Attorney Kenneth Thompson, City Manager Wauhilleau Webb, City Clerk Absent: None ITEM 4 - APPROVE MINUTES OF FEBRUARY 17. 1981 REGULAR MEETING. The Motion was made by Al Lambert, seconded by Dennis Burke, to approve minutes of February 17, 1981 regular meeting, and by reference made a part hereof. Ayes - Messrs. Spencer, Lambert, Burke and P1rs. Fickle Nays - None Motion carried. ITEPZ 5 - APPROVE RESOLUTION N0. 81-03 AUTHORIZING OPWA BOARD OF TRUSTEES TO BOR- RO~rI $120,000.00 AT 9% INTEREST FOR WATERLINE CONSTRUCTION TO BE REPAID FROM OPWA INCOME. Mr. Thompson explained arrangements have been made with the First Bank of Owasso to borrow this $120,000.00 to be drawn on as needed during construction. He said we will not need the full $120,000.00 and the figure includes a 10% con- tingency. He also stated Public Service Company is contributing $15,600.00 to- ward the cost; that figure being based on 410 feet of frontage on 76th Street North at $38.00 per foot. Motion was made by Robbie Fickle, seconded by Al Lambert, to approve Resolution No. 81-03 authorizing OPWA Board of Trustees to borrow $120,000.00 at 9% inter- est for waterline construction to be repaid from OPWA income, and by reference made a part hereof. Motion was made by Robbie Fickle, seconded by Dennis Burke, to approve Emergency Clause to Resolution No. 81-03. Ayes - Messrs. Spencer, Lambert, Burke and Mrs. Fickle Nays - None Motion carried. P4ayor Spencer recessed Owasso City Council at 7:39 PM and reconvened at 8:58 PPZ. ITEM 6 - REVIEW OF FISCAL 1979-80 AUDIT REPOP~T FOR GENEP,AL FUND, TRUST AND AGENCY FUNDS. Motion was made by Boyd Spencer, seconded by Al Lambert, to accept fiscal 1979- 1980 audiot report for General Fund, Trust and Agency Funds. Ayes - P4essrs. Spencer, Lambert, Burke and Psrs. Fickle Nays - None Motion carried. ITEM 7 - APPROVE RESOLUTION N0. 81-04 RESCINDING A RESOLUTION ADOPTED MARCH 5, 1974, DESIGNATING THE REGIONAL METROPOLITAN UTILITY AUTHORITY AS AGENT FOR STEP I FACILITY PLANNING FOR THE CITY OF OWASSO SEWAGE TREATMENT SYSTEM. P4otion was made by Boyd Spencer, seconded by Dennis Burke, to approve Resolution No. 81-04 rescinding a resolution adopted P~.arch 5, 1974, designating the Region- al Metropolitan Utility Authority as agent for Step I Facility Planning for the City of Owasso sewage treatment system and by reference made a part hereof. Ayes - Messrs. Spencer, Lambert, Burke and P1rs. Fickle Nays - None Motion carried. Motion was made by Boyd Spencer, seconded by Dennis Burke, to approve Emergency Clause to Resolution No. 81-04. Motion was made by Dennis Burke, seconded by Al Lambert, authorizing repayment of funds expended by RMUA on the City of Owasso's behalf for Step I Planning. Ayes - Messrs. Spencer, Lambert, Burke and Mrs. Fickle Nays - None Motion carried. ITEM 8 - PLANNING COMMISSION MINUTES OF JANUARY 15, 1981 MEETING. ITEM 9 - BOARD OF ADJUSTMENT MINUTES OF FEBRUARY 18, 1981 MEETING. Mayor directed minutes reflect receipt of the above minutes. ITEM 10 - ACCEPTANCE OF UTILITY EASEMENTS ON THE OWASSO FIRST FREE WILL BAPTIST CHURCH PROPERTY IN THE 700 BLOCK NORTH BETWEEN BEAUMONT AND CARLSBAD. Ms. Dickey reminded Council that this property was recently annexed and they now want to build onto the West side of their existing building. She said the City Engineer has requested access onto the church property to Atlanta. Mr. Thompson commented that the church was to bring a map showing the easements but no one was present with the map and he felt the Council should see what they are approving. Ms. dickey commented they will have the map at the next day's Board of Adjustment meeting. Motion was made by Robbie Fickle, seconded by Al Lambert, to accept utility ease- ments on Owasso First Free Will Baptist Church property in the 700 block North between Beaumont and Carlsbad, with the approval of the City Manager's review of the map. Ayes - Messrs. Spencer, Lambert, Burke and Mrs. Fickle Nays - None Motion carried. PZr. Charney requested Mr. Thompson's approval of the easements be indicated on the easement by his signature. ITEM 11 - APPOINTP4ENT OF FOUR MEPZBERS TO THE COMMUNITY CENTER ADVISORY BOARD FOR THREE YEAR TERMS, EFFECTIVE APRIL 1, 1981. Motion was made by Dennis Burke, seconded by Al Lambert, to appoint Ted VanCuren, Mildred Raeuber, Margaret Jestus and Helen Bush to the Community Center Advisory Board for three year terms, effective April 1, 1981. ITEM 12 - APPOINTMENT OF FIVE MEMBERS TO THE COUNCIL ON AGING FOR THREE YEAR TERMS, EFFECTIVE APRIL 1, 1981. Motion was made by Boyd Spencer, seconded by Dennis Burke, to appoint Margaret Jestus and Vernon Stokes to the Council on Aging and reappoint Clarence Brown- ing, Dale Johnson and Lois Shultz, with all five terms expiring March 31, 1984. Ayes - Messrs. Spencer, Lambert, Burke and r4rs. Fickle ~. N ' s - None Motion carried. ITEM 13 - CONSIDER LETTER FROM COMMUNITY DEVELOPMENT CABLEVISION ZINC. STATING THAT INSTALLATION OF THE TELEVISION CABLE SYSTEM IN OWASSO HAS BEEN COMPLETED AND AUTHORIZE RELEASE OF THE $10,000.00 PERFORMANCE BOND. "'"`~'°' Due to a question of some underground cable not buried, this item was tabled to April 7th meeting. ITEM 14 - REQUEST TO AUTHORIZE PAYROLL DEDUCTIONS FOR FRATERNAL ORDER OF POLICE LODGE DUES AND INTERNATIONAL ASSOCIATION OF FIREFIGHTERS DUES. Motion was made by Dennis Burke, seconded by Al Lambert, to authorize payroll deductions for Fraternal Order of Police Lodge dues and International Associa- tion of Firefighters dues. Ayes - Messrs. Spencer, Lambert, Burke and ilrs. Fickle Nays - None Motion carried. ITEM 15 - REQUEST AUTHORIZATION FOR LEGAL SERVICES TO NEGOTIATE COLLECTIVE BAR- GAINING AGREEr~NT WITH INTERNATIONAL ASSOCIATION OF FIREFIGHTERS. P~Ir. Thompson informed Council that Jim Lindsey has been recommended by OML to represent the City during the collective bargaining. P4r. Charney said he would like to be present during the bargaining sessions without any charge to the City. Mr. Charney also said Mr. Lindsey's fee should be approved by the City Council. Owasso City Council r4arch 17, 1981 Page Five Motion was made by Dennis Burke, seconded by Al Lambert, to allow City Manager to hire Mr. Jim Lindsey to assist the City in the collection bargaining nego- tions as long as he feels Mr. Lindsey's fee is within reason. Ayes - Messrs. Spencer, Lambert Burke and Mrs. Fickle Nays - None Motion carried. ITEM 16 - APPROVE RESOLUTION N0. 81-05 AUTHORIZING EXECUTION OF AN AGREEMENT JOINING THE OKLAHOMA MUNICIPAL LEAGUE MUNICIPAL ASSURANCE GROUP. Motion was made by Boyd Spencer, seconded by Dennis Burke, to approve Resolution No. 81-05 authorizing execution of an agreement joining the Oklahoma Municipal League Municipal Assurance Group, and by reference made a part hereof. Ayes - Messrs. Spencer, Lambert, Burke and Mrs. Fickle Nays - None Motion carried. ITEM 17 - APPROVE RESOLUTION N0. 81-06 AUTHORIZING APPLICATION TO OKLAHOMA WATER RESOURCES BOARD FOR 20 YEAR WATER RIGHTS FROM OOLAGAH RESERVOIR. Motion was made by Al Lambert, seconded by Robbie Fickle, to approve Resolution No. 81-06 authorizing application to Oklahoma Water Resources Board for 20 year water rights from Oolagah Reservoir for 2,200 acre feet per year and authorizing Mayor to have power of attorney for the City in making application for the water rights, and by reference made a part hereof. Ayes - Messrs. Spencer, Lambert, Burke and Mrs. Fickle Nays - None Motion carried. ITEM 18 - REQUEST TO PURCHASE MINI-DISK DRIVE FOR BURROUGHS COMPUTER. P-Zotion was made by Boyd Spencer, seconded by Al Lambert, to purchase a mini-disk drive for the Burroughs computer. Ayes - Messrs. Spencer, Lambert, Burke and Mrs. Fickle Nays - None Motion carried. Owasso City Council March 17, 1981 Page Six ITEM 19 - DISCUSS PROPOSED CHANGES IN THE PERSONNEL RULES ALLOWING POLICE AND FIRE CADET POSITIONS AND INCREASING AUTOP9OBILE MILEAGE ALLOWANCE FROM .15 CENTS TO .17 CENTS FOR PRIVATE AUTOMOBILE. Mr. Thompson commented we have had requests for employment in the Police and Fire Departments of individuals under 21 years of age and these people could be utilized in a Cadet position at a reduced rate until they are age 21. He said it gives them a chance to see if they actually want that position as a career. He said an alternate to the Cadet position could be to lower the age limit for these departments. Mayor Spencer said he would not like to see us go any lower than 20 years of age and Mr. Charney responded that 18 is the legal age and we should not have any trouble legally if we elect to lower the age to 18. Mr. Lambert said he would be in favor of reducing the age to 18. Dennis Burke said he would be in favor of establishing a Police and Fire Cadet program with a minimum age of 18 and retain them for a full two years on parole then at the age of 20 establish them as a full status Policeman or Firefighter, passing the regular physical as required by the departments. Also he would be in favor of establishing as part of that policy half of any schooling would be ~;., paid by the City. PZr. Lambert was concerned that if we do not have a committment from them re- garding any schooling that as soon as they receive their training they are free to leave us and we lose all their training expense. Mr. Burke agreed that a committment should be part of the agreement but Mr. Charney advised that you cannot make an employee a "slave" to you. Mayor Spencer directed this item be passed to another meeting. Motion was made by Dennis Burke, seconded by Al Lambert, to increase automobile mileage allowance from .15 cents to the federal allowable allowance of .20 cents per mile. Ayes - P4essrs. He said there are problems with expenditures that have been charged into incorrect areas. Mr. Burke questioned the problem with being over the budget in the Park Department and Mr. Thompson said it is mainly the fencing. Mayor Spencer complimented Bob Fugate's financial statements. Ayes - Messrs. Spencer, Lambert, Burke and Mrs. Fickle Nays - None Motion carried. ITEM 21 - APPROVE WARRANTS FOR PAYMENT. Motion was made by Boyd Spencer, seconded by Dennis Burke, to approve General Fund Warrants 1427 through 1730 for $124,918.94, Revenue Sharing Warrants 48 through 56 for $2,824.65 and Park Development Warrants 5 through 8 for $410.90, and authorize Mayor to sign same. Ayes - Messrs. Spencer, Lambert, Burke and Mrs. Fickle Nays - None Motion carried. ITEM 22 - NEW BUSINESS: Mayor Spencer advised the public that there will not be action taken on any new business but items could be requested to be placed on next agenda. Item Mr. Burke suggested we go to the people in Collinsville to see if they would furnish us treated water to prepare ourselves for a bad summer. Mayor Spencer commented that unless we get some heavy rains there is no doubt we will have water problems this summer. Mr. Thompson commented on the proposal to bypass the pump station at the top of the hill and feels it would be beneficial to the North end of the City as far as water pressure. He said we could do most of that work with our own staff. Mr. Thompson was directed to talk to Collinsville and bring back information to the Council. Item Council thanked Mr. Hollis Weatherl for his assistance with the fencing at Rayola Park.
